PUBLIC RECOGNITION Susan Brown thanked Richard Hayes, Executive Director of Kitsap Transit for his immediate and personal response to a recent correspondence provided by her sister. Loren Johnson invited the members of the Council to a performance of the Nutcracker presented by the Dance Arts Theater to be held at the Bremerton High School Performing Arts Center on Saturday, November 27, 1999 at 7:30 P.M. and Sunday, November 28, 1999 at 2:30 P.M. Additionally, he raised concern over the difficulty there has been in marketing 150 acres for sale out of approximately 300 acres of privately owned property located at the west end of Werner which is zoned "Industrial". He believes it has been for sale for so long due to the lack of water service, and asked if the City could initiate action to approve a new water line. The fo/lowing citizens offered comments and documentation in support of the Bremerton Animal Control Department, and encouraged the City not to contract out those services: Mary_ Griffith Russell; Chris Nordleaf, of Peninsula Dog Fanciers; Sandra Kay Fletcher, of the Fletcher Glen Raptor Center (wildlife rehabilitation); Melody Pugh, Pet-Detective.corn (information & help to find lost pets); and Karen Hoover. 9A - NAMING PARK PROPERTY (LOCATED AT LEBO BOULEVARD & REID STREET, CURRENTLY KNOW AS LENT LANE.) TO "LENT LANDING", #AB99-250 Cris Gears, Parks & Recreation Director, reported that Dr. Gordon Cromwell has been working with the Parks & Recreation Department on behalf of the East Bremerton Rotary Club, to develop the park property commonly known as Lent Lane. This property is located at Reid Street and Lebo Blvd. southeast of Lions Field. During his research, Dr. Cromwell discovered that the property was used as a ferry-landing site to shuttle Navy personnel between West Bremerton and East Bremerton during World War 1~[. He also discovered that the driveway that leads from Lebo Blvd. to the beach was named Lent Lane to honor the Lent family for their contributions to the community. That driveway has since been abandoned. The East Bremerton Rotary Club is requesting that the park be officially named "Lent Landing" to continue honoring the Lent family, while further recognizing the City of Bremerton's history. The East Bremerton Rotary Club submitted their request to the Parks & Recreation Commission on Tuesday, October 26, 1999. After due deliberation and in accordance with the City policy for naming parks, the Parks & Recreation Commission voted unanimously to support the request and to submit it to the City Council. A sketch of the proposed sign, which would be paid for by the Rotary Club, was also presented. There were no questions or comments from the public. Mr. Reed suggested that the Lent family be contacted for their comments. Mr. Gears responded that unsuccessful attempts were made, but if he does hear any negative comments from members of the Lent family, he will bring the matter back to Council. Mr. Olsen thanked him for the District #1 Park. 3 TAPE #1665 City Council Reg. Mtg. This contract provides for the decommissioning of 4 underground storage tanks, 2 hydraulic hoists, and the removal of up to approximately 1,000 cubic yards of petroleum-contaminated soil from 4 parcels of public right-of-way. Eleven bids for this project were received, with Stemen Environmental Inc. the lowest responsive bidder with a bid of $68,277.98. The Engineer's estimate for this project was $107,711. There were no questions or comments from the public. Mr. McConnell asked if there were other funding sources, and if yes, when would the funds be received. Mr. Price stated there is currently sufficient funds, and clarified that indicated amounts are from Federal Highway Administration funds and Transportation Improvement Board funds, in addition to the arterial street funds already received by the City. Mr. Olsen left the meeting at approximately 6:15 P.M. #1260 M/S/C/U (Montgomery/Reed) Motion to approve award of the bid of $68,277.98 with Stemen Environmental Inc. for the SR 304 Transportation Improvement Project Underground Storage Tank Decommissioning/ Petroleum- Contaminated Soil Removal contract and authorize the Mayor to execute the same. 9C - JAIL CONTRACT WITH KITSAP COUNTY. #AB99-252 Glenna Malanca, City Attorney, stated that the County Jail Services Contract has been modified and revised to reflect necessary changes to the City's needs. There were no comments from the public. Mr. McConnell was concerned that the City still had to pay $57.00 for persons delivered to the County jail, even if they post bail, and are released after only a few hours. Ms. Malanca responded that was true, and clarified this contract is valid until the end of December, and that a new contract may be negotiated with the new jail. The purpose of this contract was to maintain the "status quo", to bring the City of Bremerton equal with what other jurisdictions are paying. President Shepherd stated that Council might want to bring up a discussion at a later date to determine the possibility of setting bail locally, thus eliminating the cost of the trip to the County. Mr. Montgomery pointed out that part of the required process is for a defendant to be "booked" before they can post bail. #1350 M/S/C/U (Montgomery/McConnell) Motion to approve one (1) contract for jail services with Kitsap County ending December 31, 2000. Mr. Olsen returned to the meeting at approximately 6:20 P.M. 9D - LEGAL SERVICES AGREEMENT WITH KITSAP COUNTY, #AB99-253 Glenna Malanca, City Attorney described legal services as provided by the Kitsap County TAPE #1665 City Council Reg. Mtg. Minutes November 23, 1999 Page 4 of 4 Prosecutor's office since 1995. Their expertise on prosecution and matter pertaining to criminal behavior has made their service to the City a benefit. The City's Legal Department has been able to focus on civil issues. City and County personnel have prepared an agreement to reflect the scope of work the City would like to have the County perform. There were no comments from the public. Mr. McConnell was concerned with the wording contained in SECTION 5, under "PAYMENT", where it states that $115,053.08 is compensation for services rendered "...for the remainder of calendar year 1999", because it implies this contract amount is only for the remaining two months of the year. Ms. Malanca clarified that was not the intent, and that the $115,053.08 is the yearly, base amount of the contract, which has not been changed since 1995. Effective January 1, 2000, a yearly CPI adjustment would be added. Russ Hauge, Kitsap County Prosecutor, further added that the relationship between his office and the City is "so good" that they have been working without a contract since June, and that the payment terms have always been monthly. Mr. She_Dherd noted that he has personally seen the Prosecutor's staff work weekend hours to keep up with their caseloads, and that his staff should be commended for their dedication. Mr. Hauge stated that from the standpoint of his office, and law enforcement in general, this has been an enormously successful "experiment", so much so that the City of Poulsbo has now decided to enter into a similar arrangement next year. He stated it makes sense for cities to engage with his office at the misdemeanor lever because they are already handling cases at the felony level. #1520 M/S/C/U (Montgomery/Olsen) Motion to approve one (1) agreement for legal services with Kitsap County Prosecutor ending June 15, 2004. She again encouraged businesses to decorate their storefront windows, and to call her office at 478- 5266 to register their participation, and be eligible for prizes. INFORMATION ITEM Richard Hayes, Executive Director; and Wendy Clark of Kitsap Transit, provided a presentation on a "Bremerton Transportation Center (BTC) Project Update-Post 1-69~'. A memo dated November 29, 1999 from the Agency Oversight Committee (AOC) to the Policy Group, regarding the "Project Status and Recommended Direction" was provided to the Council, which summarized the actions of the AOC and the Project Team to respond to changing circumstances. Several recommendations for proceeding with the completion of this project were also included. LEGISLATIVE REPORT - There was no report tonight. PUBLIC RECOGNITION Larry Dickerson commented that instead of hearing how Kitsap Transit was going to complete the Transportation Center, he would like to have heard a solution to the cuts in transit services. He also asked for an update on the City's "SOAP" ordinance, to assist the Police in cleaning up prostitution. Officer Wendy Clark, Crime Prevention Officer, announced the Bremerton Police Department would begin a "Landlord Training" program to educate property managers on screening tenants, etc., on December 18 & 20, from 12:00 to 4:00 P.M. The location will be announced soon. She provided copies of "Rental Property Incident Cards" to assist officers in reporting problems at rental units. Carol Atkinson announced that Santa Claus will be "coming to town" this Friday at 6:00 P.M. to light the City's Christmas tree, and that a number of related events will also be scheduled that evening. Sandra Kay Fletcher provided additional information showing the link between cruelty to animals and child abuse. She also voiced her support for the City of Bremerton's Animal Control Department, along with Patti Hutchin(js, Linda Col(jan of PAWS, and Karen Hoover. 10A - ORDINANCE NO. 4676 (SECOND READING), ESTABLISHING REGULATORY AN[') REVENUE LICENSING OF RESIDENTIAL RENTAL BUSINESSES; AND CREATING A NEW CHAPTER IN TITLE 5 OF THE BREMERTON MUNICIPAL CODE, #AB99-241 The First Reading of this item was presented at the City Council meeting on November 17, 1999. The ordinance was read in its entirety as requested by a citizen. The following members of the public voiced their opposition to this proposed ordinance: Elizabeth Buell, Mike Gustavson, Ruth Natividad, Gerald Jenkins, and Jim Adrian (who provided a handout of information, including portions of the Residential Landlord-Tenant Act). TAPE #1667 Mr. Law reiterated that he would not support the ordinances proposed this evening because to approve any tax increase or fees after the voters passed 1-695 would be saying he didn't listen to the voters who said they didn't want any increases. TAPES #1666 & #1667 City Council Reg. Mtg. Minutes December 1, 1999 Page 3 of 5 Mr. McConnell stated that this was a normal time of year for Council to review its budget, and consider potential tax increases, and that he believed 1-695 had nothing to do with this proposed ordinance. He further added that this issue was introduced several years ago. President She.oherd stated that if voters wanted "no taxes", they would have to amend the Constitution, not merely approve an Initiative, so he questions what the voters really wanted. He stated his constituents expect him to fulfill his responsibilities, which included making these types of decisions. Mr. Olsen stated again that the City should place this item on the ballot for the citizens to decide. #0235 M/S/C (Montgomery/Overson) Motion to pass Ordinance No. 4676 on second reading, with a $25 fee, per residential unit, per year, effective December 31, 1999. There were no questions or comments by the public. Mr. McConnell reiterated his previous comments also applied to this ordinance. Mr. Olsen asked the Council members to consider the fact that commercial parking lot owners already pay B&O Tax, as well as a Business License Fee. President Shepherd clarified that because this tax would be based on the "gross" amount, the percentage was lowered from 10% to 6%, and also stated that he is in favor of further discussion on possibly phasing out the B&© Tax. Mr. Olsen and Mr. Reed each agreed. #0340 M/S/C (Montgomery/Arends) Motion to pass Ordinance No. 4679 on second reading. There were no questions or comments by the public. Mr. McConnell stated that he could not support this ordinance without knowing how much of the fines currently being assessed is actually collected. He also wanted to know what happens to an individual that does not pay. Ms. Malanca stated she did not have the actual percentage of fines that are paid, but provided that the purpose of the amount of a fine is not only to generate revenue, but was also used to deter the conduct. TAPES #1666 & #1667 City Council Reg. Mtg. Minutes December 1, 1999 Page 4 of 5 Mr. Montgomery stated that fines should not be based on whether there was an ability or non-ability to pay the fine, because everyone would simply claim they could not pay. Mr. Reed felt that higher fines could act as a deterrent. #0530 M/SIC (Arends/Montgomery) Motion to pass Ordinance No. 4680 on second reading. LYNN HORTON, Mayor ATTEST: KATHLEEN McCLUSKY, City Clerk PROGRAM FOR ELIMINATION OF IMPROPER PRIVATE STORMWATER INFLOW Page 6 SUMMARY ORDINANCE REGARDING PROGRAM FOR ELIMINATION OF STORMWATER INFLOW TO THE WASTEWATER SYSTEM Stormwater inflows to the wastewater system contribute to combined sewer overflow (CSO) events, sanitary sewer surcharging and increased wastewater storage, conveyance and treatment costs. A stormwater inflow to the wastewater system typically takes the form of roof drains, parking lot drains, foundation drains, curtain drains and driveway drains. These inflows are called inappropriate stormwater inflows. Removal of these inappropriate stormwater inflows is a critical element in meeting the City's goals and schedule for reduction of CSO events. Furthermore, removal of inappropriate stormwater inflows at the property is considered very cost-effective compared to City construction of public works projects that would otherwise convey, store and treat the stormwater inflow in the wastewater system. To address this, City staff has prepared an ordinance that establishes' a program for elimination of inappropriate stormwater inflow, to the greatest extent reasonably possible, from the wastewater system. The key elements of that ordinance are: · Definition of Inappropriate Stormwater Inflow: An inappropriate stormwater inflow is defined as a stormwater connection or inflow to the wastewater system prohibited by the Bremerton Municipal Code. Examples of this include, but are not limited to, roof drains, parking lot drains, foundation drains, curtain drains and driveway drains. · Disconnection is required by 2005. The ordinance requires that all inappropriate stormwater inflows to the wastewater system be disconnected by January 1, 2005, unless otherwise authorized by the Director of Public Works and Utilities (Director). This authorization is envisioned where there is no practicable alternative for elimination of the inappropriate stormwater inflow. An example of this may be a driveway drain that is too Iow to be connected to the storm drainage system rather than the wastewater system, or an area where there is no storm drainage system available to which a connection can be made. · Director's authority to order early disconnection. The Director will have the authority to order early disconnection of inappropriate stormwater inflow prior to January 1, 2005 in areas where the City is pursuing CSO reduction plans and disconnection of the inappropriate stormwater inflows support cost-effective implementation of that plan. · Establishment of target areas. Target areas will be identified within the wastewater service area that have the highest priority for reduction of inappropriate stormwater inflows. It is envisioned that these target areas will be coincident with the CSO reduction plan project areas. Specific target areas may be established to eliminate sanitary surcharge problems as they are identified. Summary of the Program for Elimination of Inappropriate Stormwater Inflow to the Wastewater System October 14, 1999 Page 1 ~1 Notice. All customers will be notified of the Program through a notice in the utility bills. Additionally, owners of property identified as having inappropriate storrnwater inflows will be notified individually in writing no less than ninety (90) days prior to the date separation is to occur. Residential Disconnection Assistance Program. The ordinance will establish a program to assist residential property owners (owners of single family or duplex residences) in the elimination of inappropriate stormwater inflows to the wastewater system. The program may include the following elements: , Technical assistance to property owners. ,. . Provision of supplies for incorporation of work upon residential property. · Work in the right-of-way that supports the residential property improvements. · Funding of residential property improvements through grants and loans. The City Council will periodically establish funding for the program and set limits and terms of loans or grants. The ordinance sets forth a process for implementation of the program that includes the following elements: · Establishment of a scope of work. · Prioritization in target areas. · Application and agreement. · Reimbursement criteria for work on the single and duplex residential property by contractor or owner. The ordinance establishes a new rate for inappropriate stormwater inflow to the wastewater system. The rate has the following elements: · It is based on the stormwater impervious surface units (ISU) for that property. · It is a progressive rate, increasing as a fraction of the stormwater ISU for each property. The progression starts at 25% of the stormwater fee in effect for a property in January 2002 ($1.00 per residential household at the 1999 rate), increasing 25% a year to 100% of the stormwater fee in effect on January 1, 2005. · The inappropriate stormwater inflow fee is only for those properties that have inappropriate stormwater inflow to the wastewater system. It is not a citywide fee. It is intended to be a rate to account for the cost of conveyance, storage and treatment of the stormwater through the City wastewater system. · Funds collected through this rate schedule are intended to be used to fund the Residential Disconnection Assistance Program until 2005, then go to the wastewater fund for conveyance, storage, and treatment. Summary of the Program for Elimination of Inappropriate Stormwater Inflow to the Wastewater System October 14, 1999 Page 2 5 ~- · The ordinance allows the City to enter onto private property and abate, at the expense of the owner, inappropriate stormwater inflows that exist subsequent to the disconnection timeframe specified. · The Right-of-Way Use Ordinance is modified to allow a Iow cost permit for homeowners performing stormwater disconnection work in the sidewalk and curb area. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION: City staff presented to the City Council a new ordinance on stormwater inflow to the wastewater system. This compamon ordinance establishes a fee structure for those properties that have an inappropriate stormwater connection to the wastewater system. The fees are set up to provide funds for two things: 1. The Residential Disconnection Assistance Program. 2. The cost associated with conveyance, storage and treatment of storm~vater inflow as part of the wastewater system. The fee is a flat rate based upon the impervious surface units (ISUs) for a property, as identified in the stormwater fee. It is a progressive rate, starting with 25% of the then current stormxvater ISU fee ($1.00 per month, per household at the 1999 rate) on January 1, 2002, increasing to 100% of the then current stormwater ISU fee (S4.00 per month, per household at the 1999 rate) in 2005. The fee will be applied only to those properties that have inappropriate stormwater inflow to the wastewater system. This fee will not be applied ciLvwide.
