MUNICIPAL CODE (BMC), APPROVING AMENDMENTS TO THE ZONING CODE: AND
AUTHORIZING THE EXTENSION OF TIME PERIOD IN DEVELOPMENT AGREEMENTS (#AB00-
143): Glenna Malanca, City Attorney, reiterated that the Ordinance approving amendments to the
Zoning Code, Chapter 21.02 of the BMC, was to allow for the extension of time periods, through
development agreements, for project approvals and permits, including Planned Unit Developments.
This item is intended to give the City, through the Council, more flexibility to allow for undetermined
types of developments.
There were no comments from the public.
Mr. Farr asked if this would take the place of a PUD (planned-unit development). Ms. Malanca
responded that is ultimately, a realistic observation. She further elaborated that a PUD is fine for a
smaller project that results in a final application or plat by the third year, but more ambitious projects
sometimes take 10 to 15 years to come to a full completion. Mr. Farr clarified that the City Council
still would have the ability, at their prerogative, to impose "milestones" upon the developer of a
specific project, as long as it is agreed upon before the Development Agreement is signed.
#0835 M/S/C/U (Reed/Farr) Move to approve the proposed ordinance on first reading, amending
Chapter 21.02, by providing for the extension of time periods, through development agreements, for
project approvals and permits, including Planned Unit Developments.
