Zion Missionary Baptist Church this Friday evening beginning at about 10:00 P.M. and to attend a Spring Revival happening all week, beginning on May 10, at Sinclair Missionary Baptist Church 9A - LEASE OF WATER UTILITY LAND FOR IN-VESSEL COMPOSTING AND WOOD WASTE PROCESSING FACILITY. #AB99-076 Edwards Forest Products of Port Gamble, WA has requested leasing Water Utility land for the purpose of operating an in-vessel composting and wood waste processing facility. Current zoning of the site is industrial. The proposed operation uses technology that has successfully operated elsewhere. The proposed facility would have the capability of processing wood waste, yard waste, and biosolids into high quality compost for resale. An operation of this type is referred to in the November 6, 1998 draft of the Kitsap County Comprehensive Solid Waste Management Plan as an effective element of overall waste management in the country. This facility could also provide an alternative for the City's Biosolids Management Program and lessen the City's dependence on land application. Bill McKinney provided the staff report. He stated his Department has reviewed the system, as well as a similar system in another area. He reported this facility would provide a benefit to the community as a place to dispose of yard waste. He stated this Lease is only the first step in achieving a successful facility. The process being proposed is an "in-vessel" system, where the composting takes place in contained vessels, completely sealed to control odors and eliminate leachate. An additional benefit is that it provides an alternative for the City's Biosolids Management Program and lessens the City's dependence on land application. Public comment - none. Mr. Reed spoke in support of this project. Mr. Overson voiced his concerns that Council is signing a "blank check", and asked for additional information on the costs of processing biosolids. Mr. McKinney answered that a firm price will not be available until Edwards is well under way, but an estimated range would be approximately $30-$40 per wet ton. Following establishment of a lease agreement, the actual price of the project can then be determined. He did assure Council the price would be "competitive". Gene Sampley, Director of Public Works & Utilities, elaborated that the various conditions placed on the project would determine the operating costs. He did not feel it was necessary to tie up the process with a condition that cannot be met. Ms. Malanca offered a solution, which would be to add general parameters to the rate in the lease agreement, rather than using the subjective term "competitive". Mr. McConnell asked if the facility would be allowed for public use. Mr. McKinney replied yes, and that the public use is so stated in the lease agreement. TAPE #1614 City Council Reg. Mtg. Minutes May 5, 1999 Page 4 of 4 Mr. Law stated there have been two study sessions on this issue already, and noted that Edwards Forest Products have been cooperative in answering questions and concerns. He stated that if prices became excessive, the facility would then not be used, since use is optional, therefore he did not feel "parameters" were necessary. Mr. McKinney also pointed out that there is language in the lease agreement that states the City has no obligation to provide yard waste to the facility. Mrs. Arends was pleased there would be an alternative to burning yard wastes, but asked for additional clarification on whether Council was only considering the lease agreement, and not a "finished product". Mr. McKinney stated that it depends how much Council wants to be involved in the process, since they must meet numerous parameters with multiple entities. Mr. Farr thanked Edwards Forest Products for taking the time to modify the location of the proposed site, and can now support this proposal. He stated the blanks on the open price for processing biosolids, and price per wet ton should be determined, even if on a broad range, based on currently known information to remove the competitive term. Mr. Overson noted the liability concerns raised by the City's Risk manager, and stated that even though there is possible risk with this project, there also appears to be possible benefits, however he suggested a rate parameter of $30 - $40. Mr. McKinney stated the cost $20 - $40 per wet ton could be added to the lease agreement. Mr. Shepherd pointed out the main purpose of the lease is to generate income, and developing alternatives to burning yard waste. #1830 M/S/C/U (Overson/Olsen) Motion to approve the attached lease for Water Utility property to Edwards Forest Products of Port Gamble, WA, including supplemental language at the end of Schedule II to read: Payments to be negotiated will be competitive i.e. $20 - $40 per wet ton, with current operation costs of the City. Lessee will have the capability to handle approximately 50% of the City's current operation. The final negotiated amounts will be subject to City Council approval. Also authorize the Mayor to execute the attached agreement in accordance with established Administrative Policies & Procedures. With no further business meeting adjourned at 6:30 P.M.
