Tommy Jones, invited everyone to come to the Martin Luther King Bridge
Builder Award Ceremony to be held next Saturday, 12:00 noon on September
12, at the Olympus Club in PSNS. The keynote speaker for the event will be
U.S. Senator Slade Gorton.
Al Colvin, announced Bridge Builder Awards would be given to Ed Sheldon,
Reverend Cleveland Williams, and the Kitsap County Regional Library. He
extended a special invitation to attend the award ceremony and luncheon to all
citizens, public officials, and others who aspire to become public officials who
support the Bridge Builder concept.
Chief Paul Du Fresne, Bremerton Police Department, reported that $1500 was
raised from the basket of beanie babies that were raffled at the Kitsap County
Fair. He presented a plaque to Mr. Gary Keys from the Detailer Shop for
donating his service in getting the D.A.R.E. car ready for the Fair; and another
plaque was presented to Audrey & Tom Walters from Teddy Bears To Go, for
suggesting this idea, and donating the basket of beanie babies.
Lauralee Hanson, Bremerton resident, stated the government should not
deprive the citizens of the right to vote on an issue so vital to their health
[fluoride], and urged the Council not to "cave-in" to the pressure from special
interests groups. She asked that this issue be placed on the November ballot.
Don Larson, President of Kitsap Diving Association, announced a series of
events would be held during Washington Water Weeks from August 29 to
October 4, 1998. For a free copy of "Washington Waterweeks '98 Activity
Guide", the public can call (800) 424-4EPA. On September 12, the Naval
Undersea Museum in Keyport will have a Waterweeks Day, with many activities
planned. On September 19, the Sinclair Inlet Cleanup and Marine Fair will take
place from 11:00 A.M. to 2:00 P.M. He appreciates Distdct #5 and their
involvement.
Paul Drnievic brought a tape recorder to re-play a quote he stated Mr.
Montgomery made at the Council Retreat. Mr. Olson called for a point of order,
stating the two gentlemen involved could listen to the tapes and settle the issue
in sidebar. Mr. Dmjevic stated that he wanted it done in public because he felt
he was being called a liar. Mrs. Arends pointed out that if it is only 45 seconds,
they should go ahead and listen to it. President Farr stated that Public
Recognition was not was not the appropriate forum for this purpose, but he would
allow it, to put an end to this situation. Mr. Montgomery clarified that the voice
on tape making the comment was not him.
Roy Mclnnis stated he served 20 years in the United States Marine Corps
defending his right to have a choice. He stated if there is an issue that causes so

much confusion, the citizens should have a choice. Secondly, he wanted to
know how much it is going to cost the City of Bremerton to fluoridate the water.
Ms. Malanca, per the Mayor, wanted it recognized that the Bremerton Pure
Water Association's lawsuit (which alleged a violation of the Open Meetings Act,
as well as an original request for a temporary injunction, which was defeated in
Kitsap Superior Court), was dismissed voluntarily by the Bremerton Pure Water
Association, with their attorney noting the determination that there was nothing
improper about what the City had done.
John Becket, Bremerton resident, has concerns about the vote fodagainst
fluoride going to the people, and Council representing the interest of the people.
He wanted to make sure the Council did nothing to interfere or delay the process.
President Fart pointed out that there is a letter to Mr. Drnjevic from Kathleen
McCluskey, Director of Administrative Services, that outlines the schedule of
events that will need to happen if the signatures are certified, which is
accomplished by the County Auditor's office, and is out of the hands of the City.
He wanted to assure the public that the City does recognize the seriousness of
this issue, and is taking steps to assist in this process any way it can.
Reverend Cleveland Williams, Ebenezer A.M.E. Church, on behalf of the
Bremerton Ministerial Association, thanked the Council and Mayor for their
support and cooperation of the Community of Faith program which painted two
homes in the City of Bremerton to improve the outward appearance, as a way of
improving the community.
Ruth Natividad, citizen opposed to fluoride, stated that if it was not on the ballot,
Council would have to face the citizens against fluoride again, and for as long as
it would take. She received a list of Fluoridation Facts from the Health
Department, published in 1993, and stated that there have been many studies
since then, that offer a different view.
Bob Jaenicke, Bremerton resident, had concerns that the Bremerton Chamber
of Commerce and Bremerton Main Street Association should support local
business rather than going out of state to get things done.
Elizabeth Buell, Bremerton resident commented that "if our water works, don't
fix it", and she hoped fluoride would not be added to the water.
Gordy Byrd questioned how Council could over ride something that the people
wanted, and gathered signatures on. Mr, Law pointed out that it would benefit
the Council to get this on the ballot now, because a special election in February
would cost the City more money.

Mr. Olson stated the citizens who gathered this number of signatures in one
week should be proud of themselves. He again clarified that Council is doing
everything in their power to keep this process going.
8A - SR-304 TRANSPORTATION IMPROVEMENT PROJECT
SUPPLEMENTAL AGREEMENT WITH STATE TO PROVIDE FUNDING FOR
RIGHT-OF-WAY ACQUISITION, #AB98-193
On May 18, 1998, the City and the State, through the Washington State
Department of Transportation entered into an agreement for the State to provide
$431,653 as matching funds towards various successful grant applications on the
SR304 Transportation Improvement Project. The Washington State Department
of Transportation through a 1998 legislative funding allocation will provide an
additional $1.7 million towards right-of-way acquisition on the project. The total
State funding available for the project is $2,131,653. The attached agreement
provides for disbursement of those funds to the City of Bremerton for use on the
project. Staff recommends that the City Council authorize execution of the
attached agreement.
Mayor Horton provided an update on the project thus far, and discussed what is
left to go on the project, such as the Gateway Phase, which will occur in the
summer of 1999, and will enhance access into PSNS, the ferry terminal and
Sinclair Landing. She provided an update on the funding, and stated there is
additional funding still available outside of the City that has not yet been
received. Although $23 million has been put together so far, there is still a
shortfall of about $14 million, so funding efforts will continue.
She then introduced several State Legislatures in attendance at the meeting
tonight, not only thanking them for their participation so far, but also asking them
for a continuance of their significant role in getting the remainder of the project
funded.
District 23 Representatives Paul Zellinsk¥, and Karen Schmidt, District 26
Representative Tom Huff, District 35 Representative Bill Eickmeyer, and
Senator Betti Sheldon each addressed the Coundl, thanking them for the
invitation to be at the meeting tonight, and offering words of support for
Bremerton and the completion of this project. President Farr thanked all of the
legislatures for honoring the Council with their presence, and all the hard work
they are doing for this community.
#3160 MlSiClU(ArendslMontgomery) Motion to authorize and direct the Mayor to
execute the attached agreement with the Washington State Department of

8B - SR304 TRANSPORTATION IMPROVEMENT PROJECT WASHINGTON
STATE DEPARTMENT OF TRANSPORTATION AND CITY MEMORANDUM
OF AGREEMENT REGARDING TRANSFER OF PERSONAL PROPERTY,
#AB98-194
The City and the State through the Washington State Department of
Transportation are acquiring properties in the SR304 corridor as right-of-way
necessary for construction of the SR304 Transportation Improvement Project.
Most of the properties are being acquired in the States name, as the State will be
the ultimate owner of the right-of-way. In order to allow the City to remove and
dispose of existing improvements on the property (i.e. commercial or residential
structures, fixtures, landscaping, etc.) the salvage rights to the improvements
must be conveyed to the City. The attached Memorandum of Agreement
provides authorization to transfer salvage rights of the improvements to the City,
with a Bill of Sale (Personal Property Including Improvements) executed for each
property upon acquisition. Staff recommends approval of the Memorandum of
Agreement.
TAPE #1566
Lynn Price, SR304 Project Manager, reiterated that the Memorandum of
Agreement from the State Department of Transportation would provide for the
transfer of salvage rights to the City, which will allow the City to proceed with the
demolition and disposal of items within the SR304 corridor. Out of 85 parcels, 49
parcels are acquired, and this will allow the start of asbestos removal.
President Farr asked if members of the public could obtain some of the
vegetation and landscaping from the demolished property. Mr. Price stated he
has had a number of requests for various items, but no, the City is not allowed to
make any of the property available to specific individuals, it would have to be sold
through a public auction process to give everyone a fair chance. However, an
auction is not being considered at this time. The current plan is for the majority
of the property to be demolished with City forces. Other properties my go out for
bid. Interested persons can contact the contractor.
#0168 MISIClU(ArendslMontgomery) Motion to authorize and direct the Mayor to
execute the attached Memorandum of Agreement with the State to transfer
salvage rights of the improvement acquired in the States name on the SR304
Transportation Improvement Project to the City.
8C - INTERLOCAL AGREEMENT/STREET LIGHT ACC~UISITION GROUP,
#AB98-195
Section 16 of the Franchise Agreement between the City and Puget Sound
Energy (PSE) allows the City to purchase from PSE the street lights within the
City but not currently owned by the City at fair market value. A preliminary study

was completed which indicated ownership by the City may be cost effective. The
Interlocal Agreement will allow the City to participate with other cities to complete
the Phase 2 study for the possible acquisition of streetlights.
Gene Sampley, Public Works Director, stated this was the second phase of an
ongoing process, which evaluates the feasibility and practicality of the City
acquiring its streetlights. The agreement will cooperate with other cities in the
area that are similarly interested. The City of Bellingham will be the administrator
of the contract for the consultant performing this work.
Elizabeth Buell asked what kind of streetlights he was talking about. Mr.
Sampley clarified that these are streetlights that are "luminares" which provide
nighttime visibility as opposed to traffic lights, which the City already owns.
Mr. Law wanted to assure the public that Council was not going to do this without
having a presentation from Puget Sound Energy on their perspective with the
new regulations coming. There are a lot of questions that still need to be
answered. Mr. Sampley stated this item will definitely come back before
Council, and no decisions will be made without appropriate presentations.
Mr. McConnell .questioned if part of this phase was to determine fair-market-
value? Mr. Sampley yes, and phase 2 refers to the study that will be
accomplished. Mr. Reed asked how many systems there are? Mr. Sampley
stated there is just one, and the market value is actually $6-$8, rather than $10
as stated in the packet.
#0385 MlSlClU(MontgomerylOIson) Motion to approve City of Bremerton to
participate in a study for possible acquisition of streetlights from Puget Sound
Energy.
9A - RESOLUTION #2667~ 1999-2004 SlX YEAR TRANSPORTATION PLAN~
#AB98-197
The Six-Year Transportation Improvement Plan is prepared pursuant to RCW
35.77.010 and RCW 36.81.121. The Plan is updated annually and filed with the
Secretary of Transportation, Department of Transportation, Local Programs
Office. It is intended as a planning tool for the local, State, and Federal
transportation funding entities. The attached plan has been prepared for City
Council approval by Resolution, and will be submitted to Washington State
Department of Transportation.
Jeff Shea, Senior Engineer, reported there are only two changes this year from
last year. The first change is the Kitsap Way Street Improvements project was
dropped because it will be complete by this year; and the Arsenal Way/Patton

Avenue Improvement project has been added to improve safety and capacity in
the corridor from Lafayette Avenue to Loxie Eagans Boulevard.
Mr. Mont_qomerv asked if sidewalks would be installed on one side of the street
between Loxie Eagans and Patton. Mr. Shea stated the plans have not been
drawn, so he could not answer the question at this time.
#0470 MlSlClU(MontgomerylOIson) Motion to pass Resolution No. 2667,
approving the City's 1999 - 2004 Six-Year Transportation Improvement Program,
and direct the Mayor to forward the resolution and plan to the Department of

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The Bremerton-Kitsap County Health District completed a sanitary survey of on-site septic systems in the Gorst
area in May 1996. Based on the survey, the State Department of Health declared the Gorst area a severe public
health hazard requiring the area to be served by sanitary sewers. A 1997 study for sewering Gorst and South
Kitsap Industrial Properties determined it to be cost-effective to provide sewer treatment at the Bremerton
Wastewater Treatment Plant. The maximum monthly flows are projected to be less than 1% of the plant's design
capacity. Kitsap County will provide all customer service, billing and collection requirements w/th treatment
8. RECOMMENDATION:
That the City Council authorize the Mayor to sign the ULID petition for sewering Gorst and provide a letter of

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION
provided as county customers under the existing Kitsap County Sewer District 1 service agreement.
An effort is currently underway to form a utility local improvement district (ULID) for construction of the Gorst
sewer system. A successful petition requires owners of 51% of the property by area within the service area sign
the petition. The City owns 2.3% of the property within the service area and would benefit from sewer service. It
is recommended that the City Council authorize the Mayor to support the establishment of the ULID for sewering
Gorst by (a) signing the petition on behalf of the City and (b) providing a letter of availability to the County under
the existing Sewer District 1 service agreement for treatment at the City's wastewater treatment plant, lh i s
recommendation is based on the county's representation that the sewer system will be
equivalent to a step system with sol ids managed by the county and effluent only delivered
to the CityIs Wastewater Treatment Plant (WWTP).
5. IMPACT ON NON-PASSAGE:
The City's property in the Gorst service area will not be sewered and loss of revenues from wastewater treatment at
the Bremerton Wastewater Treatment Plant.
6. IMPACT ON STAFFING, BUDGETS, FACILITIES, EQUIPMENT OR OTHER RESOURCES:
No impact on staffing, facilities, equipment and other resources. Wastewater treatment capacity is currently

UPDATE FOR BREMERTON CITY COUNCIL
GORST LID FORMATION FOR
THE PURPOSE OF FINANCING
SANITARY SEWERS
Th/s item is on the agenda for the study session on Wednesday, September 9,1998
Background: The Health District conducted a sanitary survey of the Gorst area completed in
May 1996. The survey revealed (confirmed) a large number of failed on-site
septic Septic systems. The State health Department declared the Gorst area a
severe public health hazard
The Health District, County, City of Bremerton, City of Port Orchard, The Port of
Bremerton, Northwest Corporate Campus, the citizens of Gorst and the major
Industrial land owners conducted a Study of the alternative ways to sewer Gorst
and the South Industrial Area. A recommendation was made and two further
alternatives were developed. One suggested by the City of Bremerton and the
other by the City of Port Orchard. The Bremerton alternative was the least
cost.
The County and the Health District conducted a number of public meetings with
the people in the Gorst area and as a consequence reduced the proposed LID area
to exclude the uplands of Gorst and modified the proposed sewer collection
to a pressure system to keep costs down and to minimize any excess flows that
enter a standard gravity collection system. The projected maximum monthly flows
from the Gorst project will be 0.9% of the design flow of the Bremerton Plant.
The sewering of Gorst will fit with either of the alternatives that were last
developed by the Gorst Parmers.
Gene Lobe, a business owner in Gorst has been circulating the required petition to
form an LID. It is required that 51% of the property in the proposed LID area sign
the petition. Gene currently has 48 % of the property signed up but has had
difficulty getting the last 3%. Therefor we are asking the City to sign the petition
for the property that the City owns at Elanden Gardens which represents 2.3% of
total property in the proposed LID area.
The new connections will pay the Bremerton's cOnnection fee which we propose
to include in the LID financing. That is, Bremerton would get the money up fi-ont
for the capital costs to provide treatment for Gorst. The County would operate and
maintain the collection system and billing would be just as in Navy Yard City.
Bremerton would collect the usual monthly billing based on water usage and the
required 50% surcharge for customers outside the City limits. The impact on the
08/25/98 TUE 11:18 FAX K C PUBLIC WORKS ~003
plant is minimal and the City benefits financially and helps solve a long standing
community health problem. Additionally sewering the City's property will
increase it's value to the City. When the LID is formed the City will be asses,.~ed
Its' fair share to be paid over the term of the bond
Action:
For all these reasons we respectfully request that the Council direct the Mayor
to sign the petition to the County Commissioners in favor of forming an LIX)
for sewering the Gorst area.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION'
Beginning in January of 1998, the City of Bremerton removed furniture, clothing, auto parts,
appliances, garbage and debris from the property located at 1903 W. Kitsap Lake Lane after the owner,
Patricia Hoxer and the tenants failed to do so as ordered by the Building Official. Work was stopped
before completion due to the weather and inability to use heavy equipment for removal of these
materials. In June, the house was ordered vacated, more material was removed, and the house was
boarded against entry. Council must now decide if the fees incurred for this action are just, and how
they should be collected.
RECOMMENDATION:
It is recommended that Council, by Resolution # ~,~, order that the fees incurred for the
abatement of garbage, debris, auto parts, furniture and clothing and for securing the house located at
1903 W. Kitsap Lake Lane be collected as reasonable abatement costs and become a lien against the
property.
