9A - PUBLIC HEARING ON RESOLUTION NO. 2698, REGARDING RECOVERY OF
FEES FOR THE ABATEMENT OF PROPERTY LOCATED AT 1929 9TH STREET,
#AB99-061
On February 16, 1999, the City removed garbage, debris, and appliances from the
property located at 1929 9th Street after the owners, Estate of Harold and Nita Schott
failed to do so as ordered by the Building Official. The cost of the action, including
administrative fees, totaled $1,705.60. Council must now decide if the fees are just and
reasonable, and how they should be collected.
Janet Lunceford, Building & Development Specialist II, discussed the process that
has taken place to date for this abatement, which began as a weed abatement. Upon
removing the weeds, appliances, tires, and other garbage were discovered and
removed. No heirs were identified during this process.
Public comment - none.
Mr. Montqomerv asked how many "Administrative" hours are necessary to perform
abatements. Ms. Lunceford explained approximately 25 hours. Each year, the costs
increase due to normal cost of living raises. She also described why the difference in
fees between "garbage" or "weed" abatements ($584); and "dangerous building"
abatements ($819). She pointed out that if the City did not charge the owner of the
property the "Administrative" fees then the taxpayer would indirectly be charged.
#0836 M/S/C/U (Montgomery/Olsen) Motion to pass Resolution No. 2698, ordering that
the fees incurred for the abatement of garbage, debris, and appliances located at 1929
9th Street be collected as reasonable abatement costs and become a lien against the
property.
With no further business meeting adjourned at 6:00 P.M.
