Minutes March 19, 2003 Page 4 of 4 9B - OR, D~NAI~tCE (FIRST READING) REPEALING AND REPLACING CHAPTER 9.88 AND TITLE 9A OF THE BR;EM~RTON MUNICIPAL CODE (#AB03-043): Simon Stocked, Assistant City Attorney, stated that many of the current provisions of Chapter 9.88 and Title 9A of the Bremerton Municipal Code are outdated, and that this proposed ordinance would increase the efficiency of our efforts to prosecute crimes by adopting additional state criminal offenses into our code and by improving the language in many of the existing provisions. There were no comments from the public. Mr. Rollman referred to the segment on "MISCHIEF ON BRIDGES", and expressed his concern that suicidal individuals should not be punished, but instead helped. Mr. Stocker responded that no changes are being proposed for this provision in the code, however, did point out that when people attempt to jump off of bridges, it places rescue crews at risk with their reckless behavior, and should be made responsible. Also, it may also be an action that motivates a person to seek help. Mr. Rollman questioned the "FREEDOM TO DISPERSE" provision, and asked if it would apply to anyone wishing to peacefully protest against the war. Mr. Stocker answered that it does not prohibit freedom to peacefully assemble for protests. Mr. Younf:ler emphasized that the "MISCHIEF ON BRIDGES" provision was a tool for law enforcement, and was in place to also address people who are playing on the bridge, and therefore did not support the removal of this segment from the Bremerton Municipal Code. Mr~ Nyqren and Mr. McConnell agreed, and after elaborating further on the issue, supported no change. Mr. Shepherd agreed with Mr. Rollman, and could not support the "criminalization" of mental illness. Mr. Maupin asked if the language was removed, does the City still have the authority to help suicidal jumpers? Mr. Stocker replied yes. Mr. Short was confident that at the scene, an individual would be cited for the act, but then be recommended for psychiatric assistance. #2292 M/S/C (Younger/Oisen) Move to approve the proposed ordinance on first reading.
