COUNCIL MEMBER REPORTS Mr. Overson reported he enjoyed the Bremerton Main Street and Bremerton Area Chamber Of Commerce sponsored St. Patrick's Day events on Saturday, March 11. He attended a meeting on March 13 where the Citizen Action Committee on Wastewater Treatment Plan Odor Control project made a presentation, which he found to be lively and well run. Overall, he has been impressed with the professional manner in which this group has dealt with the task placed before them. Mr. Farr stated he was pleased that the Kitsap County Historical Museum is moving to a building on 4th Street and sees that as a welcome addition to Bremerton. Mr. Law stated he also enjoyed the St. Patrick's Day events held on March 11. He reminded everyone that the next District #3 Neighborhood Meeting will be held March 21, 1995, 7:00 P.M., at the Senior Center. The program for that meeting will be an "open forum". Mr. Montgomery stated over the past two weeks he has had the opportunity to visit a number of City assets. He thanked staff members Bill McKiNney, Kathleen Cahall, Bob Tulp and John Poppe for their indoctrinating him on the City's sewer treatment plant, water system, and watershed. Mr. Colvin thanked his District #1 Neighborhood Meeting committee for the great work they have done all year. The next District #1 Neighborhood Meeting will be held Thursday, March 16, 7:00 P.M., at the Sheridan Park Recreation Center. The program for that meeting will be a representative from Kitsap County, who will speak on "Growth Management". Also, Councilman Montgomery will be making a presentation on how to figure out sewer rates based on water usage. Mr. Winters stated he also enjoyed the St. Patrick's Day parade on Saturday, March 11. He hoped that more people will come out and participate in future parades. He and his family enjoyed the traditional Irish music that was performed at the RoxyTheater. He announced the next Kitsap Lake Neighborhood Association meeting will be held Thursday, March 23, 1995, 6:30 P.M., at the Cascade Gas Building on Kitsap Way. Mrs. Huff-Menees wished everyone, especially those of Irish decent, a Happy St. Patrick's Day. She also attended the meeting on March 13, which was sponsored by the Citizens Advisory Committee on the TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 3 of 11 Wastewater Treatment Plant Odor Control project and she also felt it was a very good meeting, well attended and well conducted. She hoped that the public will continue to attend those meetings in order to be well informed. MAYOR'8 REPORT Mayor Lynn Hotton stated at the previous Council meeting there was discussion about a "park user fee" and the possibility of including some language that would provide a type of exemption from that fee to be acted upon by Council at this Council meeting. Due to being short staffed on Thursday, March 9th, she was not able to include that item into the Agenda packet, however, some language modification has been developed and was presented before the Council Committees on March 14 and March 15. The modification to the Park fees will be brought before Council on the March 22 Agenda. She was pleased to report the amount of funds the City will receive from the timber sale as identified under the Consent Agenda was far greater than the amount anticipated by Bill McKinney, the City's Forester, due to the current market. She thanked Mr. McKinney for doing such a good job in preparing the timber sale documents. The City of Bremerton's population has topped the 40,000 mark. It has been many years since the City had that high of population and was due largely to the influx of Navy families. She felt it was to the City's credit to be able to absorb an additional 10% population without "missing a beat". Mayor Horton made the following announcements: (1) Series on Earthquake Preparedness Programs: TCI Cablevision Channel 12 - Mondays at 8:00 P.M. and Thursdays at 4:00 P.M. Falcon Cablevision - Mondays at 2:00 P.M., and Tuesdays at 7:00 P.M.. (2) The Warren Avenue Bridge will be closed from 9:00 P.M. to 6:00 P.M. on the following dates to provide earthquake stabilization: March 20, 23, 27 and 30th. PUBLIC RECOGNITION Mr. & Mrs. Larry Dick, 6701 Lake Drive, discussed a problem they are experiencing that involves a hedge that blocks their view when exiting their property onto an access road. Photographs and maps were provided showing the location of their property, neighboring properties and access roadways. Mr. Dick related that he had almost had five automobile wrecks within the past two months due to this hazardous condition. He had already talked with the City about investigating his complaint, however, their response TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 4 of ll indicated they did not see it as a traffic hazard. President Huff- Menees assured Mr. and Mrs. Dick that they would receive a response from the City Council office. 7A - BUDGET ADJUSTMENT - REPLACEMENT OF A TEMPORARY ADMINISTRATIVE POSITION WITH A FULL TIME OFFICE ASSISTANT I, #AB95-048 The Parks & Recreation Department administrative and clerical support staff currently includes one Office Assistant II and one temporary clerical position. These two positions provide clerical support for thirteen full-time employees. Both administrative positions are also responsible for assisting the public at the front counter, answering phones, handling registrations, typing and processing department administrative work, including purchase orders and requisitions, as well as covering for breaks, lunch, and vacation/sick leaves. The temporary clerical position has been filled by the same employee for over six years. She is paid an hourly wage without benefits. The financial impact of hiring a full-time OAI, in lieu of using a temporary will be a $8,777.60 increase (based on the current City contract) in our full-time salary line for 1995. A budget increase to compensate for this difference in wages will not be necessary for the 1995 budget. Our department has experienced savings by delaying the hiring of one position within our department. We also have savings due to a recent retirement. For the last six years, funding the OAI position with a full-time civil service employee has been an important budget priority. Unfortunately, the position has not been funded. We feel the need to fill this position is important to continue the smooth functioning of our office and to maintain a high level of service to the public. Hiring a full-time person will allow us to extend our office hours and provide better administrative support to staff. Pat Harris, Parks and Recreation Director, emphasized the need to have this position filled full time for his department and the benefits to the community will come in the form of providing better customer service, possibly expanding their office hours and provide efficient operations internally for department staff. Public comment - none. Mr. Farr stated his initial response to this proposal was somewhat skeptical and wanted assurances this was not just empire building, but following Mr. Harris's presentation to the Operations Committee and the questions raised he is satisfied that it is a logical request. He complimented Mr. Harris on his bringing a welcome degree of professionalism to the Parks Department. #0842 TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 5 of 11 Mr. Law acknowledged that Mr. Harris and Jim Meith, Human Resources Manager, provided the Fiscal and Budget Committee with requested information that accepts the position of Office Assistant I and the duties thereof. There was a concern within Fiscal and Budget Committee that the position's job description was such that we would end up with a person performing the job at a lower level than the actual requirements of the position. Mr. Winters commended Mr. Harris for his foreseeing future needs based on the Pendergast site, more activities and more people using City services. He feels there is still a need for added personnel to keep up with the increased volume of activity within the Parks Department programs. M/S/C/U(Colvin/Dawkins) to approve a full-time Office Assistant I position for the Parks & Recreation Department. 7B - CONFIRMATION OF GENE 8AMPLEY AS DIRECTOR OF PUBLIC WORK8 & UTILITIES, AND APPROVE CONTRACT, #AB95-049 Eugene Sampley has 14 years of public sector, public works and utility experience, serving 9 and 5 years respectively for Skagit County and Whitman County, Washington, and has served as a consulting Civil Engineer with R. W. Beck and Parametrix, Inc.. Mr. Sampley served as Bremerton's Provisional Utilities Director and City Engineer from November 1992 to April 1993, and has been the City's Provisional Director of Public Works and Utilities since January of 1995. Mr. Sampley is recommended for permanent appointment to the position of Director as the most highly qualified candidate among recent applicants. The Employment Contract negotiated with Mr. Sampley varies from standard professional and management benefit provisions in the areas of sick and vacation leave and severance pay and must be approved by the Council. Negotiated salary is at Rate 8 of the range for the position. Mayor Lynn Hotton stated as Council is aware, Mr. Sampley had served the City previously and she feels based on his background and education he has a high degree of expertise. She has been very pleased with his performance during his interim service as Director Of Public Works and Utilities. She emphasized Mr. Sampley has good communicative and administrative skills. She acknowledged that employees in the Public Works and Utilities Department have had concern over change of leadership, however, they seems pleased with her announcement that she was going to proceed With recommending Mr. Sampley to fill the Director position on a permanent basis. She urged Council to confirm Gene Sampley as Director of Public Works and Utilities. #1061 TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 6 of 11 Public comment - none. Mr. Montgomer7 stated on the short time he has served on the City Council he has heard many comments about various people, but Mr. Sampley seems to have the respect of everyone within the Public Works and Utilities Department. Mr. Overson pointed out the last statement in the first paragraph of the Summary Statement states: "Mr. Sampley is recommended for permanent appointment to the position of Director as the most highly qualified candidate among recent applicants". He questioned if that the administration intended to have that statement included? Ian Sievers, City Attorney, stated the Mayor did not go back through a selection process since one was conducted a little over a year ago and of those applicants the Mayor felt Mr. Sampley rated higher. Mr. Neville stated he as had several conversations with people who have and would be working under Mr. Sampley and the common theme throughout is that everyone is truly impressed with his management style and expertise. He also pointed out the City was getting a "better deal" through hiring him permanently than what the City was paying for his consulting fees. Mr. Winters asked Mayor Horton if Mr. Sampley would be in partnership with R. W. Beck and serve as a Senior Director of the client services? Mayor Horton explained she believed Mr. Sampley had severed his relationship with R. W. Beck and currently employed with Parametrix Inc. Mr. Law stated among Mr. Sampley's many strengths is his ability to communicate well, which he feels is a very important factor and he looks forward to having him on Bremerton's team. M/S/C/U(Neville/Farr) to confirm the appointment of W. Eugene Sampley to position of Director of Public Works and Utilities full time and approve Employment Contract. 8A - RESOLUTION NO. 2503, REVISED REIMBURSEMENT AGREEMENT FOR THE MERNER ROAD SEWER UPGRADE, #AB95-050 The City of Bremerton has been asked to upgrade sewer service to a site outside City limits. The site is being developed to host a defense sub-contracting division of Westinghouse. The delivery of sewer services meets BMC 15.02,040 (annexation and Comprehensive Plan criteria). Because of the economic importance of the Westinghouse project to the community and because upgraded sewer service is necessary to serve other industrial lands planned for the area, the City proposes to revise the Developer's Reimbursement Agreement, approved by Resolution #2491, to finance the projection TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 7 of ll costs over the $80,000.00 contribution of the developer, $80,000.00 from the Wastewater Utility and the remainder of the approximately $260,000.00 cost from the Real Estate Excise Fund. Public comment - none. Mr. Law stated it was his understanding that the cost of $260,000 is a maximum amount as presented to Council during a Study Session, and hopefully it could be less than that amount. He questioned when will the final cost be known? Mayor Morton stated she did not believe a final cost will be known until actually construction takes place and reveals how much rock is encountered, however, there is a healthy contingency fund build into the cost. Mr. Law stated he is interested when the cost will be finalized and it was his understanding the project would be completed some time in April. Mayor Hotton stated Mr. Law was correct and the project time of construction is approximately five weeks. Mr. Winters questioned how can the City use the Real Estate Excise Tax to put those dollars into a sewage development reimbursement plan? Ian 8ievers, City Attorney, explained the Real Estate Excise Tax has become more complicated over the last 2-3 years. There are two different quarter percents, one is incumbered with the adoption of a Comprehensive Plan and part of it is not incumbered. There are sufficient funds in the unincumbered portion of the City's account. That tax revenue is to be spent for capital facilities and this project is a utilities capital facilities, which does have statutory authority for the General Fund monies. He could provide that authority in writing at a later time. Mr. Winters stated he would like to have the written documentation to pass on to a constituent. Mayor Hotton emphasized the City cannot use Utility funds to go into the General Fund, but General Fund money can go into utility projects. Mr. Overson questioned doesn't this then turn out to be an investment whereby it generates additional income tax, such as Real Estate Tax, that then goes back into the fund to replenish over a period of time? Mr. Mievers stated it is probably indirect, but certainly the purpose of the General Fund is that this is a worthwhile use of the funds because it does expect to appreciate future General Fund revenue by extending the sewer line and making more development possible, which would then contribute to the General Fund in various kinds of tax revenues, including Excise Tax for sales in the area. Mayor Horton pointed out the Real Estate Excise Tax fund is predicated upon sales and if properties within that corridor do change hands as a result of this action, then the Real Estate Excise Tax fund will benefit by the upgrade. Mr. Sievers stated that all assumes a near future annexation of the area where the sewer is being extended. #1276 #1306 TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 8 of 11 M/S/C/U(Winters/Colvin) to approve Resolution #2503, Developer's Reimbursement Agreement and approving Adjustment. revising Budget 9A - ORDINANCE NO. 4509 (SECOND READING) VACATING A PORTION OF FIFTH STREET ADJACENT TO THE WEST PARK LANES BOWLING ALLEY, ~AB95- 044 Public comment - none. M/S/C/U(Farr/Dawkins) to pass Ordinance No. 4509 on second reading, vacating a portion of Fifth Street adjacent to the West Park Lanes Bowling Alley. 10A - PUBLIC HEARINGAN D ORDINANCE (FIRST READING) TO ACCEPT PUBLIC COMMENTSAND CONSIDER THERECOMMENDATION OF THE PLANNING COMMISSION REGARDING THE REOUEST FOR REZONEOF THREE PARCELS AT UNION AVENUE; APPLICANT: CMARLES HASELWOOD, #AB95-051 The request is a REZONE from "Single-Family Residential (SF-3)" to "Industrial General (IG)". The subject property is three vacant lots, 0.76 acre in total size, on the west side of Union Avenue, approximately 300 feet south of Werner Road in the Auto Center Way area of West Bremerton. The lots are located immediately adjacent to the "IG" zone. This proposal was presented and discussed at the Planning Commission public hearing on February 21, 1995. The City Council is required to make a determination on this request, and if approved, pass an ordinance for the action. President Huff-Menees asked the "Appearance of Fairness/Conflict Of Interest" question with all Council members being seated. Shane Jensen, Current Planning Division, provided a view graph showing the location of the subject site. Adjacent uses to the site are the National Guard Armory, State Patrol Office and some auto dealerships and Cocoa Cola Bottling warehouse. The three parcels are currently vacant and are subject to a power line right- of-way that runs across them. The reason for seeking a rezone is further development that would be allowed within an Industrial Zone. The Staff Report lists allowable uses under the currently zoning, and it lists allowable uses under the Industrial Zone. The site is adjacent to the IG Zone, to the north, and would connect to it if the rezone is approved. Across the street from the site is a General Business Zoning area where some of the Haselwood Car Dealerships are located and to the west and south is single family residential. Mr. Overson questioned the zoning of the Pendergast Regional Park site? Mr. Jensen pointed out it was either Forest Management or Parks And School Zone. Mr. Overson stated he thought part of the TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 9 of 11 subject area was rezoned in that prior action. Mr. Jensen stated he was not sure of the boundary area included in the Pendergast Regional Park rezone. It is his understanding that the National Guard Armory property remains in the Single Family Residential Zoning. Mr. Jensen explained foremost in their consideration for a rezone is compliance with the City's long range plan. The Industrial General Zone would enact policies and uses that would be supported by that Comprehensive Plan designation. Upon review by staff and the Planning Commission, the Commission recommended approval of the rezone. Nick Puah, of Gig Harbor and representing he and his wife Cindy, stated he and his wife found saw the subject site as a challenging piece of property and felt it was more in line with Industrial General Zoning. They originally thought it had that zoning designation when they pursued purchasing the site. His intention is to place a MACO Auto Painting And Body Work franchise on the site, which would be comprised of a new facility of approximately 8,000 sq. ft. on two floors and employ approximately 15 people. Currently, there is a lot of trash dumping on the site. It is their intention to develop a complex that compliments what everyone else is doing in the Auto Center Way area. He emphasized no matter what the outcome on this proposal, he has been very pleased with the reception and help they have received from the City's Planning Department. Mr. Neville questioned the size of the third parcel and whether or not it was large enough to develop? Mr. Jensen explained a boundary line adjustment would be made combining the three lots into one lot. President Huff-Menees noted the rezone complies with all of the criteria applicable to rezones. Mr. Overson noted one of the major supporting reasons given by the Planning Commission was the power line that runs through the subject site. It was also interesting that the applicant is Mr. Haselwood, who has done a lot of residential development and is knowledgeable of what makes good residential areas and what makes Industrial General areas. Mr. Law stated this type of business compliments and solidifies the automobile dealers in the area. He appreciates that from the City's business point of view and is hopeful that more support agencies will locate in that area. #1831 M/S/C/U(Law/Farr) to approve Ordinance, on first reading, amending TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page 10 of 11 the Official Zoning Map of the City of Bremerton for property located on the west side of Union Avenue approximately 300 feet south of Werner Road in the Auto Center Way area of West Bremerton, adopting the proposed REZONE from "SF-3" to "IG". 10B - PUBLIC HEARING TO DISCUSS BREMERTON COMPREHENSIVE PLAN AMENDMENTS, #AB95-052 Planning Commission Resolution No. 1995-1 forwards proposed revisions to the Bremerton Comprehensive Plan to the City Council with a recommendation of approval. The proposed revisions will bring the Plan into conformance with the Growth Management Act. After holding a public hearing(s) on the proposed revisions to the comprehensive plan, the Council may: (1) approve the proposed revisions as recommended by the Planning Commission; (2) approve any revisions the Council deems appropriate; or (3) remand the plan (or any part of the plan) to the Planning Commission for further work. Ron Hough, Planning Manager, stated this plan has been going through the preparation process and revision of the old plan through a Citizens Advisory Committee over the past two years, through the Planning Commission public hearings, City Departmental review, various organizations and jurisdictions, 16 different State agencies, etc. Currently, the City is within the 60-day State review process and comments will be coming back to the City by the end of March and he anticipates adopting the plan on April 5. Each of the following Elements of the Comprehensive Plan were discussed: ELEMENT "A" INTRODUCTION TO THE PLAN ELEMENT "B" THE VISION FOR BREMERTON ELEMENT "C" PLANNING GOALS ELEMENT "D" CITIZENS INVOLVEMENT PROGRAM ELEMENT "J" ENVIRONMENTAL MANAGEMENT ELEMENT "K" IMPLEMENTATION/CONSISTENCY/CONCURRENCY Mr. Law stated for clarification the Growth Management Act was a requirement of cities the size of Bremerton and the County of Kitsap. There are two different Growth Management Act plans for the public to understand. Council is talking about the Growth Management Act and plans for the City of Bremerton. Kitsap County has also originated its own Growth Management Plan/Program. He #2975 TAPE #1269 City Council Reg. Mtg. Minutes March 15, 1995 Page ll of 11 wanted the public to understand the City is not working on the same wave length or pieces of property as the County. Mr. Hough stated Mr. Law is correct in that the City and Kitsap County are two different jurisdictions, but we are also suppose to be coordinating with each other so that we end up with a regional plan that is consistent with everyone. The final objective to have the plans working together. Mr. Dawkins complimented the Planning staff and the volunteers that have help in preparing and processing this document. Mr. Colvin commended Mr. Hough for an excellent presentation. He pointed out that the Comprehensive Plan is not "etched in concrete" and.can revised every year if needed. Mr. Hough noted there was one changed that was attached to the Agenda Bill on when the plan is amended under the Emergency Clause .... during the annexation process. M/S/C/U(Law/Montgomery) to continue the public hearing on proposed revisions to the Bremerton Comprehensive Plan on the following dates: March 22, March 29, and April 5, 1995.
