9B ORDINANCE (FIRST READING) AMENDING CHAPTER 13.04.140 OF THE
BREMERTON MUNICIPAL CODE. TO ALLOW THE SALE OF ALCOHOL DURING THE
"BLUES MUSIC FESTIVAL" ON SUNDAY, JULY 18. 1999. #AB99-114
Charlene Burnett, Parks & Recreation Department, requested an amendment to Bremerton
Municipal Code section 13.04.140 to allow the sale of beer and wine at the Blue Festival on
Sunday, July 18, 1999 from 12:00 noon - 7:30 P.M. at Pendergast Field. Ms. Burnett
provided a brief overview. She clarified that the City would have an agreement with a private
contractor, who will carry a $1 million bond. This agreement will also be reviewed by the
City's Risk Manager and City Attorney.
Leon Mhyers, Special Events Coordinator for Kitsap County, addressed the issue of liability,
and reviewed various issues that could be considered to address concerns.
Pat Tucker Security Director of the Fairgrounds Board, described his positive experience
with various beer gardens at County events.
Roger Pascal Past President of the Bremerton Athletic Roundtable, stated that there has
been success in generating revenue through the use of beer gardens and that the
Roundtable would provide the liquor permit for the event on July 18th.
Members of the public who spoke in opposition to this amendment:
Lauralee Hanson: Elizabeth Buell; Marsha Masters (President of Kitsap County Mothers
Against Drunk Drivers [MADD]); John Becker, who asked how much income this event is
expected to generate, questioned if $1 million would not be enough liability, and was also
concerned about the precedence this would set; Del Knauss, who asked if the Mayor
discussed this issue with the City Attorney, did the City Attorney discuss the issue with the
Risk Manager, and read a statement from the Kitsap County Chapter of MADD (Mothers
Against Drunk Drivers); Roy Mclnnis: Ruth Natividad; and Susan Brown.
John Thomas suggested if this was going to be done, that the ordinance be permanently
changed, rather that a one-time amendment that must be amended each year.
Roy Runyon asked if Kitsap Transit was assisting with free public transport for this event.
Ms. Burnett responded to questions as posed by citizens (1) Who is to police the facility?
The Non-profit organization will hire security for the event and alcohol servers will check for
levels of intoxication (2) Why is there only a one-time request? Since this is the first time
such a request has been made, and Council indicated support on a trial basis, it was decided
that a one-time request would be made rather than an overall amendment to the ordinance.
(3) How much profit is expected to be generated by this event? It is not known how much
profit would be generated. However, comparable events such as Whaling Days, generate

about $20, 000 net profit and Rodeo Days, generate $5,000 net profit. Both events have a
long standing history and success. (4) Is there a provision for public transport? No
communication with Kitsap Transit regarding transport of attendants to their homes has been
conducted.
Mayor Horton confirmed that communication with the City Attorney and Risk Manager did
occur.
Glenna Malanca discussed the possibility of sending a memo to Council regarding
communication between the Mayor and Attorney, and Attorney and Risk Manager, as those
discussions can be considered confidential.
Ms. Arends does not support the one-time request.
Mr. Overson mentioned predominant opposition to the sale of alcohol in a recent phone poll.
Mr. Reed supported the request and indicated that fear is impacting the City.
Mr. Farr stated it's a matter of precedent. He feels it's a move in the wrong direction.
