Dear Donnie:
The City has been working with the Shipyard to improve the Burwell/State Street intersection for
pedestrian traffic.
We are making some changes to alert drivers to the presence of pedestrians and the Shipyard will
be using crossing guards at peak time frames.
State funding for a traffic signal is unlikely and the City has no funds available. We are urging
the Shipyard Commander to see if Congressman Dicks can of assistance.
I am aware of your concern and we are interfacing with Captain Bryant. I believe the most
productive process would be for your organization to work through the Shipyard Commander in
order to provide input. This would prevent mixed signals and misunderstandings.
We will continue to seek ways to improve the situation.

Re: Burwell Street (SR304) and State Avenue Intersection
Dear Captain Bryant
I want to take this opportunity to reiterate the City's position regarding the pedestrians from the
Shipyard and Naval Base crossing Burwell Street at State Avenue. We discussed this at our
meeting of August 18, 1999. Our staffs have had further conversations since then and I am in
receipt of your letter dated November 1, 1999 (copy attached).
As you are aware, the majodty of pedestrians crossing at this intersection, and particularly at
peak crossing times, are workers and military personnel from the Shipyard and Naval Base. We
also recognize that State Kvenue is a City street and that Burwell Street is a State highway on
the National Highway System and a Federal National Defense System highway. With the
recent modifications to Burwell Street, in particular modifying the lane configuration from a two
lane to a three lane arrangement, the pedestrians using the intersection have more difficulty
crossing the street. Although there have been'no reportable pedestrian accidents at this
location since 1987, we have received more complaints on that intersection subsequent to the
Burwell Street construction. Additionally, as you are aware, a bicyclist riding across the street in
the crosswalk (not walkinq in the crosswalk) was struck by a car approximately one month ago.
We have discussed that a traffic signal may be the most effective method of assuring pedestrian
safety at this location. A traffic signal can be expected to cost between $125,000 and $150,000.
At our meeting of August 18, 1999, we shared with you our thoughts that the Shipyard and
Naval Base have a share of the responsibility for addressing this problem, as it is Shipyard and
military personnel who predominantly use the intersection by virtue of the location of the State
Avenue gate. We understand your position that generally Shipyard funds can not be used
beyond the Shipyard boundary. We also discussed opportunities available to access State
funding for this work. A direct appropriation from the State Legislature may be possible but is
unlikely to be successful, particularly in light of 1-695 passing. The Legislature and the
Washington State Department of Transportation refer us to traffic safety and transportation

grant funding programs. Cdteda for these problems are quite specific, and placement of a traffic
signal at this location will not score well for funding because of the Iow-accident history at this
location. The City does not have sufficient funds to do this work.
The City is not asking that Shipyard funds be expended to address this problem. We are
requesting your assistance in obtaining federal funds for safety improvements to this
intersection as Shipyard and Military personnel are the pdmary users of this intersection and
because of your concern with its safe function. You are in the best position to lead this effort
through your ongoing work with members of Congress to obtain a direct appropriation in a
Department of Defense Budget. The City will continue to lead the effort with the ~traditional"
state and federal transportation funding sources.
To keep you up to date on what the City is doing to enhance pedestrian safety at this
intersection, the following activities have been performed or am being investigated:
· Rumble strips have been placed on Burwell Street ahead of the 'Pedestrian Crossing"
signage to call the driver's attention to the signage and the crossing. A second set of
rumble strips may be placed closer to the intersection if further evaluation indicates it will
improve pedestrian safety.
· The pedestrian crossing signs have been changed from black on yellow to black on the new
fluorescent lime green background that is currently available. The sign size was increased
and the positioning may be adjusted to assure visibility.
· Traffic enforcement has been increased on Burwell Street. Over fifty citations have been
issued in less than a week utilizing approximately three hours of directed traffic enforcement
daily.
· The City is evaluafing~ptions and costs for installing overhead "Crosswalk" signage and/or
flashers (perhaps pedestrian activated flashers) at this location. If the City has funds it will
install a lighted or flashing crosswalk marking. If sufficient funds are not available for this
improvement, we may request your assistance in providing funding. This may be viewed as
an incremental or short-term improvement until funding for a traffic signal can be obtained,
depending on its effectiveness.
· City staff are discussing borrowing the Shipyard's "Radar Speed Trailed for use on Burwell
Street. This trailer will notify vehicles of their actual speed and the speed limit, educating
them to their responsibility on the road.
I appreciate your suggestions in your letter to improve the pedestrian safety at this location. In
response I offer the following thoughts:
· The City is willing to allow the Shipyard to provide crossing guards for its employees and
military personnel at this location. The crossing guards need to have the appropriate
training (such as a Washington State Traffic Control Flagger certification) and equipment
(vests, paddles, etc.). The City does not have funds available to contribute to this activity.
November 10, 1999
Captain G.R. Bryant
Burwell Street and State Avenue
· Installation of stop signs on Burwell Street (State Route 304) at State Avenue is not feasible,
prudent or safe due to the traffic volumes on Burwell Street. The City will not support this
suggestion.
· The City will continue to work together to pursue Federal and/or State funding for
improvements to this intersection.
In addition, your safety office put out a notice to Shipyard employees that points out the
pedestrian responsibilities for crossing the street (copy attached). We appredate this effort, as
crossing the street safely involves both pedestrians and vehicles.
in the event funding for a traffic signal cannot be secured and the above mentioned
improvements don't produce the desired effects, an alternative solution to this issue would be to
dose the State Avenue gate to pedestrian traffic. Having the pedestrians use the signalized
intersection at the Naval Avenue gate or the underground crossing at the Park Avenue gate to
cross Burwell Street would eliminate the significant pedestrian crossings at State Avenue. This
solution would additionally reduce the impact of speeding, parking and littering' on the
surrounding City neighborhood.
I appredate your interest in addressing this issue, i would like to meet with you to formulate a
plan to approach Congressman Norm Dicks and others on obtaining Federal funds for this work.
If you have any questions I can be reached at (360) 478-5266, or Randy Witt, City Engineer, is
available at (360) 478-5348.

Lynn Horton, Mayor

IN REPLY REFER TO
November 1, 1999
Dear Mayor Horton,
I am writing this letter regarding our mutual concern for traffic safety on Burwell Street, also
known as State Route 304. In a meeting in your office on August 18, 1999, you requested the
Shipyard to assist with installation of a traffic control signal on Burwell Street at State Street.
Two blocks away fi.om this intersection is the location of a gate to the Shipyard and Naval
Station where numerous employees enter and exit daily.
Burwell Street was recently changed from two lanes of traffic to three. Now, if the driver in one
eastbound lane has stopped for a pedesu/an, the driver in the other lane cannot see the t~edestrian
and continues through the intersection, risking hitting the pedestrian. Prior to this traffic
revision, there were significantly fewer complaints concerning Burwell Street traffic.
The reason for your request was based on the following:
The number of complaints from Shipyard employees to the City since Burwell Street was
revised from two lanes to three lanes in the summer of 1999.
Data from City of Bremerton Police studies showing average speeds on Burwell Street to
be well over the 25 mph speed limit.
Lack of City funds to support installation of a traffic control signal.
Inability to obtain State assistance for installing a traffic control signal due to inadequate
accident statistics at Burwell Street and State Street.
During the August 18 meeting, I informed you that the Shipyard agreed with the need for traffic
control to improve pedestrian safety on Burwell Street, but that there is no authorization for the
Shipyard to pay for such improvements outside of federal property.
Since the August 18 meeting, I am aware of two vehicle-pedestrian accidents at Burwell Street
and State Street. On September. 29, a bicyclist crossing Burwell Street in the crosswalk was
struck by a car on one of the two eastbound lanes. The victim was airlifted to Harborview
Medical Center in Seattle, but fortunately was released for recovery. On October 28, a second
pedestrian was bumped but not injured by a car in one of the two eastbound lanes.
People who cross Burwell Street at State Street recognize it to be a significant hazard. However,
because of the traffic lane design, even if traffic appears to be stopped, they still risk being run
down by the "blind lane" driver. As you are aware, during the morning and evening rush hours,
there is a constant stream of traffic, and pedestrians cannot wait for a lull in traffic to cross. If
something is not done about this situation it will be only a short time before more serious
accidents occur.
I have the following suggestions for improvement in pedestrian safety at Bm-well Street and State
Street:
For minimal cost to the City, provide City sponsorship of crossing guards during shift
change times. The Shipyard would provide individuals to perform crossing guard duties under
City sponsorship. City costs would possibly include additional signage or other devices to warn
drivers of the crossing. I consider this to be a temporary solution until a permanent solution can
be implemented.
For minimal cost to the City, install Stop signs on Bm'well Street at State Street. Turn the
Bm'well Street and State Street intersection into a 4-way stop intersection. Additional signage or
other devices might be required to warn drivers of the traffic revision.
Continue to jointly pursue State assistance to install a traffic control signal at Burwell
Street and State Street.
The recent traffic revision which changed Burwell from two to three lanes has increased the
hazard to pedestrians. Although resolving this matter is a City and State responsibility, I am
willing to provide temporary assistance in the form of labor for crossing guards. I am also
willing to go to the state, on behalf of the city, to stress the need for their support in resolving
this traffic problem. I have forwarded a copy of this letter to Mr. Sid Morrison, Secretary of
Transportation, and to the 26th Legislative District Representatives and Senator to ensure their
awareness of the matter.
I_fi can be of further assistance in the matter, please do not hesitate to call. I sincerely hope
something can be done about this problem, before someone is seriously injured at this
intersection.
Sincerely,
Captain,(U. S. Navy/

DANGEROUS INTERSECTION
A Shipyard worker was injured on Wednesday, September 29, attempting to cross the intersection at
Burwell and State Street. It was a bdght sunny day and dry. With daylight hours getting Shorter and
weather conditions that will worsen, workers should be extra careful when crossing this intersection.
This intersection is very busy with pedestrian, bicycle and vehicle traffic during shift changes.
Shipyard employees using this intersection should be aware of the dangers.
1. Do not assume the driver can see you.
2. Look both ways several times before stepping into the roadway.
3. Wear light colored ctoth!ng or reflective materials on your clothing.
4. Wait until traffic slows before attempting to cross Burwell

LEGISLATIVE REPORT
A response from the City Attorney was provided to concerns raised by Del Knauss regarding an
"Information Item on the Impacts of 1-695" presented at the October 13, 1999 City Council meeting.
PUBLIC RECOGNITION
Patricia L. Foote Project Coordinator for Gateway Community Family Resource Center (formerly
known as the Phoenix Project), provided information on the project, which included a childcare center
for 136 children, with an emphasis on infants and extended hours. This is a joint effort by Kitsap
Transit and a number of other collaborative partners. The facility will be located at the Park & Ride
Lot at 6th & Montgomery. She is asking the City for a Joint Resolution of support.
John Becket raised concerns over the "Purchase Offer for the KPS Building" discussed at the
Council meeting last week. He asked 1) Why was the item not placed on the published Agenda,
providing an opportunity for those who wished to comment; and 2) If this item was only brought as an
"approval to negotiate", where does "negotiation" end, and "commitment" begin. Ruth Natividad was
also concerned with the item being hastily added to the Agenda, and added her opposition.
Gordy Byrd requested a copy of the letter sent to Del Knauss, and raised concerns of Iow
attendance at various local informational meetings. He encouraged citizens to be more involved.
Al Colvin congratulated all participants in the recent election. He extended sincere thanks to the
Mayor, Council, and citizens for welcoming the Tuskegee Airmen who were special guests at the
Constitution Day Luncheon on September 18, 1999, specifically thanked Carlos Montgomery_ for
creating the "key to the City" which was presented to the Airmen. He announced a memory book
commemorating the event would soon be available.
Al Buss, representing the Disabled American Veterans, raised concerns about what he viewed as
"excessive" regulating of the parking strip in front of the Disabled American Veterans Hall located at
2315 Burwell Street during bingo nights from 9:00 A.M. to 3:00 P.M. on Mondays and Thursdays.
9A - ORDINANCE NO. 4671 (SECOND READING) AUTHORIZING CONDEMNATION OF
PROPERTY FOR RIGHT-OF-WAY ON THE WERNER CORRIDOR IMPROVEMENTS PROJECT,
#AB99-223 (First Reading of this Ordinance was presented at the October 29, 1999 meeting).
There were no questions or comments from the public.
Mr. Reed supported the improvements, but reiterated his concerns that condemnation should not
take place until every reasonable attempt to negotiate reasonable properties value are attempted

Mr. Shea responded that appraisals were done with a certified Appraiser, and also a Reviewer. It
was explained that the disparity in amounts had to do mainly with the size of the property. Another
step in the process is available if a price can not be agreed on. Mr. Fart pointed out that no one has
come forward to request that step tonight, and clarified with Mr. Shea that proper notifications were
sent to affected property owners letting them know they had this opportunity.
Mr. Montgomery added that condemnation is a very valuable tool to businesses for tax purposes,
which each of the affected business needs to look into. He further pointed out that only one property
in the entire corridor was not a business, and that federal transportation dollars as well as an EDA
grant were involved, and there has already been one extension.
#0791 M/S/C (Montgomery/Farr) Motion to pass Ordinance No. 4671 authorizing the purchase of
properties through condemnation for the purpose of providing right-of-way for widening and
developing Kean Blvd., and Werner Road between Auto Center Way and Auto Center Blvd.

9B - ORDINANCE NO. 4672 (SECOND READING) LEVYING PROPERTY TAXES FOR
COLLECTION IN 2000, #AB99-226 (First Reading of this Ordinance was presented at the October
29, 1999 meeting).
Ruth Natividad asked how much of an increase was this going to be. Rich Hanna, City Treasurer,
stated the tax rate will from 1999 will actually go down for the year 2000, by approximately 2.9%.
#1060 M/S/C/U (Montgomery/Olsen) Motion to pass Ordinance No. 4672 on second reading, levying
property taxes for collection in the year 2000.
9C - ORDINANCE NO. 4673 (SECOND READING) AUTHORIZING THE LEVY OF PROPERTY
TAXES AT A RATE IN EXCESS OF THE INCREASE IN THE IMPLICIT PRICE DEFLATOR
#AB99-227 (First Reading of this Ordinance was presented at the October 29, 1999 meeting).
John Becker asked what the Implicit Price Deflator (IPD), was; and what the increase would be. Mr.
Hanna responded that the IPD is a measure of inflation, like the more common CPI. He further
clarified that even with the passage of this Ordinance, the tax rate would be lower in the year 2000
than it was in 1999 (a decrease of approximately 1-%%).
#1150 M/S/C (Montgomery/Olsen) Motion to pass Ordinance no. 4673 on second reading, limiting the
City's levy increase to 106% of the 1999 levy.

Motion carried.
9D - ORDINANCE (FIRST READING), SETTING GREENS FEES FOR GOLD MOUNTAIN GOLF
COMPLEX, AND REPEALING RESOLUTION NO. 2657 & RESOLUTION NO. 2684, #AB99-231
Pat Westhoff summarized that in order for the City's Gold Mountain Complex to remain financially
sound, it is necessary to implement fee changes on a systematic and regular basis. Greens fees
were last updated in January 1999.

There were no questions or comments from the public.
Mr. McConnell pointed out that rates are only increased every other year, and only by $1.00 per
round. He further pointed out that all revenue goes back to improving the Golf Complex.
#1243 M/S/C/U (Montgomery/McConnell) Motion to approve ordinance on first reading, establishing
greens fees for the Gold Mountain Golf Complex, and repealing Resolution Nos. 2657 and 2684.
9D - ORDINANCE (FIRST READING), AMENDING BREMERTON MUNICIPAL CODE 15.06.
SETTING UTILITY ASSESSMENTS, RATES, FEES, & CHARGES, #AB99-237
Rich Hanna, City Treasurer, stated the proposed ordinance will allow the City's utility assessments,
fees, and charges to be adjusted to compensate for the effects of inflation. Adjustments will take
effect December 1, 1999 and on January 1 of each year beginning 2002. These adjustments are
necessary to allow the utility to meet the costs of operations and maintenance, and to implement the
capital improvements, which are mandated to meet environmental and water quality regulations.
John Becker asked what this increase would cost the ratepayer, and why a rate higher than inflation.
Mr. Hanna stated the proposed rate increase would be 6% on average, effective December 1, 1999,
and adjusted for inflation each January beginning in Year 2002. He further explained the intention
was to adjust the rates for the approximate rate of inflation anticipated for the years 2000 and 2001.
The purpose is to preserve the financial stability of the utilities to be able to deal with the court
mandated environmental improvements. He did not believe that 3% was an unreasonable rate.
Roy Mclnnis voiced his concerns over the assumption that inflation will increase by 3%.
Mr. Overson took issue over the questions being asked regarding the proposed fee increases. He
pointed out that having a quality Utility does cost money. He complimented staff for the great work
they are doing to keep the costs down. He also pointed out these proposed fee increases are less
than being proposed in the County. Mr. Montgomery agreed with the comments made by Mr.
Overson, and reminded citizens that most fee increases are due to State mandates.
Mr. Reed stated he could possibly support about 85% of the proposed fee increases, but would not
support this item as currently drafted due to the "presumed" rate of inflation.
Mr. Olsen did not like the increase, but reminded citizens that the Utility Depar[ment has bonds that
must be paid; and the City is forced to comply with State, non-funded, mandates.
Mayor Horton further commented that a $600,000 Congressional Line-Item Appropriations Grant
was received, which was the first time money was ever received from the State of Washington or the
Federal Government in the form of a grant. In the past, the City has had to pay 100% of all past
loans used for stormwater improvements through the ratepayer. She is hoping that the City will be
included in future Line-Item Appropriations.
Mr. Fart referred to "Appendix A", and asked if the rates shown reflect an increase of 6% over what is
in effect today? Mr. Hanna responded the increase will be 6% overall, and the increase is on the
fixed, rather than the volumetric portion of the bill. With the current sewer utility rates, approximately
73% of the rate revenue is derived from the volumetric charges, with the other 27% from the fixed fee
portion. The City is currently working to get a more equitable distribution. Mr. Farr was still
concerned at the 6% increase imposed all at once. Mr. Hanna responded there was a slightly higher
amount of rate revenue available to the Utilities. Another intention was to allow the City to sit on the
TAPE #1658

Mr. Law observed this increase is necessary to protect the purchasing and servicing of the sewer
system for the next two years. He agreed it was circumventing 1-695, but stated this would be the
only time he would vote along these lines. The problem in this particular case is the City's Legal
Department is diligently trying to stay ahead of the stringent requirements placed on the City by the
Puget Soundkeepers Alliance.

RCW 82.80.030 Commercial parking tax. (1) Subject to the conditions of this section, the legislative authority of a
county or city may fix and impose a parking tax on all persons engaged in a commercial parking business within its respective
jurisdiction. The jurisdiction of a county, for purposes of this section, includes only the unincorporated area of the county. The
jurisdiction of a city includes only the area within its incorporated boundaries.
(2) In lieu of the tax in subsection (1) of this section, a city or a county in its unincorporated area may fix and impose a tax
for the act or privilege of parking a motor vehicle in a facility operated by a commercial parking business.
The city or county may provide that:
(a) The tax is paid by the operator or owner of the motor vehicle;
(b) The tax applies to all parking for which a fee is paid, whether paid or leased, including parking supplied with a lease of
nonresidential space;
(c) The tax is collected by the operator of the facility and remitted to the city or county;
(d) The tax is a fee per vehicle or is measured by the parking charge;
(e) The tax rate varies with zoning or location of the facility, the duration of the parking, the time of entry or exit, the type
or use of the vehicle, or other reasonable factors; and
(f) Tax exempt carpools, vehicles with handicapped decals, or government vehicles are exempt from the tax.
(3) "Commercial parking business" as used in this section, means the ownership, lease, operation, or management of a
commercial parking lot in which fees are charged. "Commercial parking lot" means a covered or uncovered area with stalls for
the purpose of parking motor vehicles.
(4) The rate of the tax under subsection (1) of this section may be based either upon gross proceeds or the number of
vehicle stalls available for commercial parking use. The rates charged must be uniform for the same class or type of commercial
parking business.
(5) The county or city levying the tax provided for in subsection (1) or i2) of this section may provide for its payment on a
monthly, quarterly, or annual basis. Each local government may develop by ordinance or resolution rules for administering the
tax, including provisions for reporting by commercial parking businesses, collection, and enforcement.
(6) The proceeds of the commercial parking tax fixed and imposed under subsection (1) or (2) of this section shall be used
strictly for transportation purposes in accordance with RCW 82.80.070. [1990 c 42 § 208.]

RCW 82.80.070 Use of revenues. (1) The proceeds collected pursuant to the
exercise of the local option authority of RCW 82.80.010, 82.80.020, 82.80.030, and
82.80.050 (hereafter called "local option transportation revenues") shall be used for
transportation purposes only, including but not limited to the following: The
operation and preservation of roads, streets, and other transportation improvements;
new construction, reconstruction, and expansion of city streets, county roads, and
state highways and other transportation improvements; development and implementation
of public transportation and high-capacity transit improvements and programs; and
planning, design, and acquisition of right of way and sites for such transportation
purposes. The proceeds collected from excise taxes on the sale, distribution, or use
of motor vehicle fuel and special fuel under RCW 82.80.010 shall be used exclusively
for "highway purposes" as that term is construed in Article II, section 40 of the
state Constitution.
(2) The local option transportation revenues shall be expended for
transportation uses consistent with the adopted ~ransportation and land use plans of
the jurisdiction expending the funds and consistent with any applicable and adopted
regional transportation plan for metropolitan planning areas.
(3) Each local government with a population greater than eight thousand that
levies or expends local option transportation funds, is also required to develop and
adopt a specific transportation program that contains the following elements:
(a) The program shall identify the geographic boundaries of the entire area
or areas within which local option transportation revenues will be levied and
expended.
(b) The program shall be based on an adopted transportation plan for ~he
geographic areas covered and shall identify the proposed operation and construction
of transportation improvements and services in the designated plan area intended to
be funded in whole or in part by local option transportation revenues and shall
identify the annual costs applicable to the program.
(c) The program shall indicate how the local transportation plan is
coordinated with applicable transportation plans for the region and for adjacent
jurisdictions.
(d) The program shall include at least a six-year funding plan, updated
annually, identifying the specific public and private sources and amounts of revenue
necessary to fund the program. The program shall include a proposed schedule for
construction of projects and expenditure of revenues. The funding plan shall consider
the additional local tax revenue estimated to be generated by new development within
the plan area if all or a portion of the additional revenue is proposed to be
earmarked as future appropriations for transportation improvements in the program.
(4) Local governments with a population greater than eight thousand
exercising the authority for local option transportation funds shall periodically
review and update their transportation program to ensure that it is consistent with
applicable local and regional transportation and land use plans and within the means
of estimated public and private revenue available.
(5) In the case of expenditure for new or expanded transportation facilities,
improvements, and services, priorities in the use of local option transportation
revenues shall be identified in the transportation program and expenditures shall be
made based upon the following criteria, which are stated in descending order of
weight to be attributed:
(a) First, the project serves a multijurisdictional function;
(b) Second, it is necessitated by existing or reasonably foreseeable
congestion;
(c) Third, it has the greatest person-carrying capacity;
(d) Fourth, it is partially funded by other government funds, such as from
the state transportation improvement board, or by private sector contributions, such
as those from the local transportation act, chapter 39.92 RCW; and

(e) Fifth, it meets such other criteria as the local government determines is
appropriate.
(6) It is the intent of the legislature that as a condition of levying,
receiving, and expending local option transportation revenues, no local governmen5
agency use the revenues to replace, divert, or loan any revenues currently being used
for transportation purposes to nontransportation purposes. The association of
Washington cities and the Washington state association of counties, in consultation
with the legislative transportation committee, shall study the issue of nondiversion
and make recommendations to the legislative transportation committee for language
implementing the intent of this section by December 1, 1990.
(7) Local governments are encouraged to enter into intertocal agreements to
jointly develop and adopt with other local governments the transportation programs
required by this section for the purpose of accomplishing regional transportation
planning and development.
(8) Local governments may use all or a part of the local option
transportation revenues for the amortization of local government general obligation
and revenue bonds issued for transportation purposes consistent with the requirements
of this section. [1991 c 141 § 4. Prior: 1990 c 42 § 212.]
