architecture of the machine and the fact that it is no longer covered by NCR's warranty we need to either replace
it or take out a maintenance contract to keep it running. It is estimated that a maintenance contract would cost
between $8,000 and $10,000 per year.
RECOMMENDATION:
Motion to replace the NCR S40 with an ALR 9200 series, acquired through the State's Technology Brokering
Service at a cost of approximately $19,000.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
The City of Bremerton will receive an estimated $550,000 m Community Development Block Grant Funds for
year 2000 from HUD. The City previously provided set-asides for the following activities: $90,000 for CDBG
administration; $100,000 forthe City's housing program; $20,000 to assist Bremerton Housing Authority
develop a plan for evaluation of the Westpark complex, $10,000 to assist E.D.C. carry out microenterprise
activities; and $10,000 for ADA improvements to the Admiral Theater.
Applications for the remaining funds were accepted on August 18. We received 28 applications requesting
$877,471. City staff reviewed the applications to determine that they met threshold requirements and were
consistent with HUD regulations. The Citizens Advisory Committee (Roy Mcinnes, Trna Davis, and Dav/d
Willis) reviewed the applications, interviewed each applicant, and rated the project in accordance with the
approved action plan. The recommendations were presented to the Council on October 13, 1999. Council
returned the recommendations to the Advisory Committee to review items discussed during the Council
meeting. Each member of the Advisory Committee was contacted and a revised recommendation was agreed
upon. The Advisory Committee's revised recommendations are attached.

Re: Year 2000 CDBG Allocation
If the City of Bremerton is awarded any additional funds, please consider the
YMCA Childcare Scholarship Program.
Just through September of 1999 we served 64 new Bremerton low-income
children in Latchkey Childcare and Day camps by provifling them $23,000 in
dLrect scholarship support.
Our contract was for 38 children and $7600 for 1999 and we still have 3 months
left in the year to go! We will strive to cominue to serve these and additional
children in 1999. However, this will be impossible in 2000 with zero City
CDBG funding.
Thanks for considering our request.

CITY COUNCIL HEARING DATE: October 20, 1999
PREPARED BY: Ned Lever
SUMMARY
A. Applicant:
Loren and Karen Olsen
P.O. Box 729
Port Orchard, WA 98366
B. Location:
A five foot wide, 200 foot long strip of R-O-W located along the
north margin of Marine Drive just west of Dora Avenue.
C. Attachment: City of Bremerton Application for Right-of-Way
BACKGROUND
The applicants have petitioned the City of Bremerton to vacate a portion of Marine Drive
Right-of-Way that abuts their property (approximately 1,000 sf). There are no other
properties that abut this portion of the right-of-way. The vacation will eliminate a jog in
the right-of-way line and will increase the buiidable area of the abutting property due to
improved building setback locations. In addition the vacation is being processed
simultaneously with a dedication of right-of-way by these same applicants. The
dedication is located at the northwest corner of Marine Drive and Dora Avenue and will
benefit the City by accommodating the construction of sidewalks on Dora. The
dedication has been completed as part of a recent short plat and was considered as
part of the compensation for the right-of-way vacation. Finally, the proposed area to be
vacated is located at the top of a grassy slope and does not contain any public utilities.
See the attached application for a sketch of the area in question.

BMC '1'1.20.120 sets forth issues that the City Council needs to determine at the
conclusion of the Vacation Hearing. These issues and the staff position are:
1. Whether the street, alley or portion thereof is no longer required for public
use and vacation of the described portion will better serve the public good.
Staff Position:
This portion of Marine Drive is no longer required for public use. The area
encompasses the top of a grassy slope and does not contain any public utilities.
2. Whether the vacation is consistent with the City Comprehensive Plan.
Staff Position:
The proposed vacation does not conflict with the comprehensive Plan and the
property to be dedicated will allow for improved pedestrian infrastructure on Dora
Avenue.
3. Whether continued use of the proposed vacation as a public way is not of
such public benefit as to not justify the costs of maintenance.
Staff Position:
This is a vegetated portion of the right-of-way. The maintenance has been and
will remain the responsibility of the adjacent property owner.
4. Whether substitution of a new and different thoroughfare would be more
useful to the public.
Staff Position:
This is not an issue the capacity of Marine Drive as a thoroughfare will not be
impacted.
5. Whether conditions may so change in the future as to provide a greater
public use or need than presently exists.
Staff Position:
The resulting width of right-of-way after the vacation will still allow for the
pavement widening and sidewalk improvements that could occur in the future.
October 5, 1999
Street Vacation/BTC Project/Engineering Report
Page 2 of 3
6. Whether objections to the proposed vacation are made by owners of
private property abutting the same.
Staff Position:
No objections have been received from any abutting property owners. The
petitioners (Loren and Karen Olsen) are the only abutting property owners.
SHORELINE ACCESS
This portion of right-of-way does not provide shoreline access.
UTILITIES
All private utility companies have been contacted and there are no utilities located within
this portion of the right-of-way.
SUFFICIENCY OF SIGNATURES
The request for the vacation was made by more than two-thirds of the owners abutting
the property to be vacated on a front footage basis.
COMPENSATION
The compensation amount of $88.33 has been paid and the corresponding dedication
of right-of-way has been completed through the short plat process.
STAFF RECOMMENDATION
No comments were received from Police, Fire, or Community Development staff. Staff
recommends that this Street Vacation be approved as requested without modification.

Additional right-of-way is required to accomplish the West Hills Commercial/Werner Road Corridor Improvements
Project. The additional right-of-way is needed to develop Kean Boulevard, widen Wemer Road, and improve the
intersection at Wemer Road and Auto Center Boulevard. This affects 13 parcels, 11 property owners. In July 1999
the right-of-way acquisition started with mailings to affected property owners along Kean Boulevard. Since then
negotiations have been ongoing with all the property owners with agreements anticipated on at least 4 properties in the
next few weeks and negotiations continuing with the other nine.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION - Continuation
However, to keep the project on schedule for construction next spring, condemnation proceedings need to be initiated
on the properties without executed agreements. The City will continue to negotiate purchases under procedures of
Bremerton Municipal Code 2.78.040-070 before initiating a condemnation action with the court against any of the
parcels. In fact, the City desires to reach a negotiated acquisition of the properties rather then proceed with the
condemnation process. The Mayor is authorized to execute purchase agreements on any of the parcels inlieu of
condemnation.
This ordinance authorizes the purchase of properties through condemnation for the purpose of widening the right-of-
way for street improvements.
Staff recommends passage of the attached ordinance.
5. IMPACT ON NON-PASSAGE:
The City will not be able to accomplish the West Hills Commercial/Wemer Corridor Improvements project and all
State and Federal funding may be in jeopardy, as the project will not be completed as within the project description.

Re: 2000 Property Tax Levy
Attached are the Agenda Bill and proposed Ordinance for levying
property taxes for collection in 2000. The levy figures are based
on the County Assessor's preliminary estimate of the City's
valuation. As the Assessor produces the final assessment figures,
the calculations will be modified accordingly. Usually there is a
minor revision upward in the assessed valuation which results in
slightly lower levy rates and slightly higher property tax revenue.
The City's property tax levy actually consists of three different
components, the method for setting the levy is slightly different
for each of these components:
The general or O & M levy is by far the largest component of
the City's levy. It is used to help finance the operations of
the City's General Fund and is levied as an exercise of the
authority of the City Council pursuant to statute.
Historically, the amount of this levy was limited by two
different statutes: First, RCW 84.52.043 limits the City to a
maximum levy rate of $3.325 per thousand dollars of valuation.
RCW 84.55.010 further limits the City's property tax revenue
to a maximum of 106% of the highest of the preceding three
years plus the amounts resulting from new construction and
annexations.
With the passage of Referendum 47, the 106% limitation is now
divided into two components, each of which must be presented
in a separate ordinance. The first, codified as RCW 84.55.050,
limits the increase in our tax revenues to the lesser of 106%
of the levy from prior years or the change in a measure of
inflation called the Implicit Price Deflator, (IPD). For this
year the change in the IPD 1.42%, so this is the limiting
factor which is presented in the first of our two ordinances
which will require a simple majority for passage. The second
ordinance, which will, if approved by a super-majority as
required by RCW 84.55.0101, increase the levy from the change
in the IPD approved in the first ordinance up to the 106%
limitation.
However, the maximum levy rate
limitation on this years levy.
will be the operative
The Emergency Medical levy is set pursuant to excess levy
authority granted by the voters. A levy rate not to exceed
$.50 per $1,000 was approved in 1998 and runs for six years.
The Fire Bond levy is set pursuant to excess levy authority
granted by the voters in 1990 authorizing the bonds issued in
1991 which were refinanced in 1997. The annual levy is set to
match the City's debt service obligation on this bond issue
for the year.
