4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
After more than a year of conducting meetings, undertaking research and evaluating public
input, the citizen-based Y2R (Yes to Recreation!) Committee, in conjunction with the Parks
and Recreation Commission and City staff, has developed a comprehensive proposal to
address needs for community recreation facilities. The Y2R Committee is recommending that
the City: construct a new Recreation Center in downtown Bremerton; upgrade Senior
recreation facilities in East Bremerton; and complete the long-awaited development of multi-
purpose athletic fields at Pendergast Regional Park. To fund these projects, it will be
necessary to hold a Special Election to seek approval from the City's voters to issue
$16,5 00,000 in general obligation bonds. The proposed Ordinance (attached) would establish
March 14, 2000 as the date of the Special Election.

Failure to approve the proposed Ordinance would effectively stop progress on this project
and would derail the efforts put forth by the Y2R Committee, the Parks and Recreation
Commission and staff over the past twelve months.
IMPACT ON STAFFING, BUDGETS, FACILITIES~ EQUIPMENT OR OTHER
RESOURCES:
Approval of the proposed Ordinance would commit thc City to pay for thc expense of a
Special Election. If thc bond measure is approved by voters, the election costs would be
paid out of bond proceeds. If the bond measure fails at thc polls, election costs would be
paid fi-om existing City funds.

CITY OF BREMERTON, WASHINGTON
ORDINANCE NO. 4/~ ~
AN ORDINANCE of the City of Bremerton, Washington, relating to City parks
and recreational facilities; providing for the incurring of indebtedness, issuing of bonds

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
Kitsap Transit and Washington State Ferries have petitioned the City to vacate portions of From (First) Street,
Washington Avenue and the alley south of Front (First) Street and east of Washington Avenue for construction of
the Bremerton Transportation Center. On November 17, 1999, the City. Council passed Resolution No. 2728
setting a heating date of December 22, 1999 for this proposed vacation. In accordance with BMC Chapter 11.20,
all postings, mailings and notifications of this heating have been made. An Engineering Report has been prepared
(attached) that addresses the background, shoreline access, compensation and other issues relevant to the street
vacation. The Engineering Report further addresses the hearing considerations that the City Council needs to
determine at the conclusion of the vacation in accordance with BMC 11.20.120. A staff recommendation is
provided on each of these issues. The action before the City Council is to approve, disapprove or modify, the
proposed vacation. Staff recommends approval of the vacation as requested.

2. CI~EARANCE COMMENTS:
5. IMPACT ON NON-PASSAGE:
The portions of Washington Avenue, Front (First) Street and the alley in the Bremerton Transportation Center area
will remain as City rights-of-way. Retaining this right-of-way will not allow the Bremerton Transportation Center
project to market its retail space in an effective manner due to a cloud that will exist on the Title. Non-passage of
the vacation ordinance may also conflict with the Master Development A~eement for the Sinclair Landing Project
to which the City is signatory.
6. IMPACT ON STAFFING, BUDGETS, FACILITIES, EQUIPMENT OR OTHER RESOURCES:
The compensation for the right-of-way vacation ($338,757.00) is a City contribution to the project that can be used
by Kitsap Transit as a match for other project funding.

BACKGROUND
These streets are being vacated to accommodate construction of the Bremerton
Transportation Center (BTC), a joint Kitsap Transit and Washington State Ferries
project. Kitsap Transit is the lead agency on this project and this application. All right-
of-way being vacated will be used for construction and operation of the BTC. The
master development agreement for the Sinclair Landing Project to which the City is
signatory identifies these properties for vacation as part of the BTC development.

HEARING CONSIDERATIONS
BMC 11.20.120 sets forth issues that the City Council needs to determine at the
conclusion of the Vacation Hearing. These issues and the staff position are:
1. Whether the street, alley or portion thereof is no longer required for public use
and vacation of the described portion will better serve the public good.
Yes, vacation of the proposed streets will provide for construction of the
Bremerton Transportation Center. The construction and operation of the BTC
will better serve the public good than retention of the existing rights-of-way.
Whether the vacation is consistent with the City Comprehensive Plan.
Yes, construction of the BTC is consistent with the Downtown Waterfront Urban
Renewal Plan, which is an implementation of the City Comprehensive Plan.
Vacation of these rights-of-way is necessary for construction of the BTC.
Whether continued use of the proposed vacation as a public way is not of such
public benefit as to not justify the costs of maintenance.
This question is not applicable, the rights-of-way to be vacated will continue in a
public use as part of the BTC. The cost of maintenance will shift from the City to
Kitsap Transit and Washington State Ferries.
Whether substitution of a new and different thoroughfare would be more useful to
the public.
No, the ultimate use of this area is as a transportation center.
o
Whether conditions may so change in the future as to provide a greater pubfic
use or need than presently exists.
No, no anticipated future use will provide a greater public use or need beyond the
proposed use as a transportation center.
Whether objections to the proposed vacation are made by owners of private
property abutting the same.
No objections have been received from any abutting property owners. The
petitioners (Kitsap Transit and Washington State Ferries) and the City are the
abutting property owners.
SHORELINE ACCESS
The portion of First Street east of Washington Avenue abuts a body of water, Sinclair
Inlet. Chapter 35.79.035 RCW identifies specific actions that need to take place prior to
vacating those properties that abut a body of water. The Shoreline Permit for this
project was approved in part due to the increase in public access to Sinclair Inlet
provided by the project. The proposed vacation is consistent with the approved
Shoreline Permit, as revised.

COMPENSATION
The property compensation has been determined to be a Class II property; rights-off
way in which the interest of the City is limited to a public easement or fight of use for
particular purposes that have substantial public improvements in any portion of the
fight-of-way. Valuation of this property has been determined at $14.00 per square foot.
The total area of the vacated rights-of-way is 48,320 square feet, for a total value of
$676,480.00. Class II property is compensated at 50% of the value, for an amount of
$338,240.00. In accordance with the City practice regarding support of this project, fees
and compensation for the vacation will not be collected from Kitsap Transit; rather the
compensation is recorded as a City contribution to the BTC project. This City
contribution is available for use as matching funds for the grants and loans that Kitsap
Transit has secured for the project. The total City contribution in the form of this rights-
of-way vacation is $338,757.00.
UTILITIES
A utility easement will be reserved on the rights-of-way for utility company usage as
follows:
1. City of Bremerton (water, sewer and storm drainage) on C16 and C 18 (east and
west portions).
2. Puget Sound Energy (electrical power) on C16 and C18 (west).
3. AT&T Cable Services (cable) on C16 and C18 (west).
Cascade Gas, US West and Falcon Cable have stated that no easements are
necessary.
Kitsap Transit is preparing detailed easements for utilities to remain in the vacated
rights-of-way, which will be recorded and the utility easements extinguished in the
futu re.
SUFFICIENCY OF SIGNATURES
The petition for the vacation was made by more than two-thirds of the owners abutting
the property to be vacated on a front footage basis.
STAFF RECOMMENDATION
