Since Cathy has more than 25 years of financial and accounting experience with the City of Bremerton, and will assume the added responsibilities of this new Finance Officer position, it is recommended that her salary be adjusted to Band 16, Rate 6 ($6,276/month). One was an Engineering Technician [! who was promoted to Engineering Technician !ri. The individual was placed in a vacant Tech II position rather than having an additional Tech III position added to the Department as had been done with other internal positions. The vacant Tech III position was under-filled at the time, and it was the desire of the Department to keep it under- filled until an internal promotion register could be established. Mistakenly thinking that the Tech III position was still available, a register was created and the position formally offered to a Tech II. It wasn't until the paperwork reached the Budget Analyst that the error was brought to our attention. For this reason, City Council is requested to approve the elimination of one Engineering Technician I! position and approve the addition of one Engineering Technician III position. Mr. Shepherd explained that he would not support any increases in the budget for any position given the financial challenges currently faced by the City. #0380 M/S/C (McConnell/Arends) Move to approve a Budget Adjustment in personnel within the Department of Public Works & Utilities eliminating an Engineering Technician II position, and adding an Engineering Technician ]~ position. The proposed ordinance corrects the citation relating to criminal impersonation in the second degree. There were no comments from the public. #0485 M/S/C/U (McConnell/Arends) Move to approve the proposed ordinance on first reading. 6B - ORDINANCE [FIRST READING1 AMENDING SECTIONS 21.02.230 AND 17.04.060 (E) OF THI- ,BREMERTON MUNICIPAL CODE RELATING TO THE DEVELOPMENT AND PERMIT REQUIREMENTS FOR FENCES (#AB04-132): Chris Hu,qo, Community Development Director, stressed that in recent years, violations of the City's fence height standards have become more prevalent. At the conclusion of a Council study session in April, the DCD was directed to draft ordinance amendments to address provisions for special use permits, entry features, and permit requirements. The Council's direction also confirmed retaining the existing height standards in the code. The Planning Commission conducted a workshop in the proposed amendments on April 15th, 2003 and held public hearings on June 17th and July 15~h, 2003. The Commission recommends the attached ordinance to the Council for adoption. He added that the Council's suggestions made during the Legislative Review Session on July 14~', 2004 have been incorporated into the ordinance. This item was continued from the TAPE #1960 City Council Reg. Mtg. Minutes Wednesday, July 21, 2004 Page 3 of 4 Council Meeting held on July 7, 2004. Mr. Huqo clarified that this ordinance includes provisions for homes on corner lots which have two front yards and for homes located next to non-residential properties; has additional language revisions regarding above ground electric fences and structural supports for fences below three feet in height; and provides a standard for front yard fences and back yard fences. Tonia Jeffrey asked if fences built prior to the change in code will be "grand-fathered"; asked for clarification on front-yard and side-yard definitions; and emphasized that fences are necessary to protect citizens' property, safety, and privacy. President N¥,qren encouraged Ms. Jeffrey to submit her list of concerns in writing to receive a response from staff. Lynn Matthews opposed the ordinance, and asked if there would be further discussion. President N¥.qren answered that the second reading of the ordinance would be heard on Wednesday, July 28th. Mr. Gehrin.cI pointed out that the height requirement for chain link fences is actually being increased from 42-inches to 48-inches (four feet). Mr. McConnell asked what the cost would be for a Type II Special Use Permit. Mr. Lubovich stated that the cost for a special use permit is $350. Mr. McConnell asked if a special use permit would be required for corner lots where one side is declared the primary yard. Mr. Huqo answered that staff would review the lot to make a determination on a case by case basis. Mr. Lubovich added that this ordinance established a permit fee of $25 for fence projects. Mr. Maupin asked Mr. Lubovich if he is correct in saying that there is n._qo requirement for citizens to lower their fences provided in this ordinance. Mr. Lubovich answered yes. Mr. Maupin also pointed out that there is relief being suggested for homes on corner lots, and an increase in the allowable height of chain-link fences. He also added that by having lower front yard fences, there will be improved visibility and safety; and by introducing a permit process for fence projects there would be a reduction in staff time devoted to enforcement of projects not meeting code. Mr. Shepherd urged staff to extend flexibility to certain neighborhoods where there is a noise issue due to traffic, and believed that he could not support the ordinance in its current form. Ms. Priest thanked Mr. Hugo for reviewing community comments and incorporating those comments into this ordinance. Mrs. Arends also thanked Mr. Hugo for taking time to address her concerns; agreed that there is a need for a means to monitor the fence issue; and would support the ordinance. President Ny,qren noted that e-mails and letters received from citizens on this issue have been included in the record; and the second reading for this issue would be held next week on July 28. Ms. Robinson expressed concerns about previously built fences, and would like to see a "grand- fathering" clause included in the ordinance. #'1685 M/SIC (Arends/Priest) Move to approve ordinance on first reading, as amended.
