CODE) BY PROVIDING THE REGULATORY MEASURES ALLOWING FLEXIBILITY AND DESIGN INNOVATION WITH REGARD TO SETBACKS AND LANDSCAPING REQUIREMENTS (#AB02-106): The First Reading of this ordinance was heard at the Council meeting on May 29, 2002. There were no comments from the public. #1295 M/S/C/U (Short/Olsen) Move to pass Ordinance No. 4806 on second reading. 9B - ORDINANCE NO. 4807 (SECOND READING) AMENDING TITLE 7 OF THE BREMERTON MUNICIPAL CODE AND APPROVAL OF CONTRACT WITH KITSAP HUMANE SOCIETY FOR ANIMAL CONTROL SERVICES (#AB02-107): The First Reading of this ordinance was heard at the Council meeting on May 29, 2002. Police Chief Rob Forbes pointed out that the "Term" of the "Agreement for Animal Control Services" was changed from an effective date of July 1, 2002 to October 1, 2002. Winton Read, from the Kitsap Humane Society elaborated at length on this issue to address all concerns raised: Larry Dickerson spoke in favor of this contract to ease the burden currently experienced by the Police Department. Chris Nordleaf provided a packet of information to the Council to support her views against the City adopting this contract. Her main concern was that she did not feel that enough research was done to consider other options, and that the City was making this change to simply make money. Ms. Johnston pointed out that the contract would be reviewed in 6-months to address any concerns with the contract. Joe Labady was against this proposal, and asked the City Attorney if it was illegal to not go for bids on a contract. Mr. Lubovich stated that it was not illegal if negotiating services. Mr. Nyqren reassured the public that this was an "on-going" process, and invited those against the proposed contract, to participate in upcoming reviews of the contract. Mr. Short provided comments to support his approval of this ordinance and contract. Mike Shepherd explained his reasons why he is against the City entering into this Contract. Mr. Younger discussed cost issues and concerns over what will happen to the City's facilities if the City retains back the contract. Winton Read emphasized that this contract was a "two way street", and that the Kitsap Humane Society had concerns over this contract as well. He reiterated that at the 6-month review, there is also the possibility that the Kitsap Humane Society would want out of the contract. Will Maupin summarized that contracting out this type of service has an advantage because if the City were ultimately not satisfied with the service, it would be easier to make a change. Wayne Olsen reminded the public that this issue has been studied for over three years, and also, if the City retained Animal control, the City would then need to provide or build a new building to house the Department, which would add to the cost.
