Wright Construction TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 3 of 9 Company. He stated this will have no impact on the Sinclair Landing Project because the company is not "disappearing", it is only changing its name. Currently, the preliminary design of the Bremerton Transportation Center is being completed, and also for the commercial development and parking garage around it. A Planned Unit Development application is planned for submittal at the end of August, or first part of September, which will involve a formal review process with the Planning Commission. A marketing package is being developed to describe all of the positive aspects of the development to attract commercial tenants. The early stages of acquiring property has also started, starting with the largest parcels. PUBLIC RECOGNITION Doyle Detroit, Westsound Community Access Television, stated in the next few weeks they will be taking over management from BCAT. She announced the Board of Directors will be meeting Monday, August 12, at 6:00 P.M., at Canterbury Manor in the Library; and the public is welcome. Ms. Detroit announced Nadine Price, a City employee under the access television program, will become a Westsound employee. She commended Nadine for the wonderful job she has done over the past six weeks keeping the public access television program running in Bremerton. Ed Pietras, President, Martin Luther King Memorial Scholarship Fund, announced the Constitution Day Luncheon will be held September 15, 1996, 1:30 P.M., which will include the award of the Bridge Builder Award to Kitsap County Commissioner Win Granlund. Emily MoshaV stated several months ago the City Council approved the fezone of some property off of Wheaton Way and Broad street for the purpose of building affordable houses. She had the pleasure of attending the opening of that development approximately three weeks ago, and was delighted to see a well designed project that provides affordable housing in the City of Bremerton. In this phase, the builder is offering veterans and military the opportunity to purchase the homes at "0" down and $2,500 of the closing costs paid by the builder. In addition, the builder is offering a free refrigerator or washer and dryer to home buyers. It saddened her to report that someone stole her flower barrel on the corner of Pacific Avenue and Burwell Street between the hours of ll:30AMand 7:00 PM. She asked that anyone having any information about the whereabouts of her flower barrel to please report it to the Bremerton Police Department. Roy McInnis expressed his concern over an incident involving his daughter's children locking themselves in a vehicle at his residence on Tuesday and the slow response by Bremerton Police Department after a call was made to 911. His daughter did not have TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 4 of 9 a key to the locked vehicle and she was alarmed about the children being subjected to excessive heat within the vehicle. She called 911 at approximately 12:30 P.M., reporting she did not have a key to the locked vehicle and the fact she believed her 1-year old son was headed toward suffocation. Mr. McInnis was under the impression that the 911 system allowed the dispatcher to immediately identify the location of the caller. He also understands that 911 needs all the requested information, but he is appalled over the fact that after the call was made and the requested information given it still took Police Officers/emergency personnel approximately 20-25 minutes to respond, considering his residence is only 2-minutes away from the City's Fire station on Olympus Drive. He was away from his home at the time the incident took place; however his daughter was finally able to contact him directly in order to obtain a key to the vehicle and rescue her children. The Police Patrol arrived after the key was made available by him driving from Sinclair Missionary Baptist Church to his East Bremerton residence. He would like to learn what actually took place to better understand the slow response of the Police Department. He has heard of similar experiences of slow responses to 911 calls and feels something needs to be done to respond in a more timely manner to citizen emergencies. President Law assured Mr. McInnis would be contacted. Carol Atkinson, Bremerton Main Street Association, reminded everyone of the two remaining Concerts on the Boardwalk scheduled for August 9 and 16. Even though the last concert experienced cooler weather, they still had a good crowd. She noted Councilman Montgomery has not missed a Concert on the Boardwalk in two years. 7A - PURCHASE SCAT TRAK MODEL 1700AND ATTACHMENTS: GRINDER, BROOM, BUCKET, AND EXTRA SET OF GRINDER TEETH; AND APPROVAL OF BUDGET ADJUSTMENT NO. 96-26, #AB96-167 Current equipment is on Pierce Company bid with which the City has reciprocal agreement, no bid is required. Total price with attachments minus rental agreement reduction is $31,582.61. Funding available is a one time State settlement amount of $35,854.00. Equipment will be placed in Equipment Rental Reserve Fund. Gene Sampley, Public Works and Utilities Director, stated the City received notification last year of a one-time settlement amount of up to $40,000; however the actual amount received from the City Hardship Assistant Account Distribution was $32,850 in a redistribution of revenue previously collected. In addition, the City received a Petroleum Products Antitrust Litigation amount of approximately $3,000. Those two items total $35,850. The City, in anticipation of the funds, leased a piece of equipment to be used #0945 TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 5 of 9 in the City's asphalting patching program, which has contributed significantly to the productivity in the Street Department. The equipment has been used for approximately three months and with the distribution of the identified monies, the City can purchase the subject equipment. A Budget Adjustment is provided for Council's consideration in the amount of $31,582.61. He noted also available is a 3-year extended Warranty at a cost of approximately $900. He recommended taking the 3-year Warranty and approving expenditure of that amount as well; thereby amending the Budget Adjustment to $32,500.00 to cover that amount. Public comment - none. Mr. Montgomery stated he strongly supports approving this request based on his having seen the subject equipment in operation on Marine Drive; and when the City has the proper equipment they can do a good repair job. M/S/C/U(Montgomery/Huff-Menees) to approve the purchase of Scat Trak Model 1700 and attachments to include a 3-year Warranty; and approving Budget Adjustment No. 96-26, as amended. 7B - COMMUNITY DEVELOPMENT BLOCK GRANT 'HOME' POLICY PLAN, #AB96- 168 Attached is the draft 1997 CDBG/HOME Policy Plan which was presented to potential subrecipients at an advertised public meeting on July 25, 1996. The Plan identifies the CDBG rules and regulations, as well as the City's allocation process. A new rating and ranking system is included. Debbie Peavler-Stewart, Department Of Community Development, stated the 1997 CDBG/HOME Police Plan provides requirements and regulations concerning Community Development Block Grant and HOME programs. These programs are available from the Department of Housing and Urban Development to provide funds for activities to benefit low income persons throughout the City of Bremerton. Some of the activities funded in the past are: day care, health care, food banks, housing rehabilitation, recreation facilities, and rehabilitation of the Community Clinic. The proposed Policy Plan is similar to the 1996 plan with the exception of a Rating System, which will be used by the Citizens Advisory Committee in selecting projects to be recommended to the City Council. One of the major elements of the Rating System is the Planning Element, which requires coordination among the agencies. The draft plan has been available since July 16 and a meeting was held, and so far all public comments on the plan have been favorable. Public comment - none. TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 6 of 9 Mr. Overson noted this issue was discussed at the Fiscal and Budget Committee and he complimented Mrs. Peavler-Stewart on her rapid implementation of the comments made during that discussion. Mr. Colvin echoed Mr. Overson's remarks and questioned if there are any provisions for requiring the upkeep of properties where people take advantage of these programs? Mrs. Peavler-Stewart stated the CDBG and HOME programs can be used for home rehabilitation and in the deed restrictions it does have an element of maintenance of the property and they are looking into ways to monitor that requirement. Mr. C01vin questioned if the City had a way to monitor the properties? Mrs. Peavler-Stewart explained any time CDBG or HOME money is used for an activity it has to remain eligible and maintained for five years. Mr. Farr pointed out one of the stated approved uses was for day care. He announced the following key deadlines for making application for these fund: 5:00 P.M. September 13, 1996, City of Bremerton Neighborhood Development Department; and assistance with an application can be obtained by calling Mrs. Peavler-Stewart 478- 7996 or Marylyn Waibel at 478-5375; and a Pre-Application Workshop will be held August 21, 1996, at the Public Works and Utility Building Conference Room 327 Olympus Drive, Bremerton, WA 98310. He reminded residents in District #6, who had some concerns about a day care in their area. Mrs. Pearlet-Stewart stated for clarification that if a neighborhood organization wants to form a day care, this might be a source of funding. The people served under the CDBG and HOME funds have to have at least 51% of them be low income. In the City of Bremerton, a family of 4 is considered to be low income if they make less than $35,900 per year. Mr. Winters asked when would Council be receiving the funds? Mrs. Peavler-Stewart stated generally the funds are received in March; however it does depend on congressional action. Even though an activity is funded from January through December, the funds usually arrive in March of that year. This year, the funds were not received until last month (July) because of congressional activities. Mr. Winters asked if she could explain to the public, the presentation she is attending tomorrow. Mrs. Peavler-Stewart stated there are a number of different entitlement communities within the State of Washington, and there will be a celebration of the CDBG Program. The City of Bremerton has been an active recipient of the CDBG Program since 1974, and quite a few different activities have been funded that have benefited people throughout the City. The Rehabilitation Program is one, and is also the most noticeable. There are a lot of other activities funded as well, such as laying carpeting and vinyl in a day care center. #1255 TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 7 of 9 Mr. Oversen stated the primary benefit, in his opinion, is that it takes subjectivity out of the scoring process, and makes it objective. That way, the recommendations for distribution of funds that Council will receive next year, will have a rating number, which will eliminate a lot of discussion, and will make the selection process easier. Mr. Colvin wanted clarification on low- income limits. Mrs. Peavler-Stewart stated 51% of people who benefit from any specific activity must be low-income (within the City of Bremerton, that would mean, a four-person family with yearly income less than $35,900). Mrs. Muff-Menees is also pleased to see the rating system in place, and will help the committee making the recommendations to Council, and will certainly make it more of an objective process. Public comment - none. M/S/C/U(Huff-Menees/Montgomery) to approve the draft 1997 CDBG/HOME Policy Plan as presented. 8A - ORDINANCE NO. 4563 (SECOND READING) AMENDING SIZE OF PLANNING COMMISSION FROM 9 TO 7 MEMBER8, #AB96-165 Roy McGinnis, questioned the reason why this is being proposed? Don Pratt, Executive Secretary for the City of Bremerton Planning Commission, stated the Planning Commission adopted a Resolution that stated they found internal procedures, or their ability to process information, and handled public debate flourished with 7 members, rather than 9. This happened initially due to 2 positions being vacant last year. They also found they had a broader range of points-of-view from 7 members rather than 9, due to the fact that with 7 members, they all had a chance to speak. Based on those issues, they are making this recommendation. Mr. Colvin stated for clarified that this recommendation was only for the Planning Commission, and not City Council? President Law stated that was correct. Mr. Winters stated he voted no on this issue last week, and will continue to do so, because he feels that there are qualified people in the City to serve on the Planning Commission, and although the Commission may like to work with 7 members, there is opportunity for additional opinions with 9 members. He also feels it is important to have more public input, not less, and that is why he will vote for 9 members rather than 7. Mr. Farr stated he will also vote no, because 9 members versus 7 allows for two additional people to participate and become actively involved in local government. #1570 TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 8 of 9 Mrs. Huff-Memees stated her reason for voting no was because the motion included a requirement that the Commission members be residents of the City. In the past, the Commission has allowed Commission members to serve, even if they resided elsewhere, but operated a business within City limits, and that has served the City very well for a number of years. She does, however, support the Commission recommendation to reduce the Commission from 9 members to 7 because this recommendation comes directly from the Commission, and she is inclined to give that a great deal of consideration. Mr. McConne11 stated the requirement that members of the Commission be City residents was included in the motion because the City Charter required it. Mrs. Huff-Menees stated the City Attorney pointed out, at the previous Council meeting, that the ordinance supersedes the City Charter in this instance, so that issue was put to rest. Council will not be violating the City Charter by leaving it as it is currently. Mr. Colvin asked the City Attorney to comment on Mrs. Huff-Menees' last statement. Ian Sievers, City Attorney, stated Councilman Huff-Menees' comment reflects accurately what he stated at the previous Council meeting. He does not believe the ordinance violates the provision in the Charter on Committee and Board membership. Mr. McConne11 challenged the statement that an ordinance supersedes the City Charter. Mr. Sievers stated Mr. McConnell was correct, an ordinance cannot supersedes the Charter. The Charter makes allowances for exception to the residency requirement by ordinance. Mr. Colvin pointed out at the previous Council meeting a statement was made that the Planning Commission seldom had nine members in attendance at their meetings. M/S/C(Montgomery/McConnell) to pass Ordinance No. 4563 on second reading, reducing the size of the Bremerton Planning Commission from nine to seven members; including striking out " and electorates of Kitsap County, and amending Bremerton Municipal Code Section 2.12.010. Vote On Motion: Motion carried. In Favor: Opposed: Montgomery, Overson, McConnell, Law, Colvin, Neville Winters, Huff-Menees, Farr 8B - ORDINANCE (FIRST READING) EXTENDING INTERIM PROCEDURES FOR LAND USE PERMIT HEARINGS, #J&B96-169 Ordinance No. 4550 established interim procedures for conducting hearings and appeals on Land Use Permits as required by RCW Chapter 36.70(b). This ordinance was effective May 3, 1996, and was limited to 90 days in duration. The Planning Commission and #1645 TAPE #1397 City Council Reg. Mtg. Minutes August 7, 1996 Page 9 of 9 Council have deliberated on permanent procedures, but it appears Bremerton Zoning Code test changes implementing these changes will not take effect for at least 2 months. Public comment - none. M/S/C/(McConnell/Colvin) to approve ordinance on first reading, extending interim procedures for Land Use Permit Hearings and amending Ordinance No. 4550.
