SUMMARY: David P. Horton is currently the Assistant City Attorney handling all of the City's
litigation. Mr. Horton also provides essential legal review and analysis for many of the City's
activities and projects. On January 1, 2005, Mr. Horton intends to leave the City and enter into
private practice. The proposed professional services agreement retains Mr. Horton's firm in order to
maintain continuity of representation for the City.
ATTACHMENTS: Proposed Professional Services Agreement
FISCAL IMPACTS (Include Budgeted Amount): Funds are budgeted in the 2005 budget for Risk
Management and the City Attorney's Office to fulfill the terms of the contract.

I move to approve the Professional Services Agreement between the City of Bremerton and the Law
Office of David P. Horton, Inc., P.S. and authorize the Mayor to finalize and execute the agreement
with substantially the same terms and conditions as presented.
