with the downtown strategy held earlier today.

9B - PROFESSIONAL SERVICES AGREEMENT WITH RYAN. SELLS. UPTEGRAFT, INC (#AB01-
041): Risk Manager Pe~__~y Lesser summarized that the City needs to appoint defense counsel to
represent the City of Bremerton in Linda Lee Kreifels vs. City of Bremerton, a police liability matter.
Defense costs are unknown at this time but can not exceed $20,000 under the terms of this contract.
There were no comments from the public.
Mr. Esser stated that although he supports protecting the liability matters of the Police Department,
he voiced concern that the City continues to go outside for legal service contracts. He suggested that
approval of this item be contingent upon verification of canceling one of the government service
contracts signed by the Mayor the end of last year. Mayor Horton replied that the City is going to
more outside legal contracts because currently, there is only one Assistant City Attorney. She further
stated that when outside legal services are required, an effort is made to search for a firm with
specific litigation skills to match the needs of a particular case. She clarified that not a great deal of
money was spent on the other contracts, but until adequate staff is in the City Attorney's office,
outside contracts will be necessary to continue the legal work for the City of Bremerton. She also
clarified that although this contract states costs would not exceed $20,000, it does not necessarily
mean the full $20,000 will be spent, and this contract, as all others, would be diligently monitored.
#0858 M/S/C/U (Arends/McConnell) Move to approve the professional services agreement with
RYAN, SELLS, UPTEGRAFT, INC.

9C - PROFESSIONAL SERVICES AGREEMENT EXTENSION FOR CITY COUNCIl
REPRESENTATION ON ISSUES RELATING TO REJECTION OF CITY ATTORNEY',~
RESIGNATION AND ACCEPTANCE OF WITHDRAWAL (#AB01-042): Council President ~
reported that outside legal counsel has been retained to represent the Council to support the
Council's rejection of the City Attorney's resignation, and acceptance of the City Attorney's withdrawal
of her resignation. The contract expired on December 31, 2000, and now needs to be extended to
June 30, 2001 if representation of the Council is to be maintained.
There were no comments from the public.
Mr. She_Dherd clarified that this was not an increase in the contract amount for money, but rather an
extension of the date for the existing contract. Mr. Farr stressed that is was the Council's fiscal
responsibility to conclude this issue, and to quit spending this money.
Mr. Olsen asked why a Seattle attorney was chosen; and Carol Arends asked why a contract
extension through the end of June was required. Ms. Malanca explained that it is not yet known
whether a Judge from Pierce, King or Kitsap County Court will hear this case, but it is likely to be a
Judge from King County, and therefore a Judge from Seattle makes more sense. Also, this is the
same attorney that successfully handled the 1-695 matter. It was also explained that the end of June
was chosen to ensure the time frame for the probability that the Mayor's attorney would depose each
and every Council member. However, once it is determined who will hear this case, an attempt will
be made for a clean, clear Summary Judgement, which could negate the need for the depositions.
#1136 M/S/C/U (Shepherd/Esser) Move to extend the Professional Services Agreement with LANE .
