The City wishes to purchase the SEAGRAVE engines for the reasons listed in the attached Bremerton Fire Department Apparatus Specification Committee Minutes. In addition this purchase will continue our effort to standardize the fleet which results in increased safety because the controls for each apparatus in our fleet will be the same. Pat McGane¥ and Greq Bowman, Firefighters with the Bremerton Fire Department and members of the Fire Department Apparatus Specification Committee, provided a briefing on the reasons why the committee recommended the purchase of the new fire engines from SEAGRAVE CORPORATrON. Mtg. Minutes March 12, 2003 Page 5 of 5 040): Chris Hu,qo, Director of the Community Development Department and Adrianne "Dri" Ralph, Environmental Planner with the Community Development Department, explained that the current provisions of BMC 21.22.240 relating to the Wetland extraordinary hardship test result in the circumvention of the original intent of the test and may result in the unintended regulatory taking of property and confusion regarding the applicability of certain test criterion. The proposal ordinance amends provisions relating to the requirements of meeting the test in order to allow for the reasonable use of property. Helen Miller asked if the code is being changed to accommodate permit requests; would like to know if there is a definition for "all reasonable economic use"; questioned the definition of "diminished value"; and emphasized that when you purchase property, you are not guaranteed an economic use of the property. Ms. Ralph responded that courts have not outlined what "all economic use" is, but there is a test available to determine diminished value. The wetland permit has not been issued as discussed by Ms. Miller and staff is working with the applicant to go through the appropriate process. Mr. Hugo also added that the question isn't whether 70% or 80% of the value has been taken, the criteria that has been implemented is that the City can potentially take all the value - it is not a matter of degree, it is all or nothing, and that is where the vulnerability lies. Mr. Short believed that the proposed changes were a reasonable compromise to protect the wetlands as well as protect the rights of property owners. However, he noted the permit process is not complete, and appropriate restrictions can still be placed. #0525 MISIClU (ShoWOIsen) Move to approve the proposed ordinance on first reading. With no further business, the regular meeting of the City Council was adjourned at 7:26 P.M. The Council then reconvened in the Council Conference Room for a Study Session to discuss the "JOB DESCRIPTION FOR THE MUNICIPAL SERVICES COORDINATOR POSITION".
