ADJOURNMENT OF MEETING PROCLAMATION WHEREAS, during the early days of World War I, a Blue Star was used on banners to represent each person, man or woman in the Military Service of the United States and as the war progressed, and some were killed in combat, others wounded and died of their wounds or disease, a groundswell movement began in Chicago to ease the sense of personal loss, the idea of a Gold Star was adopted to convey the feelings of respect and symbolize the Honor and Glory accorded the person for their sacrifice; and WHEREAS, in May 1918, President Woodrow Wilson approved the change of using the Gold Star and it was during this time the service flag was adopted. In the summer of 1928, a group of twenty-five women who had lost a son or daughter in World War I, joined together to form the organization later known as the American Gold Star Mothers, and opened their ranks to all who lost children to hostile actions while serving their country including the allies of the United States; and WHEREAS, during the Military involvement of the United States in World War II, the service banners were proudly displayed in windows of families throughout the United States and the continuation of involvement of military forces saw our servicemen and women in Korea, Vietnam, Lebanon, Grenada, Panama, Central America, Europe, the Mediterranean, Kuwait, Saudi Arabia, Iraq, and Bosnia which continued to take a heavy toll on our sons and daughters who elected to serve their country and our allies; NOW, THEREFORE, I, Lynn S. Horton, Mayor of the City of Bremerton, do hereby proclaim September 23, 2000 as GOLD STAR PARENTS AND GOLD STAR WIVES & SISTERS REMEMBRANCE DAY and encourage all of the citizens of this City, County, State and Nation to pause a moment in reverence, and honor the sacred memory of the sons and daughters of these parents who sustained a great loss, but persevered knowing that their sons and daughters made the supreme sacrifice for the preservation of Peace and Freedom for all mankind. I apologize for the lateness of this email. It has bcc,~ a very busy weekend. I hope you find this helpful in efforts of getting to know me better, t I have been living in Siiverdale for the past 13 years so I pretty much have a good idea of the county. Among my favorite things are shopping, traveling, watching movies, hanging out with my friends, listening to music, and just boating. Exploring and trying new things each and everyday are my goals in life along with traveling around the wodd. I tend to keep active by participating in numerous extracurricular activities like ASB, Honor Society, Key Club, and 'Teen Suicide Task Prevention. As far as influences are concerned I consider my parents and God very important aspects in my life along with my future aspiration of becoming broadcaster for a television network. One of the reasons why I have a desire being a broadcaster is the interaction with people. I love talking to and meeting new people which is goes hand in hand with my aspiration of being a broadcast joumalist. Ever since I was little I have never wanted to be anything else other than a broadcaster. I guess you can say that from then on broadcasting has been one of my passions. I plan to pursue a degree from a four-year college and eventually attend Northwestern University for my Masters. As far as my high school broadcasting career, I have been doing moming announcements for the past three years now and was featured on our KUGR telecasts. In addition, I also consider education another important aspect in my life. In addition to being involved with extracurricular activities I also take part in Advanced Placement classes in the subjects of history, computer science, and mathematics. Dedication and motivation is are important values which I continue to stress both in and out of the classroom. All in ail, I have found all my experiences very rewarding and I look forward to a BKAT youth representative position. Thanks Again, Trisha Rule AGENDA BILL BREMERTON CITY COUNCIL 1. By agreement ofK. itsap County Commissioners (adopted on 9/11/00), Port Blakely Communities, and the City of Bremerton staff; the following change to Section 8 is incorporated in~ tho final version of the Three-Party Agreement and it is recommended that the City Council approve the Three-Party Agl'eement on second reading with the following amended Section 8: 8. Cooperation for Economic Development. All parties will work diligently to attract job-producing firms to locate with the Property as soon as feasible. City and County officials will participate in meeting with prospective firms when requested by Port Blakely. Until 500 pioneering jobs have been created, Port Blakely will make annual reports to the Executive Committee on the actions being taken to prepare and market the employment sites within the project, and the Executive committee will discuss actions which each party to this agreement should take to facilitate the creation of jobs at the project. The minutes of the Planning Commission meeting ~f August 1, 2000 were approved as pre~ented and signed at the August 15, 2000 meeting. Reepectfully submitted b~. Roll Call Those present were: Chairman Griggs, Commissioner Boyd, Commissioner Dingjield, Commissioner Kosusko and Commissioner Moshay. Quorum certified. IL C~ll to Order The meeting was called to order by Chairman Gdggs at 5:40 p.m. IlL Approval of Agenda The agenda was approved as presented, with the following change. Item IV - 1. Proposed Amendments to Bremerton Municipal Code (BMC) Chapter 21.02 will be continued to the August 15, 2000 meeting. A revised agenda was approved. IV. Public Meeting A. Call to the Public (public comments on any item not on tonight's agenda): Mr. Paul Seheyer, 2111 Madrona Point Dr., asked that the Special Exception granted for the Coutts project on Shore Drive be rescinded, based on the overlay zone ordinance that was approved at the July Planning Commission meeting. B. Hearing 1. Proposed amendments to City of Bremerton Comprehensive Plan to accommodate adoption of the Port Blakely Joint Planning Area Sub-Area Plan. Such amendments will modify most Elements of the Comprehensive Plan including, but not limited to, Elements A, C, E, F, G, H, I, J, and K. Commissioner Dingfieid asked if there would be wording added to accommodate light industrial and mixed use recognition of the county map. She assumed that those changes would be ora generic variety that would stay. She noted that the county has done a transition zone. She also asked if the area specific items that identify Port Blakely only would go away if Port Biakely Communities was not involved in the project at some point. Mr. Wyatt responded that if Port Blakely withdrew their proposed development of the 440 acres, ~ sections that reference the Port Biakely mb-area plan will drop out as a sunset clause. There are other areas that will remain for the opporttmity of some other developer to bring another piec~ of property in or to rezone or annex a piece of property under the proposed zoning that is being presented. They ar~ not going to close the door on anyone else should Port Blakely drop out. They would like to have an open door for anyone to come in and give the City an economic development boost. Commi,~ioner l)i~gfidd comm~w_ted that as an example, th~ dra~ ordinance 7.28, page 5 talks about economic development. It added the phrase, "fight industrial or t~hnological development, including mixed uses with r~idential." She would like to keep this phrase in tl~re to ensure the door is kept open. Mr. Wyatt noted that the intent is that if the Port Biak~y proje~ did not oc.~ur, there might be a smaller parcel that could be ann~x~xl. There could ~ be the possibility of an Urban Renewal project that could come in and r~one the area, produ~n8 light industrial, m~g, electronic, wireless, 4¢. Mr. Palmer said that the oc~,~sion for the amendments is during the sub-area plan and that the amendments are pertinent to the sub-area plan more so that any other aspect of a comprehensive plan. In eff~t, they can not really do some of thes~ amendments this year if it were not for the sub- area plan. Mr. Wyatt noted that there are items (i.e., Capital Fa~liti~s) that can be amended. The effect of Capital Facilities, as visualiz~ without a master plan that is approved through an additional Development Agreement, cannot be fores~n. Without knowing the size of a pipe to carry water or sewer, at a point in time when these facts are known, the comp plan will be revised to reflect this in the annual revision. This is a vehicle to be able to ame~i the comp plan Com~i~ioner Dingfidd stated that in the ordinanc~ they are r~o~izing the thr~ party agreement. She asked if they were taking action on that or is it merely the comp plan amendments? Mr. Wyatt said that they are dealing on the Planning Commission level with the comp plan and zoning code amendments. The thr~ party agr~ment itself is one of the re~ns why this has been res~hedule so many times, because the parties involved could not come to a conclusion in regards to what they all wanted. They are now at a point where they are pretty close to being able to sig~ off and move forward. Commi~sioaer I)ingfieid asked if they would be taking a~tion on the two separate ordinances tog~er or separately? Mr. Palmer stated that the Planning Commission should take separate action on each ordinance. ~'lannintJ Comrni.~ion nfr~J Autju~l; 1. 2000 ffa~ 2 of ~ Commissioner Dingfield felt that the Commission might require more information on the Mixed Use District ordinance that on the other. Mr. Wyatt said that the staff had gone through ail sectiom and asked themselves if this effected the annexation, and does it effect the comp plan in regards to the Port Blakely project? What will it do in regards to any kind of zoning amendments? How is each section (housing capital facilities, utilities, etc.) going to be effected if the plan is adopted. If any item was effected, it is reflected in the document that the Commissioners were provided. He stated that the more specific the answer to equations are based on after the property is annexed and the master plan has a complete environmental review, development agreements are in place to start developing the actual construction on the project. At that point in time the elements (Capital Facilities Plan, utilities, wastewater, etc.) that are more hard-lined figures, will be brought before the Planning Commission on a one time a year basis. The reason that they have been able to come before thc Commissioners now (out of the annual schedule) is because the state law allows the opportunity to amend the comp plan if it is in the initial adoption ora sub-arm plan through a joint planning effort through the county and the city. Mr. Wyatt indicated that there are certain sections under utilities, etc., that refer to very specific areas in the sub-area plan itself that state there is no reason to reiterate because they have referred right back to the version 2.3 dated 8-26-00. This is a negotiated posture that they have with the owner and their various attorneys, including City staff. Commissioner Kosusko asked if the sub-area plan becomes part of the comp plan or is it an appendix to it? Mr. Wyatt said that it becomes a part of the comp plan, and that there are certain pieces in it that will act as an appendix. The implementing tools will be the change in the zoning, creating a zone to be able to facilitate the mixed use development (which is now being called a mixed use district). The development seemed to be a bit confusing with some of the other terminology, so it was determined to call it a mixed use district that could be placed just about anywhere in the zoning map, pending certain satisfactory criteria. The sub-area plan then becomes part of the comp plan. At a point in time where they actually go through the comprehensive revision, which is required every five years, they will incorporate the Port Blakely sub-area plan as an appendix at that point. Certain language will be taken out of it and put fight into the language of the comp plan. There will be certain parts of the language that will be right in the comp plan that could be lifted for other developers to come in and utilize the same comp plan and zoning amendments. Commissioner Kosusko asked if the Commissioners accept this ordinance and pass it on to the City Council, in the future if someone calls and asks for a copy of the comp plan, will they get a copy of the sub-area plan also? Mr. Wyatt indicated that the sub-area plan would be included with copies of the comp plan as a full packet. This is all public record. ?lannin~j F. ommio~ion rn~ Au~ju~r. 1. 2000 ?a~j, 3 of b Mr. Palmer added that this would be similar to the Harrison District Plan that was completed a few years ago. That has been enfolded into the comp plan and is essentially a complete document that is reproduced when the comp plan is given out. Eventually they will consolidate ali of these and integrate them to produce one package. Commissioner Dingfield asked which volume of the sub-ama plan is the official draft? Mr. Wyatt indicated that the Commissioners have the latest version. The July 26~ date is the most current. Volume I has been changed extensively, while Volume II remains the same as an appendix of various letters/correspondence, etc. Commissioner Kosusko asked if Mr. Wyatt could discuss the population allocation. Mr. Wyatt stated that early on in the comp plan and the GM/k, the City demonstrated to the county and the state that they had a certain capacity of growth over the next 20 years, which was 20,000 people. This was in addition to the 38,000 estimate at that time. The comp plan had been passed with the county's plan, which had gone through the whole GMA heatings board. In that plan there were certain populations that were allocated within various zones within the City. There had been a project in the downtown area allocating a certain population grown in the Central Business District (CBD). As a result of market trends and the economic development that did not occur, several players saw an opportunity to develop a piece of property which had already been designated as an urban reserve (future or current allocations). To facilitate the transfer of a certain population from one area to another, there has been a allocation proposed to take a certain amount out of the four major areas of the City of Bremerton and reallocate this population to the Port Blakely community. There has been quite a bit of negotiation over that. He believes that the County also has additional allocation which have not been appropriated to the various Urban Growth Areas of Kingston, Bainbridge Island, Port Orchard, Silverdale and Bremerton. To facilitate moving forward, they reallocated certain numbers of population that were basically distributed to our areas to the Port Blakely area and reduced by 84% (3,500 people) of the population that was allocated for the downtown area (to the Port Blakely sub-area plan). Mr. Palmer explained that this population was originally scheduled to go into the CBD area. There were a number of different things that did not happen that caused us to be in a position where they could reallocate that population. Sinclair Landing did not happen, they have gone through a number of abatement projects to get rid of housing stock that was deteriorated, and also the Gateway project took out quite a few homes. They came up with a number of 3,500 population which is the equivalent of what would be required to support between 900 and 1,200 housing units in the Port Blakely development. The County also had the option to allocate population (out of the year 2014 forecast) out of pool of 60,000 unallocated population forecast numbers to Port Blakely. There was an additional process to go through with the Sub-Regional Council in order to have an allocation from the County. It was more expeditious to reallocate the units within the City of Bremerton. Mr. Wyatt stated that they believe that il' Port Biakely Communities is thc impetus to drive interest in the downtown corridor again, they feel that the avenue exists for them to go back to the Fla..in~jCommi~io~,mr~^uous~.l. 2OOO?ao~4o~g, <~~ Growth Management Board and the County to request additional allocation out of the reserve fund. They strongly believe this exists. Mr. Palmer noted that the population forecast is an important issue. Heather Ballash, Department of Community Trade and Economic Development (CTED) had raised that concern back in March. They have remained consistent in their concerns about population reallocation. The City hired Shapiro and Associates to look at the population capacity analysis in 1993. It was their recommendation that they take out of the Central area and move it to Port Blakely. Commissioner Dingfield asked if the Commission would be dealing with the two ordinances separately and making separate decisions. She also asked if they would be taking public comment on both? Mr. Palmer recommended that the Commission take public comment first on the Comp Plan, and then a presentation will be made on the zoning changes with public comments. He added that he had a comment from the Suquamish Tribe and the issue of how much residential development should occur in thesub-area plan. When this is reconciled with the City Council and the Board of County Commissioners, that number will be reflected in the comp plan and the population assessment. Mr. Wyatt summarized that the Commission has the culmination of many hours of negotiation to move this project forward in the interest of economic development for the City of Bremerton. Call to the Public - None. Mr. David St. Pierre, Assistant City Attorney, provided an e-mail letter sent to the legal department from the Suquamish Tribe, describing their concerns for this project. Mr. Palmer stated that he discussed the zoning ordinance notice with Mr. St. Pierre. They do not feel that the notice was clear and specific. This matter will be advertised for the August 15, 2000 meeting, which will still be in time for the City Council to consider the Commission's recommendation. Closed to the Public Chairman Griggs asked what authority the Suquamish Tribe has regarding this development? Mr. St. Pierre stated that the Growth Management Act requires local government to coordinate and bring in all interested parties and stakeholders in the deliberation. The local government is the jurisdiction that has the authority to make the final decision. The public process requirements of the RCW require that you give notice and allow them to comment at that point. The only requirement that the City of Bremerton and the Planning Commission must follow. They have been given adequate notice. If they disagree with the decision, that is up to them and they can take that through other avenues. As long as the City has done what it is required to do undcr thc RCW, the Tribe or any other interested individual or stakeholder, has no authority. It is only the Planning Commission and the City Council that has the authority. Mr. Palmer added that the Tribe was involved in the joint planning for the Port Blakely sub-area so they are vested. The Chico Basin area is, in the Tribe's opinion, the premier salmon producing area. They are vitally concerned about what type of development goes on there. The early negotiations with the Tribe got the City/County to the point where they were satisfied that 300 of the 440 acres could be developed for industrial purposes. The Tribe became concerned when it went from a pure industrial development to mixed-use. They began raising concerns, as reflected in their letter dated June 9, 2000. Mr. Wyatt pointed out that the letter was written in June. He asked if Port Biakely Communities has withdrawn their boundary to make some assurances in the Dickerson Creek area? Mr. Palmer stated that Port Blakely took everything out of the Dickerson Creek area to get to the 300 acres so there is no impact. That is why the Tribe was originally supportive of the project as a total industrial facility. The Tribe started raising concem about residential in an industrially developed area~ Mr. Wyatt again stated that this letter is dated June 9~ and that Port Blakely Communities has made concessions to this letter. They had talked about increasing the stormwater management program for Kitsap Lake as well. A motion was made by Commissioner Dingfield to adopt the draft ordinance as outlined in the 7.28 (Final) draft and seconded by Commissioner Moshay. Commissioner Dingfield stated that she appreciated what the Tribe was saying in their letter. She was interested in finding out where developers hit their critical mass. Mr. Wyatt stated that Bremerton is unchartered waters and you would have to have a crystal ball. Mr. Palmer said that often times the mixed use is based on a model that a developer has seen developed elsewhere. One of the models that Port Blakely has in mind is the Intel Campus in the Dupont, Washington area. They also have experience in the Issaquah Highlands area with mixed use development. There needs to be a synergistic development where residential, commercial and industrial can all co-exist. Commissioner Boyd felt that it was interesting that the addition of residences seems to bring opposition. Commissioner Kosusko stated that industry is highly regulated, and single family residences are not. Chairman Griggs asked for a vote. Commissioner Boyd, yes; Commissioner Dingfieid, yes; Commissioner Kosusko, yes; Commissioner Moshay, yes; Chairman Griggs, yes. Motion passes. Flannln0 Commio*ion rnr. xj Auou'~r.;. 1, 2000 ?ao, 0 o~:/5 Commissioner Dinglield stated that she would like the project, as it annexes into the City of Bremerton, to have their name changed to reflect more of a "Bremerton or Kitsap Lake" identificmJon, it would help residences to steer away from the "Central Kitsap" concept. Mr. Wyatt noted that Port Blakely Community has already raised this concern at a meeting last week. The Planning staff and the legal office has also raised this concern. They had to develop one name. It has been referred to as the Port Blakely joint planning area sab-area plan. Once they get a project for the sub-area plan, they can call it whatever they want. Mr. P~imer had provided material to the Commissioners that is introducing a new zone, MXD. When the zone is introduced, it has a ripple effect in the other parts of the zoning ordinance. Mr. Wyatt has shown them where the ripples are and how the new zone integrates into the rest of the Bremerton Municipal Code. Mr. St, Pierre stated that the Commissioners could hear the following information, but he recommended that they should not take action on it, as it had not been noticed to the public. Mr. Wyatt indicated that once the City Council, the County and Port Blakely finalize all the documents pertaining to the comp plan and adoption of the sub-area plan, there are certain provisions in the amendments that, in order to implement, you have to make amendments to the zoning code. They looked at the various sections in the zoning code and the implications that the passage of the amendments to the comp plan and the adoption ofthe sub-area plan would have. There was not a singular zone in the existing code that allowed them to do a mixed use development. They tried to create a logical zone. They expanded the language to enable the visions of the Port Blakely sub-area plan to come to some kind of fruition in terms of the development of the project itself. This zone enables them to do that. C. Meeting: None. D. Study Session: None. V. Business Meeting A. Approval of Minutes: The minutes from the July 18, 2000 meeting were approved as presented. B. Director's Report: Mr. Palmer passed out a revised "Project: Zoning Ordinance Rewrite - Schedule of Events." The Mayor had talked with him regarding priorities. They would like to see the zoning code more "user friendly." He feels the code is not in good organizational condition. It is an ambitious undertaking to rewrite the zoning code, and it is not simple and not done quickly. He recommended a panel committee to dral~ the ordinance. The work will be done in DCD, with assistance from the legal office. He would like to have representatives from City Council, Planning Commission, the technical community, the public at large, planning and lesal staff. He foresees 9-10 members on the committee. He received one volunteer from the last meeting and one possibility. He asked again if anyone else was interested in joining the committee. ~ Mr. Palmer would like to begin the committees on August 15"', then meeting every other week. He stated that hopefully by February it would be put together to take to public meetings (possibly later than February). He also has been working with a consultant for the downtown area in regards to the City/County building. Chairman Griggs indicated that he would be interested in being on the Committee. Commissioner Kosusko stated that he could not commit to being full time on the committee, but would act as a back-up. He also asked if Mr. Palmer had spoken to Mr. Hecker about being on the committee. Commissioner Dingfieid recommended contacting Mr. Bill Robinson, a former Planning Commissioner member. Mr. Palmer said that he has been in contact with an engineer. He would also like to contact someone from the real estate field. This would be a great opportunity to see the code go together and se~ what type of a community it could make. C. Old Business: D. New Business: None VI. The urbanized portion accounts for about one-fifth of the sector and includes all areas west of National Avenue and Oyster Bay, the West Park and Jackson Park communities, the Naval Hospital, NAD Park, the developing Pendergast Sports Complex, Kitsap Lake, the City's sewage treatment plant, SR-3, and other points of interest. On the urban fringe are operating gravel extraction operations and undeveloped hills. The non-urbanized 4/5 of the West Sector consists mostly of City Utility-owned forest lands, the City's Union River Watershed, Gold Mountain Golf Course, and some smaller facilities. Also included in this sector, but physically separated, is the Anderson Creek utility lands east of Gorst and south of Sinclair Inlet. In December 1994, a portion of the Anderson Creek area (approximately 340 acres) was declared to be surplus utility land and has been designated for industrial use on the Comprehensive Plan. Ali lands were inventoried and existing uses and residential densities were determined. Only lands within the City limits or in City ownership will be addressed, with the understanding that Kitsap County will produce a consistent and coordinated land use plan for all unincorporated areas. It represents the community's policy plan for the next 20 years. The GMA requires: A housing element recognizing the vitality and character of established residential neighborhoods that: (a) Includes an inventory and analysis of existing and projected housing needs; (b) Includes a statement of goals, policies and objectives for the preservation, improvement, and development of housing; (c) Identifies sufficient land for housing, including, but not limited to, govemment-assisted housing, housing for Iow-income families, manufactured housing, multifamily housing, and group homes and foster care facilities; and (d) Makes adequate provisions for existing and projected needs of economic segments of the community. The Housing Element has also been developed in accordance with adopted Kitsap County-wide Planning Policy, and has been integrated with all other planning elements to ensure consistency throughout the comprehensive plan. The Housing Element specifically considers the condition of the existing housing stock; the cause, scope, and nature of any housing problems; and the provision of a variety of housing types to match the lifestyles and economic needs of the community. This element examines special housing needs, such as Iow-and moderate-income family housing, foster care facilities, group homes, manufactured homes, government- supported housing, and historically significant housing. The Housing Element includes the following sections: ¥? 1. INTRODUCTION 2. GOALS, POLICIES, AND STRATEGIES 3. EXISTING HOUSING CONDITIONS 4. FUTURE HOUSING NEEDS Additional background information is compiled in Appendix G of the Comprehensive P~an. The City's development regulations (zoning, building codes, etc.) establish how the development and construction of housing and other development will take place. The Housing Element establishes both the long-term and short-term policies to meet the community's housing needs and achieve community goals. The Housing Plan in this element will guide decision making to achieve community goals as articulated in the Vision for Bremerton (Element B). INTRODUCTION Text on UTILITIES - Page I and 2 is herein amended to read: This Utilities Element has been developed in accordance with Section 36.70A.070 of the Growth Management Act (GMA) to address the utility services in the City of Bremerton and adjacent urban growth area. The GMA requires: A ub'lities element consisting of the general location, proposed location, and capacity of all existing and proposed utilities, including, but not limited to, electrical lines, telecommunication lines, and natural gas lines. The' Utilities Element represents the community's policy plan for growth over the next 20 years. The element describes how the goals in the other plan elements will be implemented through utility policies and regulations, and is an important element in implementing the comprehensive plan. The Utilities Element has also been developed in accordance with adopted Kitsap County-wide Planning Policy, and has been .integrated-with all other planning elements to ensure consistency throughout the comprehensive plan. The Utilities Element specifically considers the general location, proposed location, and capacity of all existing and proposed utilities. The element also identifies general utility corridors. The Utilities Element Includes: · INTRODUCTION · GOALS AND POLICIES · INVENTORY, ANALYSIS AND FUTURE NEEDS The Urban Growth Area (UGA) boundary was selected in order to ensure that urban services will be available to'all development. This includes the provision of utility facilities. The City recognizes that planning for utilities is the primary responsibility of the utility providers. However, the City will incorporate plans prepared by the providers into its comprehensive planning efforts in order to identify ways of improving the quality and delivery of services provided in the City and its designated urban growth area boundary. All development requiring urban services will be located in the UGA, and will have these services extended to them in a timely and financially feasible manner. The Utility Plan in this element will guide decision making to achieve the community goals as articulated in the Vision forBremerton (Element B). Th~_ :=~lnnfinn nf n ~lsh-nre.
