SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION: The City has been asked to vacate a portion of the alley abutting Lafayette north of Porter to allow property maintenance by the abutting owner. This alley was included a 1994 survey of unopened rights of way subject to vacation by operation of law (see attached legal memorandum). All other right of way fi'agments in the vicinity subject to vacation by operation of law are proposed for vacation by this resolution to encourage private maintenance and development, return property to the tax roles, and save administrative processing of repeated requests in the future. These vacations are outside the acquisition area for the SR 304 Transportation Improvement Project. 8. RECOMMENDATION: Pass Resolution No o~{,, 3,ff 9. IMPAL"T QN STAFFING, BUDGETS. FACILITIES, EOUIPMENT OR OTHER RESOURCES: TO: City Council Members FROM: Ian R. Sievers, City Attorney DATE: 12/1/97 Vacation by operation of law You may recall a vacation by operation of law of a portion of Porter Street and abutting alley in mid 1995. This resolution completes the vacation of these unopened fights of way in this vicinity. In 1994 the engineering division completed a survey, including mapping and legal descriptions, for all rights of way subject to vacation by operation of law criteria. These rights of way together totaled approximately six acres. The intent was to initiate vacation of these rights of way using the resolution method rather than waiting for individual property owners to petition for the portion abutting their property. For example, the action before Council was requested by two owners, and if handled individually, this vacation process might be repeated repeatedly over an indefinite period to accomplish the area of vacation proposed in the Council's resolution. This action completes the vacation except for one additional plat near Kitsap Lake. This vacation by operation of law differs from the typical vacation in some important aspects. Streets platted in unincorporated areas before 1909 where considered to be conditional dedications by the state law of that time. If the rights of way were not "accepted" by the County by "opening" or development within five years of dedication, they reverted back to the developer or persons who had purchased the lots adjoining these rights of way. Case law has clarified that the reversion of the property was automatic, and these streets became private property after five years even though the county property records continue to show a platted street. The statutory scheme was repealed in 1909 making dedications after that point a permanent transfer. Several of these mm-of-the-century plats with unopened streets where incorporated or annexed into the City of Bremerton. We use an abbreviated vacation procedure to clear title to these streets in favor of the adjacent owners. No compensation is charged for the value of the land since the private landowners legally already own the property. Any private easements acquired by long term use within these platted rights of way are not affected by the vacation and continue to be controlled by the law relating to private easements. If any private parcels without private easements appear to be landlocked by the vacation, it should be kept in mind that they are landlocked now anyway, and have no rights to use the platted streets which don't abut their property. They do have a right to condemn a private "way of necessity" under RCW 8.24 to gain access over private property if they are landlocked. If the City wished to develop these streets now, we would be required to condemn and pay for the easements. Vacation of these streets benefits the City by returning the property to the tax rolls, and allows full utilization of land including infill development and maintenance. CC~ Lynn Horton, Mayor Randy Witt, City Engineering RESOLUTION NO.~ A RESOLUTION proposing the vacation of portions of Porter Street, Hartford Ave., Farragut St. and alleys within blocks 3, 5, 6, 8, 9, 10, 12, 13, 14 and fifteen, all within the Plat of Port Orchard, and setting a hearing date for vacation. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION: In 1992, the City began upgrading the system that water operators use to control the valves, pumps, alarms, and other critical components of the drinking water system. This project completes this upgrade which replaces old and outdated control equipment with computerized components and converts electronic signal transmission fi.om telephone to radio which will improve reliability and provide long-term cost savings. Upgrading the SCADA system will provide the strictest control of water quality and quantity. The project is recommended to be sole-source to Technical Systems, Inc., the company that has designed and constructed all previous SCADA upgrades for the City. The total cost of the project is not to exceed $371,204 and will take approximately 2 ½ years to complete. 8. The "Water System SCADA Upgrade - Phase IT' continues to improve the SCADA system from out-dated tone equipment to a computerized system. Prior improvements upgraded the SCADA for the surface supplies and the Gorst area wells, and added integrated alarm capabilities. This next phase will add the rest of the water system's wells, pump stations, reservoirs, and other system components. Th/s phase will also change the SCADA system from phone telemetry to a radio telemetry system. Radio reduces the cost of the SCADA system over time since montNy phone charges are eliminated. SUMMARY STATEMENT AND REOUIREMENT FOR COUNCIL ActION: When the City Council selected the preferred alternative for the SR304 Transportation Improvement Project it included providing three lanes of traffic on Burwell Street. At that time staff was directed to evaluate methods to address the replacement of the lost on-street parking removed along Burwell Street from Hewitt Avenue to Chester Avenue. A series of neighborhood meetings were held to develop a recommendation, which was then reviewed by WSDOT and FHWA staff. All property owners and residents were notified of the neighborhood meetings. The recommendation is generally to provide up to two asphalt parking spaces per unit off of the alley for those properties that front on the south side of Burwell Street from Hewitt Avenue to Chester Avenue which do not currently have two improved spaces per unit. The report summarizing the neighborhood meetings and a resolution detailing the recommendation are attached. This item was discussed at the Study Session of December 1, 1997. All the people who attended the neighborhood meetings were notified of the study session and this Council meeting. A Resolution regarding the SR304 Transportation Improvement Project Parking on Burwell Street. WHEREAS, the City is a partner and the lead agency in the SR304 Transportation Improvement Project; and, WHEREAS, the preferred alternative selected for the project includes providing for three lanes of traffic on Butwell Street from Hewitt Avenue to Pacific Avenue; and, WItEREAS, the preferred alternative requires the removal of existing on-street parking on Burwell Street from Hewitt Avenue to Pacific Avenue; and, WHEREAS, at the time of selection of the preferred alternative the City committed to evaluate methods to off-set the residential parking removed on Burwell Street from Hewitt Avenue to Warren Avenue; and, WItEREAS, City staff held a series of neighborhood meetings to formulate a recommendation for off-setting the on-street parking removed and received concurrence from Washington State Department of Transportation and Federal Highway Administration Officials on the recommendation; now, therefore BE IT RESOLVED by the City Council of the City of Bremerton: That the City recognizes the oppommity unique to this project to provide "mitigation" for the on-street parking removed in the residential areas along Burwell Street as part of the SR304 Transportation Improvement Project. This unique opportunity arises from the Federal and State determination that addressing the removal of on street parking along Burwell Street is an appropriate project activity and is eligible for Federal and State reimbursement. The additional lane will be added to the south side of Burwell Street, necessitating removal of the existing on-street parking from that side of the street. To off-set the removal of the on- street parking on Burwell Street from Hewitt Avenue to Chester Avenue, the City will: Where physically feasible, provide up to two asphalt parking spaces per unit off the alley for those properties that front on the south side of Burwell Street from Hewitt Avenue to Chester Avenue which do not currently have two improved spaces per unit. This program is voluntary, that is only those property owners who desire the improvements will receive them. Properties that do not have sufficient space to provide for two on-site parking spaces per unit offof the alley will not be provided additional remote Parking. Properties that front on the south side of Burwell Street from Hewitt Avenue to Chester Avenue and do not have alley access may develop, a mutually acceptable and appropriate alternative asphalt parking space placement. Existing dirt or gravel parking areas may be paved under this program; existing paved areas will not be improved. Page 1 of 2 o o In kind cash payments to property owners will not be permitted, with the exception of an eligible property owner who constructs a garage or similar improvement, will be eligible to receive the average cost to provide the appropriate number of asphalt parking space(s) on a per space basis. Payment will be made after the garage is constructed. This program terminates one year aRer the date of award of the construction contract for Buxwell Street portion of the SR304 Transportation Improvement Project unless otherwise extended by the City. No action will be taken on Burwell Street from Chester Avenue to Warren Avenue. Conducted as part of the SR 3/304 Gorst to Bremerton Transportation Improvement Project September, 1997 25406 SOUTH KINGSTON ROAD N.E. KINGSTON, WASHINGTON 98346 (360) 297-4300 FAx: (360) 297-7762 · ~ Bonnie ,Kr~,,use' BRWLRPRT.DOC ... 'P.~3 I. Background During the Environmental Impact Evaluation for the Bremerton to Gorst Transportation Improvement Project alternatives were examined to improve traffic flow, commuter access, pedestrian safety, and HOV preference between Gorst (at the railroad bridge) to the downtown Bremerton Ferry Terminal. The preferred alternative in the Final Environmental Impact Statement (FEIS) included landscaped, boulevard-type treatments in the Callow/Wycoff area (Bremerton Gateway) and a one-way couplet system near the ferry terminal for improved terminal access/egress, but no changes were recommended for the section of Burwell that linked the two, primarily due to potential impacts on current residents/property owners and business owners. Prior to the FEIS being adopted, Value Engineering was conducted for the entire project. A key recommendation was that the Burwell segment of the SR3/304 Corridor be improved, commensurate with the planned improvements at either end. The City of Bremerton appointed a Citizen Task Force to evaluate potential alternatives for improved traffic flow through the Burwell area, including 1) to create a one-way couplet system using Burwell and Sixth Street, and 2) to expand Burwell's capacity by removing all on-street parking allowing four lanes of traffic to and fi:om the downtown core. The almost unanimous recommendation of the Citizen Task Force, which was adopted by the City Council on December 11, 1996, was to remove parking on only one side of Burwell, creating two lanes of inbound traffic and one lane of outbound traffic, with additional outbound traffic being distributed onto Sixth and Eleventh Streets. Two questions remained: From which side of Burwell should parking be removed? and, recognizing that fewer parking spaces would be available, What might be done to offset parking problems caused for residents? The City Engineering Department determined how many parking spaces would be lost on each block and conducted a house by house survey of existing parking spaces. The survey counted garages, obvious in-use parking spots on properties, and driveways. As part of the survey, the City Engineer applied the new construction code standard of 2 parking spaces per dwelling unit (the maximum requirement) to existing dwellings and determined a total number of lost parking spaces for each which are not supplied by existing off- street parking. This yielded a replacement parking space "need" for each block as follows: Replacement Parking Spaces Needed On the Block Between: North Side South Side Hewitt ~ High 7 3 High ,~ Anoka 8 4 Anoka ,~> State 1 0 State ~ Chester 8 16 The Project Team was interested in knowing if each block's residents and property owners were · [,Bonnie Krause - BRWLRPRT;DOC .. ..~- .......... isage 4 interested in replacing those parking spaces, for instance with a community parking lot, or some other solution. H. Description of the Block Meetings Block meetings were held to garner resident and property owner ideas: Number of Block Date Attendees Hewitt Avenue ~> High Avenue High Avenue ~ Anoka Avenue Anoka Avenue ¢~ State Avenue State Avenue ~ Chester Street August 19, 1997 9 August 21, 1997 6 August 26, 1997 3 August 28, 1997 5 Fliers announcing the block meetings (as attached to this report) were distributed to each residence and mailed to each property, owner. Nevertheless tm-out was relatively low; although overall a good mix of owner/residents and property landlords was achieved. Presentations were made outlining; ,~' Project history and major elements ,/' Meeting purpose v' Technical and legal aspects of the work, including the fact that there is no legal requirement for the City to replace parking on its right-of-way Discussion was lively and generally consistent in terms of the issues addressed. A comment sheet was distributed, with copies freely given for attendees to give their neighbors. Two were returned, from a resident on Anoka Avenue and a resident of the 1600 block of Burwell. The commitment was made to all meeting participants that they would be notified by mail of subsequent City Council study sessions or general meetings where this issue will be taken up. It was noted in each block meeting that the City Council will be responsible for making the final decision, after reviewing recommendations from the City Engineer. Note: (4) Attachments to this summary include: Copy of Flier distributed to every household on each block & mailed to all property owners Parking lot configurations displayed at Block Meetings for discussion purposes 4 Bonnie Krause - BRWLRPRTJDOC - 'Page'5 III. Summary of the Block Meetings Meeting participants generally did not object to the "replacement parking space allocations" for their block. A few participants did say that their own household had need for more than (the allotted) two parking spaces, or that their visitors would have no place to park. However, the overall reaction was neutral, indicating that participants considered the method reasonable. Comments showed an understanding that rental commuter parking spots are not going to be replaced. Interestingly, this seemed to be viewed as a positive step by the City, at all four neighborhood meetings. · Most vocal over the loss °fparking were the owners of rental property, who fear both loss of rental income and parking function. · Virtually none of the meeting participants -- homeowners, tenants, and landlords -- want (more) parking lots on their residential block. ,/' Parking lots are perceived as a neighborhood blight -- more concrete, fewer homes, more deterioration towards commercial uses. ,/' Parking lots would provide a focal point for illegal activity and vandalism. Safety is a key concern. Some objection centered on lack of convenience i.e. having to walk too far carrying groceries. The question of acceptable solutions was more difficult. About half of the participants spent some time expressing disapproval of the City process that is going to take away their parking. With parking lots seen as undesirable, participants were hard-pressed to find an alternative. · Each of the four meetings then progressed to a different approach to the problem: The City should find ways to enable the individual homeowner to solve the problem for themselves. · ,/Each property has rather unique difficu, lties/oppommities e.g. narrow vs. ample alleys; old, small garage vs. blacktop area; steep vs. level alleys. ,/' People who want to add a garage or parking space on the alley should receive easier zoning variances, to offset their loss of parking. The City should consider creating a no or Iow interest loan program for people improving their own parking situation. ~ ,l~onnie Krause - BRWLRPRT:DOC ............. ~ge 6 · The biggest opporUmity for off-setting lost parking is in fact the alleys. ,/It was suggested that the City specifically improve the alleys wherever possible on the affected blocks. · /' The City should improve alleys on both sides of the street if possible on affected blocks, since all residents will in fact be impacted by decrease in available parking. The potential for alley improvement was the clearest factor that participants felt should be the guide in determining which side of the street to remove parking from. That is, take the parking away from the side of the street that has the most potential for additional parking on its alley. IV. Follow-Up and Conclusions City and project staff undertook follOW-up in two areas: Review with Federal Highway Administration: Would providing parking on individual properties be an acceptable resolution to mitigating removal of on-street parking along Burwell? Would that mitigation be eligible for Federal funding participation? Discussion focused on the advantages of this approach: lower cost to the project and more direct mitigation of specific impacts to each property fi.om the removal of adjacent on-street parking. FHWA staff indicated that providing on-site parking improvements is an acceptable method of addressing the issue and is eligible for Federal reimbursement as part of the project cost. The proposed standard of two spaces per unit is acceptable. However, lump sum payments to property owners in advance of construction is not acceptable; instead, a payment of average cost of providing a parking space to a property owner who constructed a garage after the construction is acceptable. Survey qfalley conditions: City engineering staff assessed alley conditions on the Burwell segment affected by the project: quite good. In particular, the south Burwell side alley (which is concrete construction) is wide and well-maintained. The north side alley is also in good condition, although there is a steep segment at one end. Some maintenance might be useful, but major improvements to the alleys are not in order. 6 Notice to residents and owners Block Meeting for Burwell Street residents and owners between Hewitt and High Avenues Tuesday, August 19 6 - 8:00 p.m. In the Board Room of the new Bremerton School District Administration Building 134 N. Marion The City of Bremerton, working with a Citizens Advisory Committee and the Washington State Department of Transportation (WSDOT), has created a plan to improve the traffic flow from Gorst through the City to the downtown ferry terminal. It includes closing one side of Burwell Street to parking. This will result in losing some parking spaces on your block of Burwell. The City is sponsoring a community meeting to review the plan and talk about how to replace the lost parking spaces. The drawing below shows the kind of neighborhood parking lot that might work for your block. to the meeting. Thank you! Please take a look at it and then bring your ideas Neighborhood p~king lot lease join us and help figure out the best solution to parking on your block. Questions?
