TAPE #1579 City Council Reg. Mtg. Minutes November 4, 1998 Page 3 of 8 Ann Brown was concerned about the 6,000 County residents who receive City water, but would not get to vote on the fluoride issue. She suggested an advisory vote conducted through the customer water bills, so that all city water- users would have a voice. Mr. Reed explained that this issue was now out of the hands of the City Council, and in the hands of the City voters. 8A - PROFESSIONAL SERVICES AGREEMENT FOR ANDERSON COVE CSO FACILITY PLAN AND DESIGN, #AB98-243 Six consultants were selected from the Professional Services roster and evaluated. HDR Engineering, Inc. was identified as having demonstrated ability in planning and design of Combined Sewer Over[Iow (CSO) reduction improvements to meet Washington State Department of Ecology (WSDOE) requirements. A scope of work was developed with HDR for development of a Facilities Plan (predesign report meeting EPA and WSDOE guidelines) and also final design of the improvements. The scope of work and budget for final design will be developed during completion of the Fadlities Plan, and will be presented to the City Council for approval at a later date. The action before the City Council is approval of a contract for Professional Services with HDR Engineering, Inc. Tom Knuckey, City Engineer, provided a staff report for a Professional Services Agreement for Anderson Cove CSO Facility Plan and Design. He reported that Anderson Cove consists of five separate overflows, and this Facility Plan will address all of them. The Design will address two of the five overflows, with the other three being addressed in a follow-up project. Public comment - none. #0725 MISICIU (McConnell/Arends) Motion to approve a contract for $88,300 with HDR Engineering, Inc. for Professional Services, and authorize the Mayor to execute the same. 8B - TOWER LEASE AGREEMENT WITH PINNACLE TOWERS, INC., #AB98- 244 Pinnacle Towers, Inc. has purchased an existing telecommunications tower enterprise that rents tower space to multiple users located on City property on Gold Mountain and is proposing to enter into a new lease agreement with the City. This site is unusual in that there are four existing towers of which one is owned and maintained by the City for emergency and Public Works communications. This lease agreement includes the rental rate of 15% of gross revenue generated from Pinnacle's three towers from sub-lessees and 60% of gross revenue generated from the City's tower from sub-lessees. The lease term is ten years because the seller of this tower enterprise had an assignable ten- year renewal option that Pinnacle is exercising. The rental payment for this site will be approximately $3,700 per month. TAPE #1579 City Council Reg. Mtg. Minutes November 4, 1998 Page 4 of 8 Paula Johnston, Deputy City Clerk, reponec :hat Gold Mountain is one of the highest points in the Brerr~rton water shed, where this particular tower site has been in existence for over 20 years. She s'~ed the City tower is a substantial tower that can accommodate more than CenCcm attachments, so throughout the years, other users have been added. The n_~'w rent negotiated for City tower attachments is 60% of the gross revenue received by Pinnacle. This will generate almost double the rental revenue the City will receive on a yearly basis from the new 10-year lease Roy' Mclnnis was concerned about the use cf the term "bound for 10 years" used before Council has had a chance to approve the agreement. Ms. Johnston explained the City has an existing ~ssee on the site with a lease that will expire this month, but has an automatic lO-year option. He can exercise this lease option himself, or assign and sell to a r~,v purchaser, which in this case it is going to be an assignment to Pinnacle Towers. Terry Donahue, Attorney for Pinnacle Towers, Inc., reaffirmed Ms. Johnston's statement that there is an existing lease with a 10-year renewal that "kicks in" at the end of this present term. At the reque~ of the City, a new lease that conforms with other leases used by the City was negotiated. Under the new lease, the City is allowed to use the Pinnacle Towers free of charge, with access to microwave towers included. Gordy Byrd asked for cla, fification on the amount of the contract and the City being "bound" to it? Ms. Johnston reassured .1hat Council was being presented a binding contract, and the figures can not be changed. Mr. Shepherd further clarified that the terms of the contract were necj~dated very diligently. #1000 MISICIU (Arends/Olsen) Motion to approve the lease agreement with Pinnacle Tower, Inc. for an existing teleco:'r~nunications tower site on Gold Mountain. 8C - EASEMENT GRANT TO PUGET SOUND ENERGY FOR BREMERTON TRANSPORTATION CENTER, #AB98-245 Puget Sound Energy is requesting an easerr~nt grant across the parking lot adjacent to the boardwalk from 2'"~ Street to the Bremerton Transportation Center for underground power lines. This land parcel is not included in Parks Protection properties so Parks Commission review is not required prior to bringing this issue before City Council. This easement descriptior~will be superseded at a later date with a surveyed description once the power has been installed. Jim Spencer, Parks & Recreation Director, stated this easement is for power required to support the new Bremerton Transportation Center. The power will be TAPE #1579 City Council Reg. Mtg. Minutes November 4, 1998 Page 5 of 8 underground, and when installed, will not be a problem with any of the planning associated with the Sinclair Landing Project. #1114 MISICIU (Arends/Olsen) Motion to approve the easement grant to Puget Sound Energy for underground power lines across the parking lot adjacent to the boardwalk from 2nd Street to the Bremerton Transportation Center. 9A - ORDINANCE NO. 4635 (SECOND READING) REGARDING THE GRANT OF A NON-EXCLUSIVE FRANCHISE TO FALCON VIDEO COMMUNICATIONS~ #AB98-240 Public comment - none. #1335 MISICIU (Shepherd/Arends) Motion to pass Ordinance No. 4635 on second reading, and summary granting Falcon Video Communications a non- exclusive franchise to operate a cable system within Bremerton. 10A - PUBLIC HEARING ON REVENUE SOURCES FOR THE 1999-2000 BUDGET~ #AB98-246 The City is required by RCW 84.55.120 to hold a public hearing on revenue sources of the General Fund. This hearing must be held prior to consideration of the City's property tax levy and must include a discussion of possible increases in property tax revenue. Rich Hanna, City Treasurer, reported this is a new requirement of the budget process as a result of the passage of Referendum 47, which was designed to provide property tax relief and reform the process. In closing, he discussed the two ordinances that would be brought to Council next week to levy property taxes for collection in 1999, and authorization to levy of property taxes at a rate in excess of the Increase in the Implicit Price Deflator. Gord¥ Byrd requested a copy of the City's Budget. Vice-President Mont.qomery informed him that copies of the Budget were available at the Public Library and in the City Clerk's office, and that Council Study Sessions to discuss the Budget were open to the public. Elizabeth Buell asked why property taxes do not remain the same. Vice-President Montgomery explained the figures vary according to the assessed valuations, which can go up or down, so hence, the rates would change accordingly. John Becker wanted to clarify his assumption that the City planned to increase the property tax to 6% of assessed values. Mr. Hanna further explained there are several constraints on the City's ability to levy property taxes. The City is currently levying property taxes at the maximum allowable rate under law, so from 1998 to 1999, the levy rate can not increase. TAPE #1579 City Council Reg. Mtg. Minutes November 4, 1998 Page 6 of 8 The revenue from property taxes to the City will vary from 1998 to 1999 by whatever percentage the overall assessed valuation of all the property in the City changes from one year to the next. He gave preliminary figures, which showed that over all, the City-wide assessed valuation was going to decrease approximately 1%. However, each individual property owner will need to refer to the value assessed by the County because he understands that most residential properties in the City have increased by about 5%, but commercial property has gone down. He reminded citizens that the City is only one of several government jurisdictions to levy taxes on the property within the City, along with the State of Washington, Kitsap Co, Jnty, the school district, the port district, and the public utility district. Mr. Reed asked for further clarification of what "1% of the shortfall" means to the City. Mr. Hanna explained that 1% of the property tax revenue would be approximately $40,000 of revenue to the City. Mr. Overson pointed out that every year Mr. Hanna has been involved with the City Budget, he has never over-estimated the income, and has ended up with a carry-over at the end of the year, which Mr. Overson felt was a strong testimonial and compliment to the City Treasurer. No Council action is requested. 10B - PUBLIC HEARING AND ORDINANCE (FIRST READING) FOR VACATION OF UNDEVELOPED ALLEY BETWEEN YANTIC AVENUE AND HARTFORD AVENU ET #AB98-247 Michael Thorniley is the owner of parcels on both sides of an undeveloped alley within Block 3 of the Charleston Navy View addition. The City Council, as the legislative body, must conduct a public hearing to receive comments on the request to vacate the north 213.01 feet of a 12-foot wide undeveloped alley located south of First Street between YantJc and Hartford Avenues. Jon Holan, Planning Manager, stated staff reviewed this request, and no present or future use for this particular alleyway was found. The Planning Commission concurred with those findings, and approved the vacation. Roy Mclnnis wanted to know if Council approved the vacation of this right-of-way, what would happen to it after the City vacates it? Vice-President Montgomery explained it would go to the property owners on both sides of the alley. In this case, Mr. Thorniley owns both sides, so they would both go to him, and he would then be taxed on the additional property. #2250 MISICIU (Arends/Olsen) Motion to approve ordinance on first reading, to request to vacate the alley and revert it to the ownership of the adjoining property owner. TAPE #1579 City Council Reg. Mtg. Minutes November 4, 1998 Page 7 of 8 10C - PUBLIC HEARING ON RESOLUTION NO. 2678, ESTABLISHING A MORATORIUM ON THE DEVELOPMENT OF DOCKS AND PIERS WITHIN THE CHANNEL BETVVEEN OYSTER AND OSTRICH BAYS, #AB98-248 The City Council approved Ordinance No. 4634 to amend the City's Shoreline Master Program to prohibit docks and piers within the channel between Oyster Bay and Ostrich Bay. This matter has been forwarded to the State Department of Ecology for final adoption. The current moratorium is due to expire on Thursday, November 5, 1990. A new moratorium is being requested to allow staff to respond to requests being made by DOE staff and to allow the Shoreline Master Program to be properly updated. Jerry Peret urged Council to uphold the Moratorium to allow the process to proceed. Cathy Gallaqer also urged Council to uphold the Moratorium. Mr. Reed asked for the current "Findings of Fact" and the work-plan developed for this Moratorium. Jori Holan, Planning Manager, stated the "Findings of Fact" are established under the "VVhereas's" listed on pages one and two of Resolution No. 2678. Mr. Reed stated that "Findings of Fact" are supposed to support accusations. He wanted to know if there was specific proof of the accusation that piers and docks "pose a potential danger to navigation and a threat to public safety". Mr. Holan stated that to his understanding, "Findings of Fact" were made at the previous hearings. Since the conditions have not changed, the dangers would still be present. Mr. Reed again asked if there was proof that there is a danger present. Vice-President Montgomery stated the proof has been established and his question has been answered. Mr. Reed did not concur. He referred to the RCW that spelled out what was required for a Moratorium and also a Continuation of a Moratorium. It stated that a 6-month Moratorium can be imposed, and extended one time, but to extend the Moratorium, a work-plan must be developed for related studies providing for such a longer period of time... It further stated that a subsequent public hearing must be held, and "Findings of Fact" made prior to each renewal. He was asking for these "Findings of Fact" and work-plan. Mr. Holan reiterated his belief that the "Findings of Fact" are presented in the Resolution, which included the statement that the channel between Oyster Bay and Ostrich Bay is physically narrow and shallow, especially at Iow tide. Mr. Reed wanted to know if there were measurements made of the channel, was there proof of the physical narrowness, proof that construction in the area would be incompatible, and was there proof of the hazard. Mr. Holan stated the "work-plan" is listed on the Agenda Bill in the Summary Statement where it indicates the purpose of this extension is to respond to requests by Department of Ecology staff, and to allow the Shoreline Master Program to be properly updated. TAPE #1579 City Council Reg. Mtg. IL Roll Call Those present were Chairman Robinson, Commissioners Boyd, Stone and Dingfield. Quorum certified. Chairman Robinson reported that Commissioner Adams was ill and xvould not attend the meeting, and that Commissioner Woffe would arrive late. Commissioner WoLfe atto'ed at 6:20 PM. III. Approval of the Agenda Motion by Commissioner Stone to approve the agenda as presented. Seconded by Commissioner Dingfield. Question called: Boy& yes; Stone, yes; Dmgfielfl, yes; Robinson, yes. Motion passes. IV. Public Hearing 1. Pre-Annexation for Sheridan Heights area - PAZ98-~01, consideration of comprehensive plan' and zoning designations. Ron Hough presented the staff report. This proposal is for consideration of approximately 172 acres in the Sheridan Heights area including 233 residences. Overheads were presented covering currem county zoning, topography, the overall process of the annexation process, and proposed comprehensive plan and zomng designations (both county and city). It was noted that this area was part of the interim urban growth area as outlined in the Kitsap County plan. The current county interim zoning designation for this area is UR-6 (up to 6 dwelling units per acre). High density is not being considered for this area, only low and medium density. Two options were presented. Option A which outlined existing condomminm~ and adjacent lands with a comprehensive plan classification medium density (MDR) with a zoning of Multi-Family (MF) and all other lands would have a comprehensive plan designation of low density with a zoning of Single-Family (SF3). Option B would essentially have the same compreheusive and zoning designations but classifies a portion of property in the southeast comer as SF2 versus SF3 in the first option. The only other difference is the inclusion of two lots in a MF zone and the exclusion of two other lots in the MF zone. Three or four letters were received. One letter received from Sturdy Sturdivan was read into the record. They were in favor of the annexation, but had concerns including the refill not fitting into the value of the homes there presently causing devaluation and social problems. The slopes and water retention problems, as well as traffic problems were mentioned also. Commissioner Boyd wanted to know the names of the streets in the annexation area. Page 1 Planning Commission Meeting, March 17, 1998 Mr. Hough pointed out the streets on the overhead. Commissioner Stone inquired regarding the interim zoning placed by the count5.'. Mr. Hough stated that the current zoning was UR-6. or 6 d~velling umts per acre ma.X-Unum. Commi.~sioner Dingfield wanted to see the topographical map and the proposed zoning designations shown side by side on the overhead projector. Public Testimony It was generally asked to have the proposal restated. Options A and B were reviewed. Dick McConahay, 2938 Ponee Dr: read a letter into the record. He xvas in support of Option B. He addressed the past decision of the Vergeer property, to zone that particular property as SF2. Ruth Deem who owns 5 acres in the annexation area spoke in favor of the proposed annexation. Greg Branch, 3146 Sahali Dr, spoke in regards to development with AnnaMarie Cole. He was in favor of the medium density zoning. He was in support of either option. George LaCount, 3122 Tracyton Beach Rd, pointed out thai there was a typo in the defimtion of SF3. It was stated as 3-3 dwelling units per acre, when it should have read 3 - 8 dwelling units per acre. Jerry Vergeer, owns 12 acres in the area to be zoned SF2 in Option B. Not in favor of Option B. Cannot understand why his propert3' is being singled out for the lower density zoning. He xx,ould like his property to be brought into the city with a SF3 zoning designation. John Chitteden, 3762 Tra .cyton Beach Rd. owns 7 acres in the northern end of the anne. cation zone. In favor of either option. Reg Robinson, Narrows View Condominiums. In favor of the annexation. He would like to see the Vergeer property to have a SF3 zone designation, with all lots zoned MF in both options combined for another option. Bill Smith, objects to high density use along Sylvan Way. Rick Smith, concerned about the increase in traffic along 31st Street due to the MF zoning in that area as well as drainage problems, especially those problems which arose from the construction of the Sahali Condominiums. He is in favor of the options except for the MF zoning designation on 31st Street. Joanne Morris, lives on E 31st StreeL also feels that more traffic on 31st Street would not be a good idea. It would be too highly congested. Dick Estridge, 2720 Tracyton Beach Rd. Feels that SF2 would be more appropriate for the whole area than SF3. DeeDee Beckley, concerned with the congestion mused on E 28th and E29th due to the increase in traffic due to higher density and xvith erosion problems. Commissioner Boyd wanted to add information regarding the area and problems with flooding. Page 2 Planning Commission Meeting, March 17, 1998 Chairman Robinson inquired as to the county's interim designation of UR-6 and what will happen ff the Hearing's Board does not approve the Comprehensive Plan. Could any decision we make tonight be invalidated'? Mr. Hough stated that the interim zoning is separate from the comprehensive designation. We will not know as to the last designation for a few days, but we initiated the annexation under the inteTM zoning (which is urban) and we may be vested under this zoning. Commissioner Stone asked that E 31st be pointed out on the overhead, which Mr. Hough did. Commissioner Stone also wanted to know ff under the county's designation of UR-6 ff multi-family would be allowed as a x~riance. Mr. Hough stated that he didn't believe so. Commissioner Stone also wanted clarification as to a previous decision by. the Planning Commission and City Council to zone the property in the southeast corner to SF2. Mr. Hough indicated that a couple of years ago that particular property underwent a Pre-Annexation process in which a recommended SF3 zoning designation was changed to SF2 following public input. It is an ordinance, which can be changed. Commissioner Wolfe wanted to apologize for arriving late, and wanted to know why the Vergeer property was being treated differently. Mr. Hough indicated that property has already gone through the pre-annexation process and through public input a zoning designation of SF2 was already predetermined. Mr. Hough also wanted to point out that SF2 has undergone a change since this property was looked at 2 years ago. Currently, the SF2 desi~tmatJon does allow a maximum density of 8 dwelling umts per acre, when developed under a Planned Unit Development Process; whereas 2 years ago it was only based on minimum lot size, or 4 units per acre. Commi.~sioner Stone was confused as to why we could adopt option A when the SF2 zoning designation was already determined. Mr. Hough indicated that any of these options could be changed in any way. Commissioner Robinson wanted to know if Option A were to be adopted would it change the ordinance already adopted? Mr. Hough stated that the ordinance would have to be amended. Commissioner Robinson wanted to state that it appeared discriminatory to zone only one small portion of the area SF2. Mr. Hough commented that one person who testified that all SF3 should be SF2. Terrie O'Neill wanted to comment that in the last version of the comprehensive plan, the Sheridan Heights area was designated as a joint planning area not a rural area. Commissioner Robinson wanted to make sure that our zoning designation was proper for this area. Ms. O'Neill indicated that development in this area would be subject to SEPA. Commissioner I}ingfield wanted to comment on the Vergeer Pre-Annexation hearings and the good comments received concerning the sensim4ty of the land involved, and did not want to throw out all the time and effort involved in that process and the findings that came out of it. Page 3 Planning Commission Meeting, March 17, 1998 Motion by Commissioner Dingfield that the Bremerton Planning Commission, recommend the comprehensive plan option B and the zoning option B for application on the Sheridan Heights Area upon annexation into the City.. Seconded by Commi~nioner Boyd. Commissioner Boyd had a question as to ff we were adopting both comprehensive and zomng designations at the same time. Commissioner Dingfield indicated that the two could be split. Commissioner Boyd suggested that the SF3 zoning designation be lowered to SF2. because the rmtxanum density, allowed would be the same in both designations. Commissioner Dingfield stated that any environmental issues would be addressed at time of development. Commissioner Stone stated that he would have to vote against the motion. Due to the discriminatory. zoning classification placed on Mr. Vergeefs propem.'. He feels that it was realistic 2 years ago, but unrealistic now. Commissioner Wolfe wanted to know what the alternative would be. Commissioner Stone favors Option A. Commissioner Dingfield supports Option B due to the character of the neighborhood upon annexation into the city. Question Called: Wolfe, yes; Dinglield, yes; Stone, no; Boyd, yes; Robinson, yes. Motion passes. Mr. Hough wanted clarification as to which option passed. It was clarified that option B is the option which passed. 2. Manufactured Housing Code Amendments Mr. Ron Hough presented the staff report. This is in re~pense to placement of unauthorized structures on nnimproved lots in the city. This amendment essenhal .hr cleans up the site plan reviexv process to ensure that the site is properly prepared and the manufactured home is up to city standards before bringing the structure into the city and placing it on the site. An overhead was shown outlining the changes to the cede, including Inspection of the site and home before placement. Public Te:gimony Eugene Donovan, wanted to commend the building department for these positive changes. Had a question regarding a change of phrasing from specific language regarding one manufactured home on one lot to a more general statement of "manufactured homes are permitted". He was concerned that a misinterpretation could be made which could cause more than one manufactured home on one lot. Mr. Hough removed that language because the land use tables and other restrictions in the zoning code address the number of homes per lot It is possible to ha,,~ more than one ff density requirements are met. Page 4 Planning Commission Meeting, March 17, 1998 Commissioner Stone wanted to know the reasoning £or the rezone. Mr. Hough indicated tlmt the reasoning was so that the building could be used for other educational uses. A motion was made by Commissioner Stone that the Bremer"ton Planning Commission find that this rezone request satisfies the City's rezone criteria and that a recommendation for approval be forwarded to the City. Council. Seconded by Commissioner Boyd. Question called: Boyd, yes; Stone, yes; l)ingtielfl, yes; Wolfe, yes; Robinson, yes. Motion passes. Chairman Robinson inquired as to when this rezone proposal would be presented to the CiD' Council. Mr. Hough indicated that it is still in state review and would be presented before the City. Council in Ma3'. Commissioner Dmgfield wanted to know if this would be included in the upcoming comprehensive plan amendments. Mr. Hough indicated that there would be no comprehensive plan amendment necessary. Meeting Adjourned.
