He wanted to wish him well and hopes he enjoys his retirement years. He also thanked him for his service to the community. Part of this service to the community included his involvement as chairman of the Lion's Eye Bank "White Cane Sales". To all citizens who had prescriptions with Smalley's, they are now handled through PayLess on Kitsap Way. Mr. Colvin echoed Mr. Winters comments on Jack Smalley. He also wished Dr. Tom Proteau well, who is a dentist in downtown Bremerton, and is retiring after over 20 years service. He commented that District 1 had a great meeting January 19th, and TAPE #1260 City Council Reg. Mtg. Minutes January 25, 1995 Page 2 of 7 they now have a new "honorary member"... Mr. Carlos Montgomery, Councilman for District 8. Mr. Montgomery was already given a task regarding a sewer bill by a District #1 member, and was pleased that Mr. Montgomery acted on it immediately, and will report back soon. Mr. Dawkins also echoed the sentiments heard previously on Mr. Smalley and Dr. Proteau. He feels they are both distinguished people, and have done an excellent job as businessmen in the City of Bremerton. He commented on the beautiful weather. Mr. Montgomery commented that the Mayor was responsible for the weather over the weekend! He had the privilege of attending the commissioning ceremony for the USS Rainier plus two receptions, and found all activities to be outstanding. It was refreshing to see our young men and women dedicated in their chosen careers and serving our country. To Captain Daneker and the crew, may God bless and guide your ship wherever you may be, we welcome you to our City, and trust that you will join in all community activities and feel free to share ideas and concerns. Mr. Law wished the USS Rainier and it's crew a "fair wind and following sea". There was an excitement, thrill, and spirit to the occasion which he felt was refreshing at the "commissioning" program, instead of the "de-commissioning" of a ship, which can be almost like attending a funeral. He announced District #3 will be having a Neighborhood meeting the third Tuesday of next month, February 21, 1995. The subject will be "What To Do In Case of a Disaster", and there will be some fantastic people on hand to give us some observations. More information will be coming. Mr. Farr wanted to remind citizens about the combined District 6, 7 and 8 meeting coming up on Thursday, February 2, 1995. He would like to see the same type of involvement that has been shown in other districts. He also commented on articles in the newspaper -lately showing new growth in businesses in areas around the City, and is hopeful that the work this Council and City staff is doing will lead Bremerton in that same direction. Mr. Overson commented on the retirements mentioned earlier, and the sadness felt. He felt Dr. Proteau was one of the best dentists he has known and was great to him and his family. He also felt that the commissioning of the USS Rainier was a wonderful event, and it was grand to welcome a new ship into the City. As far as Mr. Farr's comments, he agreed that good news for Bremerton is bound to come sooner or later, and to please "stay tuned". Mrs. Huff-Menees wished to welcome anyone from Districts #6, #7, and #8 -- or any other district to attend the meeting February 2, TAPE #1260 City Council Reg. Mtg. Minutes January 25, 1995 Page 3 of 7 1995 at the Bremerton School District office located at Burwell & Montgomery. The Mayor will be there along with the new Police Chief, and new information on plans for the upgrade of Forest Ridge Park.' She also agreed that the commissioning of the USS Rainier was a wonderful event. She said there were so many people there to take part in the ceremony, and she was glad to be a part of it. MAYOR'8 REPORT Thanked the Council members and community for their overwhelming support at the USS Rainier event. She felt this typified what Bremerton is all about. In September, Bremerton would also like to host another event, the 50th anniversary of the signing of the treaty aboard the USS Missouri. The Mayor did meet with the Parks Commission last night, and they discussed the Roosevelt Field Replacement Plan. She feels that a lot was accomplished. One of the top priority issues was Evergreen Park. Also, she would like to take credit for the sun and the nice weather we have seen lately, since when the weather is bad, Bremerton gets all the "boo--hisses"! PUBLIC RECOGNITION Jack Lefcoski, also wanted to congratulate Mr. Jack Smalley on his retirement. He also commented that there is now an empty drugstore, and the space is available for a new business, and any person interested can contact the Red Apple grocery right next door. There are also many other buildings that need filling. Jerr~ Soriano wanted to bring to the City's attention that on the corner of Burwell and Chester, next to a home owned by him, someone has been stacking up pieces of concrete almost 10 feet high. It is getting worse, and he wants someone to look into it, and resolve the problem. Charleen Burnett, Parks Department, invited the public to attend a Latin Jazz performance by the band "SONANDO". They are from Seattle, and will be performing Saturday, January28, 1995, at 8:00 P.M. at the Bremerton Community Theater. This is part of a new program at the Parks Department to further cultural enrichment in the City. Tickets are $8.00 in advance at the Parks Department or $10.00 at the door the night of the performance. She encourages all to attend. On February 10, 1995 at Mountain View Middle School, the Bremerton Police Department, D.A.R.E. Program, and the Parks & Recreation Department, along with Mountain View Middle School will have a "DARE To Have Fun Night!", 7:30 P.M. to 10:00 P.M. Please call 478-5305 for more information. #0565 TAPE #1260 City Council Reg. Mtg. Minutes January 25, 1995 Page 4 of 7 Sandy Ward new Director for the Visitor & Convention Bureau, was here to say "hello", and also to say that she is very happy to be in Bremerton. She looks forward to getting better acquainted with the Council, and especially getting better acquainted with Bremerton. 7A - REOUEST TO CONSIDER A LETTER OF INTENT FOR THE ANNEXATION OF THE ALPINE AREA INTO THE CITY LIMITS OF BREMERTON, #AB95-012 This is the initial step in the Petition method of annexation. This action will initiate steps to bring the parcel into the jurisdictional boundaries of the City of Bremerton. According to State Statute RCW 35.13,125, the City Council must determine the following: a. Will the City Council accept, reject, or geographically modify the proposed annexation area as presented; and b. Will the City Council require the simultaneous adoption of a comprehensive plan and land use designation for the area, or allow provisional default zoning as described in BMC 21.02,260; and c. Will the City Council require the area to assume proportional share of existing City indebtedness. its Ian Sievers, City Attorney, is presenting this Agenda Bill for Terrie O'Neill, and to answer questions. He point out the map, found on page 15 of the Council Packet, showed the approximate 7 acre parcel in the shaded and "cross hatch marked" area, and the piece next to it (the area just "shaded", as owned by the Port of Bremerton. The annexation of the 7 acre parcel is subject to a purchase agreement with the Port. One of the main concerns here is that this united parcel' be subject to one jurisdiction, so both parcels will eventually end up being in the City instead of one in the County and one in the City. M/S/C/U(Dawkins/Colvin) motion to a) approve the Notice of Intent to allow the process to move ahead; and b) Require the pre- annexation zoning and land designations to be adopted with the annexation of these lands; and c) Require the area to assume a proportional amount of existing City indebtedness. Mr. Dawkins mentioned the evaluation by the Kitsap County Assessor $37,950. 7B - PROFESSIONAL SERVICES AGREEMENT WITH PARAMETRIX, INC./INTERIM MANAGEMENT OF PUBLIC WORKS & UTILITIES, #AB95-013 Approval of a Professional Services Agreement with Parametrix is TAPE #1260 City Council Reg. Mtg. Minutes January 25, 1995 Page 5 of 7 requested for management consulting services forinterim management of the Department of Public Works & Utilities. Mayor Horton reminded Council that Mr. Sampley had worked with the City of Bremerton approximately 2 years ago. Since Mr. Sampley has been working with the City the past 1/2 weeks, she has been very impressed with his high level of expertise. She believes that Council will feel comfortable with his presence during this interim time. Mr. Colvin asked the Mayor to explain to the citizens what Parametrix, Inc. does for the City. MaYor Hotton explained that Parametrix is an engineering consulting firm and the City already has several contracts with.them, however, during the length of this particular contract with Mr. Sampley, he will not be having any involvement with those contracts. Up to this point, Randy Witt, City Engineer, has been the lead agent with all of those contracts, and he will continue in that role so that we will not have any conflict of interest, or an appearance of fairness issue. Mr. Colvin questioned the term of the contract? Mayor Hotton answered through the end of April. Ideally, the City was looking at not having it that long, but wanted to make sure that all bases were covered in case more time was needed. Mr. Overson stated he was uncomfortable with this proposed contract because according to the proposal, Mr. Sampley would be paid $2,280 per week, and the. on~ statement as to what that individual will be doing is "Management Advisor". There are no goals and objectives, nor any products. He questioned what is the substance for what the taxpayer is paying? Mayor Hotton asked if Mr. Overson was requesting a "scope of work"? Mr. Overson stated yes. Mayor Hotton stated she had no problem if Council wanted to table this item for one week so she could provide a Scope Of Work. She emphasized essentially Mr. Sampley will be providing interim- management of the Public Works Department. And, he is already working with Metcalf & Eddy on the Sewer Treatment Plant issues, he has been interfacing with Randy Witt on the Sewer Treatment Plant upgrades, handles day-to-day operations with the Street Department, Engineering, Electronics, and the whole Public Works operation. Mr. Overson stated he would like to see all that written out, and questioned if Council would get an update periodically as to how it is all going? Mayor Hotton stated Mr. Sampley will be in the City on Wednesdays and available to meet with Council at any point. She emphasized interim periods of time are very difficult and having Mr. Sampley here at this time, especially since he has already served in this position, there is a high degree of confidence and comfort on the part of the staff. #0962 TAPE #1260 City Council Reg. Mtg. Minutes January 25, 1995 Page 6 of 7 Mr. Colvln questioned the cost of having Mr. Sampley's services? Mr. Overson pointed out $75.00 per hour for three days per week, totalling $2,280.00 per week. Mr. Farr stated in looking through the Professional Services Agreement part of it leads him to believe that although Mr. Sampley is employed by Parametrix Inc.. However, part of the contract states "parties understand and agree that the consultant is a firm skilled in matters pertaining to...", and questioned if other services would be rendered under this agreement? Mayor Hotton stated although the contract is with Parametrix Inc., Mr. Sampley will be on loan to the City from Parametrix. The City is not contracting for other services from Parametrix under this contract. Mr. Farr stated he felt Paragraph 4 - Relationship Of Parties - needed some clarification because it indicate the City is getting more than just the services of the consultant. Ian Sievers, City Attorney, explained the contract is with the firm of the consultant. Some of those relationships do go back to the firm, such as liability, and the fee is paid directly to the firm, not Mr. Sampley. He did not recommend changes to the relationship between the two contracting parties. The contract is limited to the labor of a particularly named individual. The firm itself is a skilled, independent firm that can provide the levels of expertise the City is looking for. He questioned if Mr. Farr felt Mr. Sampley should be identified in the "Relationship Of Parties" paragraph? Mayor Hotton suggested language be changed to reflect' Mr. Sievers comments that it is understood the City is contracting for Mr. Sampley's time and his professional expertise and not with the firm beyond his relationship as an employee and they are the contracting entity. Mr. Law stated he would be more comfortable if a Scope Of Work was included with the contract. He asked the Mayor if she had enough funding available to her to continue for another week while the requested changes were incorporated into the contract? Mayor Hotton stated she might not. Mr. Sievers stated if required the Mayor could extend the initial agreement with a short contract, under her signature, for four weeks if it exceeded the $5,000 consulting cost. Mayor Hotton asked if Council could pass a motion authorizing her to spend additional funds. Mr. Sievers pointed out the Mayor has the authority to spend up to $10,000 with a more formal contract than the letter of understanding that was issued. Mayor Hotton stated she had no problem bringing this item back to Council with the inclusion of a Scope Of Work. President Huff- Menees asked that the change in wording of Paragraph #4 also be made prior to its being brought back before Council. M/S/C/U(Overson/Farr) motion to table this Agenda item for one week, with the recommended language. TAPE #1260 City Council Reg. Mtg.
