4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
Contract Change Order No. 1 has been negotiated with Stan Palmer Construction to provide reimbursement for all
reasonable and properly documented charges for additional work to the OF-2 Manette Treatment Plant
Conveyance Improvements due to unforeseen complications in the course of the Lebo CSO Project. Contract
Change Order No. 1 also includes a reckoning (including increases and decreases) for specific bid item quantity
work. The amended contract amount is $617,473.11. The request before the City Council is to authorize the
Mayor to execute Contract Change Order No. 1 to the OF-2 to Manette Treatment Plant Conveyance Improvement
contract with Stan Palmer Construction in an amount of$60,442.11. Staffrecommends approval of this execution
and authorization.

The City risks receiving a claim from the contractor for non-payment.

This project is part of the CSO Capital Program and is funded by a Public Works Trust Fund (PWTF) loan. The
additional cost of the project (from Change Order No. 1) reduces the remaining amount of the PWTF loan that is
available for future projects.
