SUMMARY: The current provisions of Ch. 2.13 BMC need to be clarified regarding the location for
filing applications and appeals to the Administrative Hearing Examiner and to further provide for a
refund of appeal filing fees when the appellant is the substantially prevailing party. The filing fee for
an appeal is $175. The proposed ordinance makes these changes to Chapter 2.13.
ATTACHMENTS: Proposed ordinance
FISCAL IMPACTS (Include Budgeted Amount): Administrative Heating Examiner appeal fees in
the amount of $175 would be returned in each case where the appellant is the substantially prevailing
party of an appeal.
