Attorney, of the Planning Department, summarized that the City of Bremerton, Kitsap County, and
Port Blakely Communities (land owner & developer) have cooperatively prepared a Sub-Area Plan for
a large parcel of land (approximately 440 acres) located west of Kitsap Lake and outside the City
limits for future annexation to the City. In addition, because City's 1995 Comprehensive Plan does
not provide the mechanism to process the proposed annexation, the City amended the
Comprehensive Plan to facilitate implementation of the provisions contained in the Sub-Area Plan and
the Three-Party Agreement. The objective of the Port Blakely Joint Planning Area Sub-Area Plan is
to facilitate, encourage, and support proposed mixed use development which will further the goal of
regional economic growth. Lastly, it was pointed out that one agreed-upon change was made to
Section 8 of the contract since the first reading of this Ordinance, stating that Port Blakely Properties
must submit an annual report showing efforts to prepare and market the employment sites within the

continuation of the Special Joint City Council & County Commissioner Public Meeting held on August
29, 2000. David St. Pierre, Assistant City Attorney, stated that no changes were made since first
reading, and reiterated that the addition of this zoning classification was developed in order to
implement the provisions of the Sub-Area Plan, and that it would benefit the City. It was further
clarified that this zoning classification could be utilized anywhere in the City, was not created just for
Port Blakely.
There were no comments or questions from the public.
#1645 M/S/C/U (Reed/Olsen) Move to pass Ordinance No. 4723 on second reading, amending

11A - RESOLUTION NO, 27?'4. UPDATING THE "BREMERTON CiTY COUNCIL RULES &
PROCEDURES" (#AB00-217): Glenna Malanca, City Attorney, reported that the City Council
determined the advisability of updating the "Bremerton City. Council Rules & Procedures", last revised
in 1996. The City Council, through Study Session, appointment of a sub-committee, and working with
the City Attorney, has produced the proposed rules. Changes made to-date to this latest draft were
discussed, and it was established that upon the Council's direction, further changes could still be
redrafted. It was further pointed out that according to Rule 9 of the Bremerton City_ Council Rules &
Procedures, amendments to these rules shall be made by resolution of the Council, which must then
be laid over for at least one week before final adoption.
Susan Brown provided a handout to the City Council, listing suggested changes to the proposed
"Bremerton City Courlcil Rules & Procedures", as well as pointing out grammatical errors. She asked
for clarification on the process for generating the censure motion discussed in Rule 1, Section 6 and
the process in Rule 9, Section 5 for discussing a written complaint. She further suggested several
replacements for the proposed introductory comments; and addressed processing complaints and
violations of confidentiality.
Mr. Law questioned if the procedure in Rule 9, Section 5 of the "Bremerton City Council Rules &
Procedures" that addresses complaints against a Council member deviates from the procedure
established in the revised Code of Ethics already in place. He further questioned who makes the

decision on which process to follow. Ms. Malan~al responded that Rule 9, Section 5 does deviate
from the Code of Ethics in Chapter 2.96 of the Bremerton Municipal Code (BMC), which establishes a
procedure for dealing with very serious allegations of an ethical violation. She clarified that Rule 9,
Section 5 of the "Bremerton City_ Council Rules & Procedures" provides a procedure for less serious
complaints such as a City Council member being "impolite" or "rude", and that it is the complainant
who decides which process to follow. Mr. She.oherd continued to discuss this issue, and suggested
that a comment be added to Rule 9, Section 5, referring complaints of a more sedous issue to
Chapter 2.96 of the BMC. Mr. Law suggested that because the "average citizen" may not
understand the procedures to make a complaint, he asked if all complaints should first go through the
Code of Ethics procedure for an objective evaluation. Ms. Malanca answered that a clear process is
now in place to determine if a complaint will go forward, and further agreed with the suggestion by Mr.
Shepherd.
Mr, McConnell asked how far State law allows a Council to "discipline" another member of the
Council. Ms. Malanca responded that this issue is not addressed very well in State law, and
provided examples where such words as "inappropriate" or even "unlawful" are used, but no
designation of a remedy is provided.
Mr. Reed addressed the issue of "rebuttal from the public being limited by the Presiding Officer"
discussed in Rule 9, Section 3. Ms. Malanca agreed that it be changed to "argumentative rebuttal".
#3537 M/S/C/U (McConnell/Law) Move to lay over Resolution No. 2774, concerning revised "City
Council Rule.~ & Procedures", to next week's meeting, as required by Rule 9 of the "City Council
R.~lles & Procedures".
With no further business, meeting concluded at 7:00 P.M.

VACATING PORTIONS OF .."C" STREET, NEBRASKA AVENUE, AN AI..LEY BETWEEN BAY
VIEW DRIVE WEST AND STATE ROUTE 3, SOUTH OF "C" STREETRESOLUTtON NO. 2775,
(#AB00-220): Jeff Shea, Senior Engineer, reported that the City initiated the vacation of portions of
"C" Street, Bay View Drive West, Nebraska Avenue, and an alley located between Bay View Drive
West and State Route 3 south of "C" Street. These rights-of-way are located in the areas that were
purchased by the City as part of the Wastewater Treatment Plant odor mitigation. Rodney & Linda
Parr have purchased a portion of this property for development, and the City has retained the
property abutting the north end of the Wastewater Treatment Plant. Necessary access will be
provided by a mutual access easement. Therefore, there is no need to provide access via a public
street right-of-way. The City Council is requested to establish a hearing date of October 25, 2000 to
consider the proposed vacations.
There were no question or comments by the public.
Mr. Farr stated that when this property was obtained through condemnation, an "odor easement" was
established to protect the City from further lawsuits filed due to odor from the Wastewater Treatment
Plant. He, therefore, asked for assurance that the new property owners would have no recourse to
sue the City, and that this condition is included in the agreement. Ms. Malanca offered to work with
the Engineering Department to include this wording in the agreement by the date of the hearing.
#1015 M/S/C/U (McConnell/Reed) Move to pass Resolution No. 2775, setting a hearing date of
October 25, 2000, for the vacation of portions of "C" Street, Bay View Drive West, Nebraska Avenue,
and an alley located between Bay View Drive West and State Route 3 south of "C" Street.
9C - RESOLUTION NO. 2776, SETTING A HEARING DATE OF OCTOBER 25. 2000, FOR
VACATING PORTIONS OF CO'I-rMAN AVENUE AND PERRY STREET. (#AB00-221): Jeff Shea,
Senior Engineer, reported that the City has received a petition from Charles and Joanne Haselwood

to vacate portions of Cottman Avenue and Perry Street located west of Oyster Bay. Most of this
right-of-way is undeveloped with a portion of Cottman Avenue being used as a gravel access way. A
private street will be improved that will provide access to the property owners that abut this right-of-
way, and access easements will be granted. The City Council is requested to establish a headng date
of October 25, 2000 to consider the proposed vacations.
There were no question or comments by the public.
Mr, Fart again asked for assurance that the City was protected from lawsuits due to odor.
#1185 M/S/C/U (Reed/Olsen) Move to pass Resolution No. 2776 setting a headng date of October
25, 2000 for the vacation of portions of Cottman Avenue and Perry Street located west of Oyster Bay.
9C - RESOLUTION NO. 2777. A "RESOLUTION OF NECESSITY" FOR FRONTAGE
IMPROVEMENTS: AND DEDICATION OF RIGHT-OF-WAY FOR THE "VINTAGE AT
BREMERTON" DEVELOPMENT, (#AB00-222~: Jeff Shea, Senior Engineer, described the 'Vintage
of Bremerton" as a project which proposes construction of senior apartments at the corner of
Sheridan Road and Schley Boulevard (former Kona Village site). As part of this development, the
developer (Canddle Development, Inc.) has agreed to construct frontage improvements (curb, gutter,
sidewalk, street lighting, etc.) on the Sheddan Road side of the project, connecting to existing
improvements to the west and south, as well as modifying the existing frontage improvements
(remove and construct driveways, construct street lighting, etc) on Schley Boulevard. The
improvements along Sheridan Road and Schley Boulevard are in the existing right-of-way, which
means that the connection to Schley Boulevard requires a dedication of right-of-way to facilitate the
right-of-way for construction of the curb return with no cost to the City. Bremerton Municipal Code,
Chapters 11.08.020 and 11.08.030, require a Resolution determining necessity of the curb, gutter and
sidewalk improvements, and a statement of how payment for improvements will be made. Resolution
No. 2777 meets those requirements.
There were no question or comments by the public.
#1286 M/S/C/U (McConnell/Reed) Move to pass the attached Resolution of necessity for construction
of frontage improvements and dedication of right-of-way along Sheridan Road and Schley Blvd. as
part of the "Vintage at Bremerton" development project.
With no further business, meeting concluded at 6:15 P.M. The Council then adjourned to the Council
Conference room to discuss the "Cooperative Approach to CSO Reduction" with staff from the Water
Resources Department of Public Works & Utilities.

LEGISLATIVE REPORT - There was no report tonight.
PUBLIC RECOGNITION
Mike Ebersol was initially frustrated that the City could not assist him in resolving an issue with
barking dogs in his neighborhood even though there is a City ordinance (BMC Chapter 7.08.100(b)
regarding "Nuisances" and "Disturbances"). However, he was more disturbed to find that the reason
for lack of enforcement was a lack of manpower in the Police Department. He researched
information and found the national average number of police officers per capita of people was 1
officer for every 426 citizens, compared to Bremerton, which was I officer for every .760 citizens. He
asked the City to look at this issue very carefully.
9A- YEAR-2001 CDBG CITIZEN'S ADVISORY COMMITTEE RECOMMENDATIONS (#AB00-227):
Debbie Peavler-Stewart, Administrative Analyst, reported that the City of Bremerton will receive an
estimated $550,000 in Community Development Block Grant Funds (CDBG) for year 2001 from HUD.
The City previously provided set-asides for the following activities: $90,000 for CDBG administration;
$100,000 for the City's housing program; and $100,000 for the downtown library revitalization.
Applications for the remaining funds were accepted on August 23, 2000. A total of 28 applications
requesting $539,230 were received. City staff reviewed the applications to determine that they met
threshold requirements, and were consistent with HUD regulations. The Citizen's Advisory
Committee (consisting of Roy Mclnnis, Tina Davis, and Steven Berkowitz) reviewed the applications,
interviewed each applicant, and rated the project in accordance with the approved action plan. Their
recommendations are included in the Council packet. Thanks were extended to all Committee
members for their efforts.
There were no question or comments by the public.
Mr. Shepherd and Mr. Farr also expressed their thanks and appreciation to the members of the
Committee for their contributions. It was noted that each year, the City seems to get an additional
block of money over the original designated amount, so it was asked if the City could expect
additional money this year. Ms. Peavler-Stewart responded that it usually is a surprise, with the
amount determined by whatever the Congress comes up with, but they estimate Iow so that no
applicants are disappointed. It is anticipated that the City will receive approximately $30,000
additional funds.
