SUMMARY: The City is required to complete Combined Sewer Overflow (CSO) Reduction
Improvements in the Pacific Avenue Basin by 2007. A major component of the work is installation of
a large trunk sewer to convey stormwater fi.om the western half of the basin to the existing outfall at
the Ferry Terminal. This Supplemental Agreement No. 1 adds scope and budget to the Professional
Services Agreement with Exeltech Consulting, Inc., to allow integration of the permitting and design
of the ~ storm sewer and other appurtenant system modifications into the Downtown
Pedestrian/BTC Access Improvements project.

FISCAL IMPACTS (Include Budgeted Amount): Maximum amount payable for the CSO
Reduction Component is $345,285.99, amending the contract maximum amount payable to
$4,270,977.99. This work is included in the 2004 budget - the project is funded by an EPA Grant, and
a Public Works Trust Fund Loan.

RECOMMENDED MOTION: Move to approve Supplemental Agreement No. 1 to the existing
Professional Services Agreement with Exeltech Consulting, Inc. and authorize the Mayor to finalize
and execute the necessary contract documents for the agreement.
