Drive rezone was included in the 1999 Comprehensive Plan amendment, which was scheduled for
second reading on the Agenda tonight. [Mr. McConnell later explains that no "site plan" has been
submitted for Aimira Drive, therefore no information on that issue would be addressed tonight].

10D - ORDINANCE (FIRST READING) REPEALING CHAPTER 3.20 OF THE MUNICIPAL CODE
RELATING TO THE IVY GREEN CEMETERY PERPETUAL CARE FUND; AND APPROVAL OF
BUDGET ADJUSTMENT NO.00-12, #AB00-119: Treasurer Rich Hanna noted that if approved, the
proposed ordinance would eliminate the Ivy Green Cemetery Perpetual Care Fund. Presently, there
is approximately $130,000 in the fund, of which $25,000 is interest earnings, which can be spent
under the current ordinance. $105,000 is proceeds from sale of cemetery lots and can not be spent.
If the ordinance is approved, all of the money would be transferred to the "Parks & Recreation Facility
Development Fund", and used to pay for improvements to Ivy Green Cemetery.
Mr. McConnell asked what monies would be used for perpetual care of the Ivy Green Cemetery if
this remaining $105,000 is spent. He expressed his opinion that a modification of the existing
ordinance should be sufficient to take care of the installation of an irrigation system. Mr. Hanna
responded the same funds that are currently used, and pointed out the vast majority of expense to
maintain Ivy Green Cemetery (approx. $75,000 to $90,000 per year) is borne by the City's General
Fund. The Perpetual Care Fund contributes $6,000 per year toward that upkeep, but believes that
even a greater savings could be achieved by installing an irrigation system.

Mr. Farr asked for legal assurance that the City would still meet all obligations after eliminating the
Perpetual Care Fund. Ms. Malanca referred the response to the City Treasurer, who has done the
research relating to State Law. It was her understanding that there were no State laws, and that this
was a self-imposed ordinance. Mr. Hanna stated that was correct, and that the City was a private
caretaker of the cemetery. Mr. Farr commented that this action did not diminish the City's intention
or obligation to care for this Cemetery, out of respect for the families of the people buried there. He
further commented the Cemetery needed to be looked after.
