They are currently looking into landscaping an area of excess right-of-way at the southeast corner of Callow Avenue and Burwell. PUBLIC RECOGNITION Bob Tul_o and Mary_ lyn Waibel announced the City would be participating in the "World Changers" program July 14 - 21, and provided a map showing the residents selected for the home rehabilitation program. It was further announced that the City of Bremerton was chosen to participate in the "World Changers" program next year, therefore the Council members were encouraged to look around their respective Districts and report any homes that they felt would benefit from the program. Lastly, the Council members were encouraged to attend a Barbecue at the Bremerton High School on Friday, July 20 at 5:30 P.M. to honor and show appreciation for the volunteer students who provide the work. Roy Mclnnis thanked the Council staff for showing their appreciation and acknowledging his willingness to provide invocations for Council meetings, and stated that he was always willing to help out whenever he could, and hoped that everyone was also willing to do their part. Darrel McDorman stated that he raised concerns a few weeks ago regarding the ingress/egress onto Wheaton Way from the new Walgreen's, and again warned the City of his fear of traffic accidents. 10A - ORDINANCE NO. 4764 (SECOND READING) AMENDING EXISTING GAMBLING TAX RATES AND ESTABLISHING A NEW TAX RATE FOR HOUSE-BANKED CARD GAMES (#AB01- 128): The first reading of the ordinance was heard at the Council meeting on June 13, 2001. L ur L Han n asked for clarification on this action before Council, then expressed her fears that passage of this ordinance would pave the way for casinos in Bremerton, which she felt would not be a good thing for the City. Paula Johnston responded that the City gambling tax code currently does not provide for house-banked card games, so it is being proposed that the City adopt the same taxing scheme and tax rate that Kitsap County has implemented. The tax rate would be 2% of the gross receipts generated from house-banked card games. Also included in this amending ordinance are housekeeping changes to gambling rates for non-profit organizations who offer bingo, raffles, and pull tabs pursuant to changes in RCW 9.46. Mr. Reed commented that although he understood Mrs. Hanson's concerns, the Council could not legislate "morality", but the Council needed to legislate "opportunity" to encourage economic growth. Mr. Esser pointed out that the City's zoning already allows casinos and the action before Council tonight was merely changing the tax code. #0825 M/S/C/U (Reed/Esser) Move to pass on second reading Ordinance No. 4764, amending existing gambling tax rates pursuant to RCW 9.46 and establishing a new tax rate for house-banked card games. Mrs. Arend$ stated that this was a "house-cleaning" issue, and would allow the Council to meet in the Council Conference room as well as the Council Chambers. The street and sidewalk are described legally in the attached dedication documents, but can be generally as the southeast corner of the intersection of Cherry Avenue and Ash Street. The street and sidewalk to be dedicated were constructed in accordance with the City Street Standards and were inspected by the Department of Public Works and Utilities during their construction. Improvements to the street include paving, curb and gutter, and sidewalk. A condition of accepting the proposed dedication is a requirement that the City of Bremerton agrees to maintain and manage this area of rights-of-way pursuant to State law and City Code and policies. Staff recommended passage of the proposed resolution. There were no comments from the public. #0965 M/S/C/U (Rollman/Younger) Move to pass Resolution No. 2815, which accepts the dedication, as City of Bremerton rights-of-way, of the southeast corner of the intersection of Cherry Avenue and Ash Street; and which obligates the City to manage and maintain this area of rights-of-way; and which authorizes the Mayor to sign the dedication documents. 11B - RESOLUTION NO. 2816, REGARDING THE RECOVERY OF FEES FOR REMOVAL OF VEGETATION ON MULTIPLE PROPERTIES (#AB01-134): Janet Lunceford, Building Development Specialist II, reported that Ordinance No. 4584 declares that it is unlawful and a nuisance to allow, continue, or maintain grass and weeds exceeding 12 inches in height, shrubs, brush, vines or trees, which constitute a fire hazard or provide a harborage for rats, rodents or horticultural pests, or noxious and poisonous plants. The listed properties are currently in violation of the ordinance and pursuant to Section §.14 of the Bremerton Municipal Code, Council is asked to approve the removal of the nuisance vegetation on the property and collection of the costs incurred by personal judgement against the owner and a lien against the property, it was noted that several properties have since met requirements, and therefore were removed from the list of abatements. There were no comments from the public. Mr. Esser suggested that the media run a story to encourage landlords and property owners to maintain their properties because the Council will take action to force compliance with the ordinance.
