Box 47600 · Olympia, Washington 98504-7600 (360) 407-6000 · TDD Only (Hearing Impaired) (360) 407-6006 July 7, 2000 Mr. Eugene Sampley, Director Public Works and Utilities City of Bremerton 239 Fourth Street Bremerton, WA 98337 Dear Mr. Sampley: Congratulations to you and your community for having a top performing wastewater treatment plant! The Washington State Department of Ecology is recognizing the Bremerton Wastewater Treatment Plant with a ! 999 "Outstanding Wastewater Treatment Plant" award. Ecology is recognizing approximately three dozen domestic wastewater treatment plants in the state for being in 100 percent compliance with their discharge permits in 1999. The permit places limits on the quantity and concentrations of contaminants that treatment plants may discharge. We evaluated the treatment plants for compliance with effluent limits, monitoring and reporting requirements, spill prevention planning, pretreatment, and other regulatory activities. We are proud of the team effort that your staff performed day in and day out. It takes dedication for daily operation and maintenance and engineering and administrative support to ensure outstanding compliance. Your facility's operator staff played a key role in operating and maintaining the treatment system, performing laboratory analysis, and keeping daily monitoring records. Qualified operators are critical for successful plant operations and the protection of good water quality. We are thankful to your community for the priority and efforts you are taking to protect water quality for people and fish. We would like to present as many "Outstanding Wastewater Treatment Plant" awards as possible at city council meetings or other public events. Please contact Judith Paulsen at (425) 649-7105 by July 31 if you would like to schedule an award presentation. Thanks again and congratulations! SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION: In November of 1999, an abatement order was posted on the property located at 241 S. Cambrian due to unsafe conditions on the site. The house was abandoned, fall of garbage and debris, and inhabited by vagrants. Due to a lack of response by the owner, the City boarded the house to prevent entry on December 13, 1999. Conditions at the property worsened, with vagrants removing the boards and occupying the structure and more garbage and debris appearing in the yard. All attempts to contact the owner were unsuccessful and the certified copy of the abatement order was returned by the Post Office as "unclaimed". The house and two detached garages were demolished beginning on May 3, 2000. The fees incurred for this action totaled $16,192.91. Council must now decide if the fees are just and reasonable and how they should be collected. RECOMMENDATION: I move that Council pass Resolution #~L-~ (~ ]., ordering that the fees incurred for the abatement of 3 dangerous structures located at 241 S. Cambrian Avenue be collected as reasonable abatement costs and become a lien against the property. 9. WHEREAS, the City of Bremerton incurred costs for demolition of 3 dangerous structures on the property located at 241 S. Cambrian Avenue; and WglEREAS, the Uniform Code for the Abatement of Dangerous Buildings, as adopted by the Bremerton Municipal Code, allows the City to recoup these costs either by personal judgment against the property owner or as a lien against the property; and WltEREAS, the City Council is charged with determining whether the fees are just, and how they should be collected; and has considered the report ofcbarges filed by the Building Official and any protests or objection filed; and WHEREAS, the Building Official of the City of Bremerton recommends the fees be collected as a lien against the property located at 241 S. Cambrian Avenue, now, therefore, BE IT RESOLVED, by the City Council of the City of Bremerton: 1. That the abatement charges included in the report of the Building Official in the amount of $16,192.91 for the property located at 241 S. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION' Ordinance g4584 declares that it is unlawful and a nuisance to allow, continue, or maintain grass and weeds exceeding twelve (12) inches in height, shrubs, brush, vines or trees which constitute a fire hazard or provide a harborage for rats, rodents or horticultural pests, or noxious and poisonous plants. The listed properties are currently in violation of the ordinance and pursuant to Section 9.14 of the Bremerton Municipal Code, Council is asked to approve the removal of the nuisance vegetation on the property and collection of the costs incurred by personal judgment against the owner and a lien against the property. RECOMMENDATION: I move that Council pass Resolution # ~--}~--, ordering that the nuisance vegetation on the properties identified by the attached listing be removed by the City with fees incurred collected as reasonable abatement costs, which shall become a personal judgment against the owner and a lien against the property. 9. IMPACT OF NON-PASSAGE: Ordinance ~4584 would not be enforced and nuisance vegetation would continue to thrive in the City of Bremerton. 6. IMPACT ON STAFFING~ BUDGETS, FACILITIES~ EQUIPMENT OR OTHER RESOURCES: The City's revolving abatement fund would suffer the deficit of not collecting these funds. 7. RESEARCH SOURCES: N/A A RESOLUTION approving nuisance vegetation abatement on the listed properties and determining means of collection of costs incurred for its removal. WHEREAS, the City of Bremerton passed ordinance ff4584 in February of 1997, which declares certain vegetation a public nuisance, a fire hazard and a menace to public health, safety and welfare and requiring its abatement; and WHEREAS, Section 9.14 ofthe Bremerton Municipal Code allows the City to remove nuisance vegetation and recoup the costs by personal judgment again~ the property owner and as a lien against the property; and WHEREAS, the City Council is charged with dete~n;ining whether the vegetation is a nuisance and whether it shall be removed and has considered the report filed by the Building Official and any protests or objections filed; now therefore BE IT RESOLVED, by the City Council of the City of Bremerton: 1. That the vegetation shown to exist on the listed properties is a nuisance. 2. That the City of Bremerton will exercise its fight to remove said nuisance vegetation and recapture abatement fees by pursuing a personal judgment against the property owner and filing a lien against the property.
