4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The Hearing Examiner has recommended ~nditional approval of a seven-lot prelimina~ plat that was
submi~ed by Dale Oien on April 26, 2002. The site is lo.ted on the east side of Rocky Point Road where it
internees with Marine Drive. The Hearing Examiner has recommended approval, subje~ to ten (10) conditions.
The City pro.dural ordinan~ indi~tes that the Hearing Examiner decision constitutes a recommendation to the
City Council, and that approval must be considered at a closed reco~ decision hearing.

Approval of the plat will create seven building lots within the City. Failure to approve the Rezone and
Preliminary Plat may be contrary to law and will deny the City o£ said seven lots and the resulting housing
units.
