The CSO treatment option is the most cost-effective recommendation based on a pilot test completed in December 1999. In addition, the CSO treatment facility will improve Port Washington Narrows water quality, provide emergency backup treatment potential for maintenance and repair of pump stations and collection system infrastructure. CSO treatment is an element of the CSO control measures for the Pine Road Basin that must be completed in 2000 per the Puget Soundkeepers Alliance (PSA) Consent Decree. The Department of Public Works & Utilities seeks approval from the City Council for a Professional Services Agreement for design and construction management services for the CTF with Camp Dresser and McKee Inc. (CDM) in an amount not to exceed $731,000. CDM was selected as the most qualified consultant for these services. There were no comments from the public. Mr. McDonnell asked how many more thousands of dollars were still needed to comply with the PSA. Mr. Poppe clarified that the money was not for "compliance" with PSA, but for CSO reduction. He added that they have approximately $15 million to go, spread out over the next years. #0638 M/S/C/U (McConnell/Olsen) Move to approve the Professional Services Agreement between the City of Bremerton and Camp Dresser McKee Inc. for design and construction management services for a CSO Treatment Facility in an amount not exceed $731,000 and authorize the Mayor to execute the same. TAPE #1700 City Council Reg. Mtg. Minutes April 26, 2000 Page 3 of 5 10A - ORDINANCE NO. 4702 (SECOND READING) AMENDING BREMERTON MUNICIPAL CODE CHAPTER 2.76.500 REGARDING CONTRACT AMENDMENTS AND CHANGE ORDERS. #AB00-101: First Reading for this Ordinance was heard at the Council Meeting on Aprfl 19, 2000. John Becker voiced his concern over the significant change from a 10%/not-to-exceed $30,000 limit on change orders and contract amendments, to a 20%/not to exceed $250,000 limit. He believes the Council should re-look at this, and should retain more control. Mayor Horton responded that there has been a lot of discussion over this issue, but the Council was comfortable about the parameters, and the included language stating that Council will consider an issue whenever the expenditure authority is being invoked. She further clarified that at any time the Council views something they feel is inappropriate, those items can be placed back on the Agenda. John Law added that this same issue was discussed at length during Fiscal & Budget Committee last week, and stipulations were included in the ordinance to address the same concerns felt by the Council. #0860 M/S/C (McConnell/Reed) Move to pass Ordinance No. 4702 on second reading, amending Bremerton Municipal Code Chapter 2.76.500 "AMENDMENTS, CHANGE ORDERS, AND WORK CHANGE DIRECTIVES". Voted in favor of Motion: Law, Rollman, Reed, McConnell, Arends Abstained from Motion: Olsen Motion carried (5 In-Favor; and 1 Abstention). It was again announced that the Roger & Jennifer Nance - Kitsap Way/Weslon Place Amendment of Item 1 I(A) Public Hearing and First Reading of Ordinance Amending 1999 Comprehensive Plan would be pulled from the Agenda tonight: 11A - PUBLIC HEARING AND ORDINANCE (FIRST READING) AMENDING 1999 COMPREHENSIVE PLAN, #AB00-104: Interim Community Development Director Bill Palmer, reported the 1999 Comprehensive Plan Amendment includes three Map re-designation requests for Plan and Capital Facilities Updates. Also included are the Zoning Map re-designationS for each of the three Plan Map changes. Each of the three amendments were described in detail, as well as designating the area on a visual display. John Becker was concerned the full packet with all information was not distributed ahead of time. MS. Johnston responded that in about two weeks, it would be possible to scan the entire packet of Council Meeting information onto the City's web site. Mr. McConnell asked why the amendments were done "in pieces". Mr. Palmer stated that in his opinion, it should not have been done that way, but he was not yet employed by the City at the time the amendments were made. It was stated that next year, for the "Year-2000 Amendments", the problem would be rectified. Mr. Law expressed his concern over the lack of proper notification. Mr. McConnell referred to the Alfatooni Amendment, and asked how the prohibition against "spot rezoning" affected this action. Mr. Palmer stated that his understanding of "spot rezoning" applies to the zoning of an area that does not make any sense in the context of the surrounding area. In this case, there was rationale for extending the adjacent plan classification into this area, and pointed out the boundaries. Ms. Malanca further clarified the consistency of this zoning request. Mr, Reed stated the Council should be supportive, and allow the City's medical community to grow. Mr. Olsen agreed. TAPE #1700 City Council Reg. Mtg. Minutes April 26, 2000 Page 4 of 5 Susan Brown referred to the Merit Company Amendment, and stated that changes made to this item have been confusing and hard to follow. She stated if zoning is changed to "General Business" (GB) in the proposed area, then control is lost. She offered two suggestions: 1 ) to include a slow-down lane; and 2) to include an extra-wide green belt buffer zone along Aimira Drive. Mr. Law stated that due to pending litigation, he would "abstain" his vote on any items dealing with the Lowe's Corporation (Merit Company Amendment). #2715 M/S/C/U (Reed/McConnell) Move to approve on first reading an ordinance regarding the 1999 amendment to the Comprehensive Plan and Map by approving that the David & Roxanna Jones Amendment, which changes a portion of the Official Zoning Map from "Medium and High Density Residential" (M/HDR) to "Business Park" (GB).
