RESOLUTION ON SURPLUS AND SALE COUNCIL MEET1NG Date: December 22, 2004

SUMMARY: The City has received an offer from Bealko, Inc. to purchase certain public utility
property. The property is not currently used for public utility service nor will it be required for
providing public utility service in the future. The offer to purchase the property is fair market value
and the City and greater community would be better served by the surplus and sale of the property.

FISCAL IMPACTS (Include Budgeted Amount): The public utility would receive the sum of
$2,900,000 (less fees and costs) from the sale of the property and the property would be returned to
the tax rolls.

RECOMMENDED MOTION:
I move to pass Resolution No. &~ 1~ q declaring the public utility property surplus, approving a
sale of the property pursuant to BMC 2.78.040 to Bealko, Inc., approving the purchase and sale
agreement and authorizing the Director of Public Works and Utilities and the City Attorney to finalize
any and all documents necessary to close the transaction and authorize the Mayor to execute the same.
