overly aggressive in targeting students parking near Olympic College, and asked the Council for a

residents who live around the College, stating that if the parking in the area was not regulated, they
would not even be able to park in front of their own homes.
Gordy Byrd expressed his appreciation for the respect shown to him by Councilman Reed.
Don Larson announced that in honor of Earth Day, a group of volunteers will gather on Saturday,
April 22nd to clean up various areas of the County, including the annual Sinclair Inlet Clean-Up event

9A - EVERGREEN PARK BUDGET ADJUSTMENT AND EXTENSION OF PARAMETRIX
CONTRACT. #AB00-099: Recreation Coordinator II Becky Lorber, reported that on September 29,
1999, the City entered into a Stage I Professional Services Agreement with Parametrix, Inc. for the
design documents required for the remediation of site properties in the expansion of Evergreen Park
(#AB99-198). The Stage I Scope of Work agreement was in the amount of $172, 186.00. This Stage
[I Amendment (Exhibit A) in the amount of $322,430.85 is needed to develop the final documents,
and includes the removal of the UST's (Underground Storage Tanks), ensuring that remediation, park
design, and construction activities meet the specifications required for the execution of the
Washington State Department of Ecology Agreed Order.
This Stage II Amendment will bring the total contract amount to $494,616.85 and extend its contract
life through completion of the Park development. As of March 1, 2000, the total amount from Stage I
contract amounted to $147,071.85 (reconciled by the Treasurer's Office). This provided a cash
balance of $25,114.15, now being applied to Stage II. The attached Amendment to Contract, Exhibit
B, in the amount of $322,430.85 is required to cover expenses through the year 2000. (Cash
Balance: $25, 114.15 + Budget Adjustment: $322,430.85 = Parametrix Inc. Stage II: $347,545.00).
The budget adjustment funds the project through completion.

9B - SR 304 TRANSPORTATION IMPROVEMENT PROJECT-SUPPLEMENTAL AGREEMENT
FOR WSDOT RIGHT-OF-WAY SERVICES. #AB00-100: City Engineer, Randy Witt noted that the
City has an Agreement for Aid with the Washington State Department of Transportation (WSDOT)
which provides for WSDOT staff to provide land acquisition and related services on City projects.
City staff have negotiated a Task Assignment to that agreement for WSDOT Real Estate Services
(RES) staff to provide right of way acquisition and relocation services for the SR 304 Transportation
Improvement Project: Navy Yard Highway Phase, Section 1, Porter Street to Charleston Beach
Road/Missouri Gate Intersection. WSDOT RES was selected because of their familiarity with the
project and with acquiring property in accordance with Federal Highway Administration requirements.
The estimated not-to-exceed cost of this work is $190,000. Staff recommends approval of this Task
assignment.
There were no comments from the public.
Mr. McConnell asked why a portion of the acquisition property extended up Charleston Beach Road.
Mr. Witt explained the property needed to extend far enough up Charleston Beach Road to make a
right angle connection at the new intersection.
#1020 M/S/C/U (Reed/McConnell) Move that the City Council authorize and direct the Mayor to
execute the attached Task Assignment for WSDOT Real Estate Services on the SR 304
Transportation Improvement Project - Navy Yard Highway, Phase Section 1, Porter Street to
Charleston Beach Road/Missouri Gate Intersection.
10A - ORDINANCE (FIRST READING) AMENDING BRFMERTON MUNICIPAL CODE, CHAPTER
2.76.500 REGARDING CONTRACT AMENDMENTS AND CHANGE ORDERS, #AB00-101: City
Engineer Randy Witt reported that Chapter 2.76.500 of the Bremerton Municipal Code (BMC) sets
forth rules and regulations regarding amendments and change orders to City contracts. This chapter
establishes an administrative authority for the Mayor to approve change orders without prior approval
by the City Council. This authority is inadequate on larger capital projects. Additionally, the existing
ordinance does not provide for changes in the work to be approved in the field prior to inclusion into a
change order. The proposed revisions allow change order authority more proportionate to the scope
of the project and address on-site project management needs by providing a graduated increase to
the Mayor's change authority on construction contracts with a ceiling of $250,000, establishing a work
change directive process that allows changes to construction contracts to be aggregated for
subsequent inclusion in a change order, and allowing emergency conditions to be addressed in a
timely fashion to be subsequently included in a change order. Staff recommends approval.

Roy Mclnnis voiced his concerns that an increase in percentages may cause a situation where
Council would not always be aware of each change order authority, and questioned how closely the
situation would be watched. Mr. Witt explained that when their budget is approved, Change Order
Authority is already built-in to accommodate normal changes that are expected with any given project.
Mr. Law asked for clarification regarding the statement "The City Council will be notified of work
change directives issued in excess of the administrative authority of the Mayor as soon as
practicable". Mr. Witt discussed this issue in further detail, and described the three scenarios where
the Work Change Directlye could be issued.
#1556 M/S/C/U (Farr/Reed) Move to approve Ordinance on first reading, amending Bremerton
Municipal Code Chapter 2.76.500, "AMENDMENTS CHANGE ORDERS, AND WORK CHANGE
DIRECTIVES".
11A- PUBLIC HEARING AND RESOLUTION NO. 2751. REGARDING RECOVERY OF FEES FOR
THE ABATEMENT OF AN UNSAFE BUILDING ON THE PROPERTY LOCATED AT 1702
BURWELL STREET. #AB00-102: Building Development Specialist [[ Janet Lunceford, reported
that in October of 1999, the house located at 1702 Burwell Street was damaged by fire and ordered
abated as a dangerous structure. The abatement order was mailed to the owner of record, Donald
Rockwell. Darlene Harrod signed for the return receipt for certified mail on October 28, 1999. Mr.
Rockwell failed to comply with the deadlines of the abatement order and the building was demolished
by Public Works on February 8, 2000. The cost of the abatement, including administrative fees,
totaled $12,471.11. Council must now decide if the fees are just and how they should be collected.
There were no questions or comments by the public.
Mr. McConnell voiced concern that the owner of record did not sign the receipt for the Abatement
Order. Ms. Lunceford verified the letter was mailed to the address on record.
#1658 M/S/C/U (McConnell/Law) Move that Council, by Resolution No. 2751, order that the fees
incurred for the abatement of an unsafe building on the property located at 1702 Burwell Street be
collected as reasonable abatement costs and become a lien against the property.
With no further business, meeting adjourned at 6:25 P.M.
