COUNCIL MEMBER REPORTS
Mr. Colvln acknowledged Ron Anderson in the audience, and noted he
would be speaking during Public Recognition.
Mr. Montqomer~. announced a Town Meeting will be held by the Kitsap
County Veterans Coalition on August 21, 1997, 7:00 - 9:00 P.M., at
the Westside Improvement Center. The purpose of the meeting is to
hear from candidates for the 35th District, City of Bremerton
Mayoral race, and other candidates. All veterans and their
families, active duty military personnel and their families, and
the general public are invited to this event. He was pleased that
the Concert on the Boardwalk was well attended and the weather was
great.
Mr. Winters thanked all participants and particularly the children
performers involved in Summer Fest '97, which was held on July 19.
He thanked Robert Boddie for asking him to volunteer his services
for that event. On July 24, at 12:00 Noon, he will attend the
Bremerton Area Chamber of Commerce luncheon, and at 6:30 P.M. he
will attend a meeting on lake weed control at the Cascade Natural
Gas building on Kitsap Way.
Mr. Fart reminded everyone that Council Districts #6, #7 and #8
will hold a joint Neighborhood Meeting on July 31, 1997, 7:00 P.M.,
at the new Bremerton School District Office, 134 N. Marion Avenue.
PUBLIC RECOGNITION
Ron Anderson, Port Of Call Hospitality House, stated the Port of
Call Hospitality House is an organization that is affiliated with
Cadence International, which formerly was known as Overseas
Christian Servicemen's Centers. He and his wife Sunny have
established a hospitality house at 901 Times Avenue, Bremerton, WA
98312. They offer a variety of services for active military
personnel.
Donald Zimmerman, former Westsound Cable Access Board member and
Kitsap County resident, stated he believes Westsound filled all of
the requests made of it by the City of Bremerton. This involves
such things as the construction of a studio set, which Westsound
never received reimbursement, special events, including the Armed
Forces Parade, and manning of the TV crews for broadcasting City
Council meetings. Those services were funded by Falcon
subscribers, who brought $200,000 to Westsound, and yet Falcon
subscribers have not yet been connected to the output of Westsound.
In the meantime, TCI funds and City of Bremerton funds have either
been withheld or very slow in coming. Westsound even acquiesced to
the City's demand, represented by one person, to remove Westsound's
Executive Director. He asked the City Council to fund what the

referenced the Westsound users Handbook wherein it specifically
states the programming comes from the community. Westsound follows
FCC regulations, i.e. programming must be non-commercial, not
obscene or pornographic, not constitute liable, slander, invasion
of privacy or violation of trademark copy right, must not be
fraudulent, must not attempt to incite any violence to persons or
property or contain speech not protected by State or Federal
constitution. Programming must not violate local, State, or
Federal law. He asked the Council to give Westsound time to fix
the problems.
Patricia Mathes, Westsound member, referenced a newspaper article
that came out in today's Port Orchard Independent about Westsound
in which the Kitsap County Commissioners decided to hold a Study
Session followed by a Public Hearing concerning the termination of
their contract with Westsound. She suggested the City of Bremerton
consider scheduling a Study Session and allow members of Westsound
members, producers, directors and members of the public explain why
it is important that Westsound continues to function and the City
continues its support, which would then be followed by a Public
Hearing. She pointed out those watching this City Council meeting
broadcast over Channel 12 were watching Westsound at work.
Shannon Bell, Bremerton resident, reported on a recent Special
Olympics Softball Tournament in Lynden, Washington, where Bremerton
was represented with two teams.
Carol Atkinson, Bremerton Main Street Association, announced
inscribed bricks and granite blocks will be installed on the
boardwalk on July 24 and 25. The Blackberry Festival is shaping up
and vendor spots on the boardwalk are all taken; however, a few
spaces adjacent to the boardwalk are still available. Work
continues putting together a hydroplane exhibition. She was
pleased with the large turnout for the Concert on the Boardwalk on
July 18, the weather was great and the fly over by the Mig 17 was
enjoyed by all. The next Concert on the Boardwalk is scheduled for
July 25, by 'the group "Bochinche". Charlene Burnett, Parks and
Recreation Department, reported the Parks and Recreation Department
is sponsoring the July 25 concert featuring "Bochinche", which is
a Latin Salsa band, and funded by a grant from Kitsap Community
Network.
7A - ORDINANCE NO. 4598 (SECOND READING) GRANTING A NON-EXCLUSIVE
FRANCHISE TO TCI CABLEVISION OF WASHINGTON, #AB97-166
Paula Johnston, Deputy City Clerk, identified several housekeeping
changes following first reading of the ordinance as well as input
from Council that was incorporated into the contract:
TAPE #1479
City Council Reg. Mtg. Minutes
July 23, 1997
(1). Under Section 2.2 FRANCHISE TERM, TCI agreed to tighten up
the upgrade construction schedule so that it would read: ""The term
of the Franchise shall be ten (10) years from its effective date.
However, if TCI has not upgraded the capacity of its Cable System
so that at least 75 video analog or digitally compressed channels
are available on the System to either 75% of the Subscribers within
the entire Franchise area, or to all the Subscribers within 75% of
the Franchise Area, within 24 months followinq the effective date
of the Franchise, then the Franchise term shall be shortened by 2
years to a total of $ years from its effective date." (Note: the
previous percentage rate was 50% and was increased to 75%.)
(2) Under Section 2.5 FRANCHISE RENEWAL - language that was in
conflict with the City's Charter was removed so that it would be
compatible.
(3) Under Section 4.3A SYSTEM CHANNEL CAPACITY UPGRADE - TCI
agreed to formalize within the agreement a commitment to retain an
analog level of 48 channels, so that when the upgrade is completed
those subscribers that do not want other services available with
the digital compression would have the same service as that offered
to County residents.
(4) Under Section 12.13 EFFECTIVE DATE - the effective date is 10
days from passage and publication of the ordinance.
Patrick McDonald, TCI General Manager, complimented Ms. Johnston on
her outlining the proposed changes. The commitment TCI made on the
analog issue was to cover concerns expressed by Council that
Bremerton subscribers would have the same number of analog channels
as Kitsap County subscribers, which is 48 channels. There is an
adjustment number of 5, which is if the market place dictates fewer
channels on the Expanded Basic Tier, which 90% of the customers
subscribe to, maybe moving some of those to a tier where only 20%
subscribe if the pricing structure can be changed to meet consumer
demands. On the upgrade time frame, the percentage was changed
from 50% to 75%~to be met within a 2-year term.
Public comment - none.
Mr. Montqomery stated he found a conflict between Section 2.2 ( 24-
months) and 4.3A (36 months), and questioned which one was correct?
Mr. McDonald stated the entire Section places out is a 3 year term
that puts in place an 8-year agreement, but TCI is moving towards
a 10-year term by meeting a 2-year commitment to have 75% of the
subscribers activated to the additional services within that time
frame. Ms. Johnston emphasized the sections referenced by Mr.
Montgomery are not meant to be identical; and when a penalty kicks
TAPE #1479
City Council Reg. Mtg. Minutes

in TCI would lose their opportunity to have a 10-year agreement,
which is to their disadvantage. Under Section 4.3A, the 36-months
is the "drop dead" date and means that TCI will be in violation of
the franchise and subject to revocation, if they do not upgrade the
entire system within 36 months.
Mr. Law referenced Section 4.3A (3rd paragraph) Channel Capacity
Upgrade And Completion Schedule were it talks about if the market
conditions exist, TCI can reduce the intended number of channels by
5; however it does not limit the requirement of 75 activated analog
or digitally compressed video channels. Mr. McDonald explained the
combination of analog (48 channels) and the digital compression
services that could range from 50-70 would make up the 75 channels.
There was some initial concern that TCI would maintain the exact
same analog package they currently offer and then add on compressed
services so that people would be required to have a "box" to
provide those additional services. The referenced section states
that TCI will mirror what the County is receiving, which is 48
analog channels. Mr. Law questioned the need for the language as
identified by Mr. McDonald? Mr. McDonald stated that language
could be removed, but it was put in to reassure that a total of 75
channels would be available upon completion of the upgrade.
Mr. Neville referenced the statement: "During the construction
period of the upqrade, .TCI shall not be obligated to provide a
refund or credit to customers where an outaqe was necessitated by
the cut-over from the present system to the rebuilt or modified
system", and questioned the length of outages? Mr. McDonald noted
it would be for short interruption (5-10-30 minutes depending on
the size of the area), which typically occur in the early morning
hours. If it would involve a longer period of time, work would be
carried out, for example at 2:00 AM, so that subscribers would not
be adversely affected. In situations where a customer does not
receive service after a rebuild connection has been made, TCI
servicemen are on call 24- hours per day to trouble shoot that
connection problem. Mr. Neville asked if the actual construction
would include several blocks at a time? Mr. McDonald stated that
would depend on a specific area. A detailed study will be made of
the existing plant and what is required for the upgrade, which will
identify utilization of existing equipment and overlaying of new
equipment. Mr. ~eville stated it was a shame that it took 18
months to get to this point in the Franchise Agreement and hoped
future negotiations would happen in a shorter time frame. Mr.
McDonald stated this process involved a lot of things having to do
with new regulations, which took concerted efforts by TCI and the
City to move through the negotiation process. Although negations
did take a long time, he was pleased with the efforts achieved over
that time frame.
TAPE #1479
City Council Reg. Mtg. Minutes
July 23, 1997
#1789
Mr. Winters stated from his own experience dealing with technical
equipment, he understands the importance of having the right
equipment to carry out the work required. For several months he
has asked the Administration to provide him with an inventoried
list of equipment; however, neither TCI nor the Administration have
provided him with that information. Before talking about upgrades,
he felt it was important to know what equipment is currently
available. It was important to him to know the existing inventory
of equipment in order for him to vote effectively, on behalf of the
taxpayers, formalizing the $.21 per subscriber pass-through charge.
Because he did not receive the requested inventory list, he will
vote "NO" on this issue. He is aware that the City's Purchasing
Agent is working on the inventory list. Ms. Johnston explained the
inventory list is not complete, but they have been identifying
equipment at all Access locations since July 18, and anticipates
the list will be available by July 28/29 that will show all
existing equipment purchased before and after the formation of
Westsound, and the source of funds. The Administration feels
confident that the funding identified in the Franchise for updating
City equipment is adequate to improve programming.
Mr. Colvin questioned the dollar amount resulting from the $.21
pass-through and who receives those funds? Ms. Johnston stated the
$.21 pass-through goes toward funding access television and is
approximately $18-20,000 per year.
Mr. ~aw questioned when the larger channel network will be
available to the subscribers, i.e. by each neighborhood as it is
upgraded or at the end of the first year of construction? Mr.
McDon&ld stated area-by-area is upgraded and the subscribers
receive the expanded programming as their area is added to the
upgrade system. TCI has to achieve activation of 75% of the
subscribers to the upgraded system by the end of two years to meet
that time line. By the time the analysis design and initial
construction is completed to launch those services, active
subscribers will come on line for about a year and building up to
75% by the 2-year time frame.
Mr. M¢Connell stated he doubted the City or TCI were 100% satisfied
with the contract, but believes it is as fair as it can get between
the two entities. He will again abstain on the vote, which has
nothing to do with the contract between the City and TCI, but
rather for personal reasons.
M/S/C(Huff-Menees) to pass Ordinance No. 4598, on second reading,
granting TCI Cablevision of Washington a non-exclusive franchise to
operate a cable system within Bremerton.

Mr. Overson stated his support for the proposed agreement and
complimented Mr. McDonald and city staff for their efforts in
negotiating this agreement. He appreciated TCI's incorporation of
the comments made during first reading of the ordinance.
President Fart stated the only comment he received from a
constituent had to do with the quality of reception on Channel 19
and his response was the data provided by Mr. McDonald on the
importance of checking input cable connections to their TV set. He
will support the proposal with a "YES" vote. He also complimented
city staff and Mr. McDonald for their patience working through the
items.

Mr. With
U S WEST Communications has asked me to contact you to see if they could purchase an
easement for a cabinet on City property. They need to replace an existing cabinet as
shown on the attached sketch.
Per my corvve~sation with Mary Ellen Babbitt, please find enclosed an easement, and a
drawing shov~dng where U S WEST Communications would like to place their cabinet on
a tract in Bremerton that used to be Navy land.
I have been authorized to offer you five dollars a square foot for a total of five hundred
dollars ($500.00) for a 10 foot by 10 foot easement.
The cabinet is approximately five feet high, three feet v, fde and two feet thick. This
cabinet will provide a central point ~br the technicians to make their connections. The
inside is full of connectors attachcd to the cables that pass by this location. By having all
the cables in this area enter this box, they have greater flexibility in choosing a line fbr a
particular customer. This allows them to have access to every line in the area for trouble
shooting purposes. This will also facilitate service to any new development in the
immediate area~
If you would like to talk to me about this, I can be reached on 206,672-7532. (after 4-27-
97 this will be area code 425 instead of 206)

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The Bremerton Shoreline Master Program (implemented through the Washington State
Department of Ecology) has a sedous lack of cladty and policy regarding the development of
some docks and piers within the Oyster Bay Channel. In order to cladfy the City Council's policy
and intent toward such development, an amendment to the Bremerton Shoreline Master
Program is in order. It is believed that continued development with the current policies may
irreparably damage characteristics desired to be preserved by new regulations. The resolution
proposes an option to remedy this situation.
All existing complete applications will be decided under the Bremerton Shoreline Master
Program in effect which are submitted prior to adoption of this resolution.

Staffing: There is potential for high impact on Planning and Zoning staff. Although the
administration intends to focus the research and development on narrow issues, the Department
of Ecology review process may be broader and does require City comment.
It is believed, however, that leaving the issue unresolved will result in a significant amount of

A Resolution Setting a Moratorium on The
Development of Docks and Piers Within the
Channel between Ostrich Bay and Oyster Bay
WHEREAS the Shoreline Management Act of 1971 requires the Bremerton
City Council to adopt a Bremerton Shoreline Master Program which the
State reviews and adopts as part of the Washington Administrative Code;
and,
WHEREAS the Bremerton City Council finds that the current Bremerton
Shoreline Master Program does not adequately address the following
issues in the Oyster Bay Channel:
A. The level of potential navigational hazards created by docks and
piers requiring substantial shoreline development permits in the Channel
between Ostrich Bay and Oyster Bay;
B. The aesthetic quality of large docks and piers in the Channel
between Ostrich Bay and Oyster Bay;
C. The environmental and public trust issues (public waters and
underlying lands are a public resource owned by and available to all
citizens equally for navigation, fishing, recreation and similar uses)
related to docks and piers which rest directly on the beach at Iow water;
and,
WHEREAS the Council understands that the City of Bremerton public use
of shoreline may suffer irreparable damage if development is not
prohibited while regulations are changed: and,
WHEREAS the Bremerton City Council believes that a study period is

FROM: THE GREATER MAJORITY"
RE: ISSUE OF RESIDENTIAL JOINT USE DOCKS/PIERS IN THE "CHANNEL" FLOWING INTO OYSTER BAY. SHOULD THEY BE PERMITED?
ANSWER; YES!
The vocal minority has expressed concern.regarding the above mentioned issue.
They have yet to substantiate any factual safety concerns. The Shorelines
Management Act has been in place since the earlier 1970's providing guidelines over
the development of waterfront. It has consistently served its pupose effectively
providing rights to both public and private property rights.
It appears that the vocal minority is attempting to change very clear guidelines at the local level. The
issue is safety of navigatable waterways which is governed by. the Federal Army Corps of Engineers, State
Department of Ecology, and State Fisheries & Wildlife.
As the City Council is very a~vare of the majority is often silent (please see attached signatures obtained in
a short time). All parties involved recognize the amount of energy the vocal minority has continually
expended. It appears they are attempting to make a clearly defined standard by. xvhich the public and
individual property owners can abide by. seem obsolete.
At this time the greater majority MUST be heard. We must preserve our civil rights as the pendulum has
sxvung more towards socialism and away from democracy. We believe that individuals wanting to develop
their property on the channel of Oyster Bay deserve to do so under existing federal, state and local
guidelines. Please don't "strip" us of our property rights. If anything, you should consider making it
more attractive to be a property owner residing in the City. of Bremerton versus a property, oxs-ner with
rentals in the City of Bremerton. Make us proud.
I am in support of those citizens who currently and in the future desire to
have docks/piers in the channel of Oyster Bay.

Reference: Resolution Number 2621 - Moratorium on Docks and Piers on the CHANNEl,
Ladies and Gentlemen of the Council:
I will echo the congratulations due to whomever drafted Resolution 2621. It is concise,
articulate, germane, and without a doubt - cogent. It was also a pleasant surprise to find
that someone can locate the site of our general concern as being on the CHANNEL
between Oyster and Ostrich Bays - and NOT 1N OYSTER BAY itself. This little
geography lesson should be posted down at the Department of Community Development
for all to see.
In most elected governing bodies, you will invariably find a wide assortment of
personalities, motivations, philosophies and character. Some individuals will struggle to
make themselves knowledgeable of the facts and mechanics of the issues to be brought
before them; some will render hip shooters decisions; some will automatically classify
everything that is New as being a sign of Progress and therefore Good; while some will
sleep through most of the meetings and upon awakening cast their vote for their own
personal best political advantage. It would not be surprising if some of these
characterizations were present, to some degree, in you ladies and gentlemen.
I would ask each of you to be aware of these little idiosyncrasies, and make an extra effort
to vote in consonance with your primary responsibility as Protectors of the Public Trust. I
would further ask, in the matter presently before you, to weigh for a moment the touted
"rights" of property owners to do just about anything their little hearts desire - with the
somewhat constraining fact that their "rights" to total dominion over their own land are
already limited by overriding considerations for the rights of neighbors and the public -
and when they attempt to project those individual land owner "rights" over lands which are
owned by the people of the state of Washington - those "rights" must be weighed in the
balance of the wants of a few versus the aggregated right of the many.
Thank you for your time and attention. I hope that you will approve this Resolution.
Sincerely submitted for your consideration;

#1:
Congratulations to whomever drafted Resolution 2621. It is concise, articulate and
germane; and by God needed.

It is indeed refreshing to find someone who can locate the site of our general concern as

It is to be sincerely hoped that you members of the Council will find it reasonable that a
neighborhood, or the general citizenry, can legitimately recognize and defend an area of
umque environmental features and pristine aesthetic quality; to preserve that uniqueness
for the enjoyment of future generations.
It is similarly hoped that you will also be able to place the interests of the many over the

ENDORSEMENT INFORMATION APPROVED BY COUNCIL PRESIDENT FOR SUBMITTAL:
4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The City Council has been requested to approve a right-of-way vacation and
dedication under BMC Chapter 11.040, first making a resolution, then adopting
an ordinance following a public hearing, under BMC Chapter 11.060. The
vacation action would allow a uniform width 60' right-of-way along Marine
Drive. The dedication action would provide for large radius vehicle turning
movements at the intersection of Marine Drive and Dora Avenue, a sharp angle
intersection.
The City Engineer has reviewed the proposed action. The Planning Commission
has recommended approval on June 3, 1997. Payment amount to City for value of
vacation, less dedication lands : $5,766.11
5. RECOMMENDATION:

9. CLEARANCE COMMENTS:
10. IMPACT OF NON-PASSAGE: The right-of-way width along ~4arine Drive will
remain larger than current roadway standards require. The sharp angle
intersection will remain at Dora Avenue and Marine Drive.
11. IMPACT ON STAFFING, BUDGETS, FACILITIES, EQUIPMENT OR OTHER RESOURCES:
Approval will make recognition of the Marine Drive right-of-way limit
(60' wide) in the field more readily identifiable for enforcement and
maintenance issues on a daily basis. School buses which access Dora
Avenue will have better sight visibility and turning movement at
intersection.
Staff and budget impacts are expected to be minimally improved, except
for time to make map change. Tax base is increased by net addition of
private lands to adjacent property.

Description of Action
The applicant and consultants requested a pre-application conference to discuss all
necessary approval action needed to permit a site plan for 12 units on a site
(42,658.5 square feet) which is located north of the intersection of Dora Avenue and
Marine Drive. Given the triangular shape of the parcel at the south and west
property boundaries and the applicant preferred housing unit, the site plan would
create the need for a right of way vacation, to allow the mix of unit types desired.
The existing right-of-way width along Marine Drive is variable, ranging between 60'-
100' widths within two blocks of the subject property. The variable width is believed
to be the result of two factors-slope and state requirements applicable at time of
road dedication. Vacation of the requested portion of lands would allow a 60' wide
right-of-way to exist after approval of the subject application. The vacation would
add 4,486.85 square feet to the current site size 42,658.50 square feet, an increase
of 10.5 %. The dedication would subtract about 385 square feet for a larger radius
at the corner. The result of approval of both vacation / dedication would add about
4,101.85 Square feet, an increase of 9.6%. The applicant has filed for site plan
approval.
Site Conditions
There is a cut bank within the portion of right-of-way to be vacated currently, with a
change in grade of about 6-10' from pavement surface on Marine Drive to existing
grades on subject property. Vegetation cover (about 85% of the slope) is mostly
exotic noxious plants (blackberry, Scotch broom). Regrading of the applicant
property is likely, given the current zoning, the stated intent of the applicant to
develop a medium density residential complex within the current zoning and
requirements for frontage improvements upon development approval.
Modifications Required by Vacation
No modifications to Marine Drive or the applicant property are required directly as a
result of the right-of-way vacation. The applicant would be required to meet frontage
improvement standards upon request for development approval. Currently the
condition along the frontage is unimproved (no sidewalk, curb &gutter, drainage
system or street lights). There are no known utilities in the portion of right-of-way to
be vacated. Puget Sound Energy has requested a set of plans to review utility
impacts of vacation action (no comments have been received on gas or electric).
Impacts of the Vacation / Dedication Approval on Traffic & Density
The changes in the right-of-way pattern will not change the auto or pedestrian
circulation pattern. The applicant is seeking a right-of-way vacation along Marine
Drive to allow a favorable lot layout, to avoid a setback variance request, on a site
which is constrained by a triangular shape, which affects setback measurement for
the particular type of unit selected by the owner. A site plan for 12 units (duplex,
fourplex and sixplex) was reviewed at a preapplication conference, which represents
a density of 12 du/acre, after vacation. The right-of-way vacation would not affect the
density calculation, because the applicant has not proposed a site plan which
approaches or exceeds the 18 du/acre maximum density, due to market factors.
There is no guarantee that the current owner or future owners will build above the
11 du/acre density, nor is there any reason to prevent development at the maximum
density.
Using lot size after vacation (47,145.35 square feet) as basis for the existing
multifamily residential (MF zone) zoning which allows 8-18 du/acre, the applicant
could qualify for two additional units, after the right-of-way vacation, at the maximum
zoned density of 18 du/acre.
Using lot size after dedication and vacation (46,760.35 square feet) as basis for
the existing multifamily residential (MF zone) zoning which allows 8-18 du/acre, the
applicant could qualify for two additional units, after the right-of-way vacation, at the
maximum zoned density of 18 du/acre.
Staff Comments: None
Community Comments & Notification
The notice of application and comment period of thirty days resulted in several drop-
by file reviews by adjacent property owners and a few phone calls to DCD offices.
There were no objections stated or received on the action. The BMC 11.20. 030
allows the Planning Commission the option to hold a public hearing prior to
recommendation on the final action by City Council.
The following portions of rights-of-way will be vacated:
General physical description of property to be vacated: A strip of land 5' X
97.37' and 200'X 20' along the southwest boundary of Parcel # 226.
General physical description of property to be dedicated: A triangle of land
approximately 38' X 38' X 22' at the southwest corner of Parcel # 226.
Legal descriptions of property to be vacated / dedicated are attached. (See Exhibit
"A"& "B")
Request Basis to Dedicate Right-of way
The above requested dedication is sought in order to develop the property.
Dedication of the comer portion of the public street will serve the following public
purposes:
- Facilitate turning movements of school buses and other large turn radius
vehicles from southbound Marine Drive to Dora Avenue.
- Allow safe visibilty at corner for southbound traffic on Dora Avenue, at stop
sign.
Request Basis to Vacate Surplus Right-of way
The above requested vacation is sought in order to develop the property. Vacation
of the slope portion of the public street will serve the following public purposes:
· place erosion control and soil embankment in perpetual responsibility of
private ownership
· allows private property owner to better control surface and subsurface
drainage and soil moisture conditions affecting sublateral structural support
of private property development
· creates additional setback dimension to permit preferred residential unit and
preferred site plan layout by owner, due to setback distances and lot
configuration (triangle parcel) adjacent to the vacated portion of right-of-way
for Marine Drive
· creates a uniformly dedicated standard right-of-way width (60' wide) along
Marine Drive, for purposes of maintenance, enforcement and liability
demarcation for city public works
Consistency with the Comprehensive Plan and other state and local law:
Comprehensive Plan
Comprehensive Plan Residential Goals, Policies and Strategies establish the
following directions applicable to the proposed right-of-way vacation:
There is one goal and several policies:
(3,) Affordable Housing
(7. b.) Consider allowing Infill development housing of vacant or undeveloped
parcels at somewhat higher densities than surrounding properties, with
assurances.., of fit...;
(12. b.) Promote increased housing density to provide a broader customer base.
Discussion: Currently the site is undeveloped and unimproved, located and
surrounded by properties which are single family in type (4-6 du/acre) although
located in a multifamily zone. The highest densities in Bremerton are the Central
area at 8.1 du/acre. If buildout at maximum density takes place, a density of 11.4
du/acre would result. The applicant site plan is near the build out average density
anticipated in the comprehensive plan and zoning for Bremerton overall. The
vacation action is consistent with the goal and policies to fully use vacant property.
Additionally, there is one strategy which applies:
1. Revise Development Standards: Modify site planing/building design
requirements (setbacks, street widths, etc.) to allow performance based
standards to increase flexibility in housing development.
Discussion: Revising original right-of-way width dedications which enabled natural
grading of slopes to meet grades for Marine Drive road access can now provide
efficiencies in land use and housing development. Today an owner has several
options for grade changes and wall on site which are economical and useful to
resolve grade changes at right-of-way limits. The strategy of the city to increase
flexibility is met by approval of the vacation. The site areas in the right of way
vacation areas would be subject to the perimeter landscape requirements for
maintenance, street trees, etc. upon site plan approval.
The above goals, policies and strategies can be best achieved by creating
residential developments within lands currently zoned for densities which meet state
and local comprehensive plans. The proposed vacation will create a parcel that will
optimize the development potential of private land while also optimizing public
benefits such as reduced ongoing maintenance of slopes, realigned right-of-way
limit lines, which benefits the entire city.
Public interest for right-of-way vacation / dedication
Vacation / dedication of the requested streets within the subject property will serve
the following public interests:
· A new development which meets the necessary requirements given the
triangular lot configuration constraint formed by the intersection of Dora
Avenue and Marine Drive.
· Public tax revenues from property tax base will be increased slightly by
creating a site plan layout that optimizes residential use which will be
desirable to the general public.
Easements: None required for utilities for the proposed vacation / dedication
Planning Commission Recommendation to City Council
Approve right-of-way vacation / dedication as shown on Exhibit A & B.

1. Item XI. Right of Way Vacation - Type III
Matt Mathes presented the staff report for the Dept. of Community Development.
Commissioner Dingfield questioned the zoning (MF) in the neighborhood.
Mr. Mathes confirmed that the existing zoning is "MF" on the site adjacent to the
proposed fight-of-way action.
Commissioner Robinson stated the right of wa.,,' to be vacated has varied widths along
the area proposed to be vacated.
Mr. Mathes confirmed the fight of way widths to be vacated vary (5 ft. wide, 20 ft.
wide), so that the fight-of-way after vacation wSll be a uniform width set at 60 ft. wide.
Chairman Stone and Commissioner Robinson commented that any erosion control
plans would be approved administratively.
Commissioner Robinson moved that the Planning Commission recommend that the City
Council approve the fight-of-way vacation and fight-of-way dedication as shown on
