his plans to tear down the old JC Penney building to build condominiums.

the remainder of the meeting, due to his required attendance at the District 3 Neighborhood meeting.
11A- PUBLIC HEARING AND ORDINANCE (FIRST READING) REGARDING DOCKET OF 2000-
2001 COMPREHENSIVE PLAN AMENDMENTS (#AB01-265): Chris Hugo, Planning & Building
Director, reported that the City of Bremerton Comprehensive Plan provides an annual process to
amend the Plan, and specifies that proposed amendments be considered concurrently to assess their
cumulative effect. The draft ordinance proposes to enact selected proposals from the 2000-2001
Docket of proposed amendments. The selected proposals are consistent with the Council's
consideration of their cumulative effect that was presented in Public Hearing on August 29, 2001; the
recommendations of the Planning Commission on the 2000-2001 Docket of proposed amendments;
and City Council findings in open, deliberative session on October 24, 2001.
Five of the proposed amendments (PL00-0054, PL00-0063, PL00-0065, PL00-0073, and PL00-0077)
in the ordinance would effect changes to the Land Use Plan map and the Official Zoning Map. One of
the amendments (PL01-0024) adds supplemental policy language and an "illustrative map" to the
Plan. In August 2001, the Council adopted two non-quantitative policy additions (PL01-0010 and
PL01-0016) to the Plan from the 2000-2001 Docket, and these additions were included in the analysis
of cumulative effect and the Council's deliberations on the full Docket.
Mr. Hugo reiterated that the items included in this Agenda Bill before the Council tonight, are those
that the Council directed staff to include in the ordinance at the conclusion of the Council Work
Session held October 24, 2001. Amendments to the Agenda Bill include Findings & Conclusions,
which were discussed during the Council Work Session. It was also pointed out that the full set of
proposed Goals & Policies that would add supplemental direction to the growth and development
additions to the Land Use Plan were included in the body of the ordinance.

Loren Combs, Interim City Attorney, clarified that the issue before Council was a Public Hearing on
the ordinance, which is a policy issue. Therefore, any testimony should be restricted to the contents
of the ordinance only.
Carlos Montgomery_ read an e-mail message from George & Helen Miller dated November 18,
2001 into the record to express their concern over what they deemed "...a breakdown in the
executive and judicial process which citizens have a right under/aw to expect from our elected and
appointed City officials..." Secondly, Mr. Montgomery_ attempted to express his own frustration of the
entire process for the proposed Comp Plan and Zoning Map Amendments conducted by the Planning
& Building Department, the Planning Commission, and the City Council, which he felt was
"unprofessional and unfai#'. He was particularly concerned with the Deliberation Session held by the
Council on October 24, 2001 to deliberate the proposed changes, where he was "dismayed that the
public was excluded from participating".
During this testimony, several "point of orders" were called by different Council members due to
"personal attacks" made by Mr. Montgomery. He was then asked to leave the meeting at
approximately 6:15 P.M. by Vice-President Shepherd.
Elizabeth Wilson representing Port Blakely Communities, provided comments on Comp Plan
Amendment #PL01-0024 regarding Downtown Development Policy Additions, and the Calthorp Plan
for Downtown Revitalization, which she thinks will go a long way to give current and future downtown
properties owners some security in what development will be coming downtown.
James C. Tracy, Land Use Attorney, referred to the Work Session held by the Council on October
24, 2001 to deliberate the proposed Comp Plan and Rezone Map Amendments, and requested a
copy of the audio tape from that meeting. Secondly, he asked the Council to provide some written
objective basis for the decision not to include certain proposed amendments in the final draft of the
adopted Comprehensive Plan and Rezone Map and ordinance. Loren Combs responded that
regarding the first request, Mr. Tracy was making a "Public Records" request, which under State law
requires a response within 5 days. Regarding the second request, it was established that because
this was legislative action, the Council was not required to specify findings as to why items were
excluded.
Ed Rollman expressed his disappointment that the Council was accused of "muzzling" the public
while trying to create solid policy with these Comprehensive Amendments.
Carol Arends referred to the Weslon Place Rezone, and clarified that the change would only include
the section along Kitsap Way, and not the portion along the shoreline.
Mr. Hugo pointed out that Exhibit"C", the Illustrative Plan Map; and a letter dated August 29, 2001
from Rick Kimball, SEPA Administrator with the Kitsap County Department of Community
Development were inadvertently left out of the packet of information, and therefore were distributed
prior to the meeting. He noted that any questions regarding these items could be discussed at
second reading.
Will Maupin stated that Council determined their actions were in accordance with the current
Comprehensive Plan; and that Council agreed with the findings of the Planning Commissions. He
asked Mr. Hugo to elaborate on the planned "update" to the Comprehensive Plan. Mr. Hugo
confirmed that the Council discussed these issues during their deliberations at the Work Session on
October 24, 2001; and that the update of the Comprehensive Plan was mandated by State law. He
announced the process would begin this winter, and conclude next September. He encouraged the
community to be involved with this process.

Mr. Combs clarified that Mr. Shepherd was properly conducting this Public Hearing in accordance
with the Rules & Procedures; and further established that the Council has held numerous public
hearings on the various proposed Comprehensive Plan and Rezone Map Amendments where the
public was allowed to address the Council. The Council then held a Work Session on October 24 to
work among them selves to discuss these issues. Although the public was not allowed to speak at
this particular meeting, it was open, and they were allowed to attend and view the Council at work.
#1655 M/S/C/U (Maupin/Arends) Move to approve the 2000-2001 Comprehensive Plan Amendments
with Concurrent Rezone ordinance on first reading.
11B - PUBLIC HEARING AND ORDINANCE (FIRST READING) AMENDING THE ClTY'.~
OFFICIAL ZONING MAP (#AB01-266): Chris Hugo, Planning & Building Director, reported that the
City of Bremerton Comprehensive Plan provides an annual process to amend the Plan, and specifies
that proposed amendments be considered concurrently to assess their cumulative effect. The draft
ordinance proposes to enact selected proposals from the 2000-2001 Docket of proposed
amendments. The selected proposals are consistent with the Council's consideration of their
cumulative effect that was presented in Public Hearing on August 29, 2001; the recommendations of
the Planning Commission on the 2000-2001 Docket of proposed amendments; and City Council
findings in open, deliberative session on October 24, 2001. He added that in the future, the Comp
Plan Map would be changed in one process; and the Rezones would be done by the applicants at
their own timing, which may help alleviate some of the complications experienced year.
#1742 M/S/C/U (Arends/Olsen) Move to approve ordinance on first reading, amending the City's
Official Zoning Map.
At the conclusion of regular Council business, the Council meeting was adjourned at 6:30 P.M. and a
Study Session was held immediately following the Council Meeting in the Council Conference Room
to hear an "OLYMPIC SOCCER & SPORTS CENTER-OPERATIONS UPDATE".
