PUBLIC RECOGNITION
Lena Swanson commended the City for the Bremerton Transportation Center, and was delighted the
fast ferries were back. However, she voiced her concern over the lack of access to the ferry terminal,
which is a building that is supported by tax-dollars, and lack of a duo-unloading lane.
Susan Brown commented on an editorial in a recent edition of The SUN regarding the fast foot ferry;
in addition to an article in The SUN today, which indicates the Ferry System has known all along that
there were problems with the wakes, and "made promises they could not keep".
Paul Drnjevic stated that he is looking forward to the Armed Forces Day activities, and asked if the
City is going to take measures to earthquake-proof the City parking garage at 4th & Washington.
Pat Wright, Chairman of the Year-2000 Armed Forces' Festival Committee, discussed several
activities and events planned for the weekend of May 19-21, 2000.
Don Larson questioned why the City of Bremerton does not have a waterfront hotel.
To accommodate the advertised 6:00 P.M. start time for the Public Hearing in the published LEGAL
NOTICE, Item 11(A) was moved up on the Agenda...

COMPREHENSIVE PLAN, #AB00-115: Interim Community Development Director Bill Palmer
reported that the 1999 Comprehensive Plan Amendment includes four Map re-designation requests
for Plan & Capital Facilities Updates. Alt exhibits (except "Exhibit A") were passed at first reading on
April 26, 2000. "Exhibit A' is now submitted for first reading of its portion of the proposed Plan Map

of properties on or adjacent to Kitsap Way and Weslon Place. They propose a change from Plan
Map designation "Low-Density Residential" (LDR) to "General & Highway Commercial" (C-G); and
Zoning Map designation change from "Single-Family Residential" (SF-3) to "General Business" (GB)
for six lots and portions of another four lots located adjacent to Kitsap Way, and on either side of
Weslon Place, at least 200 feet from the Ordinary High Water Mark (OHWM) of Oyster Bay. The
change in the boundary line was pointed out, as well as the number of lots being considered.
Those who spoke in-favor of the proposed rezone:
Roger Nance, one of the applicants, who also read a letter from Norma Moon; Brad Hail; and W__,.
Earle Smith, (who added that he was President of the Economic Development Council (EDC) of
Kitsap County when Mr. Nance & Mr. Targett first applied for this rezone. He stated that he thought it
was a "win-win" situation then, and he still believes it now).
Those who spoke in-opposition to the proposed rezone:
Owner of Lot 22; Michael Gawenka; B.T. Holland; Vir_aina McBride, who also read a letter from
Frederick H. Salmele; Suzarlne Holland; Carlos Mont_oomery; Helen Miller; a letter was included
in the record from Charles Taylor: and at the author's request, an additional letter read was read into
the record from David &Joe, nne Forbes.
Glenna Malanca clarified that there is no specific project before Council tonight; that courts have
ruled that comprehensive plan amendments are legislative, not quasi-judicial; and verified that the
group of letters opposing this rezone have indeed been included as part of the official record. She
further stated that there would be additional opportunity for opinions to be voiced at the time a
specific development project is proposed. Lastly, she addressed the issue of "spot zoning".
Mr. Esser. asked to clarify several issues, including water quality of Oyster Bay, and whether an
easement to the water is included on lot 17. Victor Targett stated that long ago, there was an
easement, and provided history on that issue. Mr. McConnell added that when a project is
proposed, all City requirements must be adhered to.
TAPE #1703
Mr. Shepherd asked if a rezone would address the issue of the "character of a neighborhood". Mr.
palmer responded yes, that the affects of a neighborhood are included in the process.
Mr. Reed voiced his comments, stating that as a 25-year resident, he would also like to preserve the
pristine area, but also supports a viable community. He does not feel this rezone would adversely
affect the neighborhood.
#0187 M/S/C/U (Shepherd/Reed) Move to approve on first reading, an ordinance regarding the 1999
amendment to the Comprehensive Plan and Map by approving: The "Nance-Kitsap Way / Weslon
Place Amendment" which changes a portion of the Map from "Low-Density Residential" (LDR) to
"General & Highway Commercial" (C-G). Said Map Amendment affects property located on the north
side of Kitsap Way approximately 350 feet on either side of Weslon Place. Specifically, the property
involved lies in the Southeast quarter of Section 16, Township 24 North, Range 01 East, W.M. and
includes all of tax parcels numbered 023,024, 025, 026, 034, 035, 036, and 075. Subject to a lawful

CARLOS MONTGOMERY TO THE PARKING ADVISORY COMMrl-rEE. #AB00-110: Mayor
Horton reported that there were four vacancies on the Parking Advisory Committee. The purpose of
this committee is to hold hearings on appeals. This committee has not met for several years, but now
has an appeal that needs to be heard. It is recommended that Klaus Golombek, Carol Atkinson, Pat
Wdght, and Carlos Montgomery be appointed to this committee.
There were no comments from the public.

9B - TRAFFIC SAFETY PROJECT AND WASHINGTON TRAFFIC SAFETY COMMISSION
GRANT, #AB00-111: Administrative Analyst Tim Sholtis reported that the City applied for, and
accepted the Washington Traffic Safety Commission Traffic Safety Grant funding of $50,000. The
City is not required to match funding. The funding will be used towards supplemental bicycle safety
and pedestrian education programs at the new State ferry terminal, developing a traffic-records
program, and to purchase a radar box, reader, and trailer.
There were no comments from the public.
#0440 M/S/C/U (Reed/Farr) Move to approve applying for funds, and administering the project
according to the agreement.
10A- ORDINANCE NO. 4703 {SECOND READING) ESTABLISHING NEW ON-STREET PARKING
REGULATIONS IN THE DOWNTOWN CORE; AMENDING CHAPTER 10.11 OF THF
BREMERTON MUNICIPAL CODE, #AB00-108: The first reading of this ordinance was heard at the
Council Meeting on May 3, 2000.
Kenneth McGuire understood the re-park problem, but voiced his concern over the one-hour limit.
He believed that changing the time to only one-hour is contradictory to the community and its goals.
Mr. Rollman stated he was proud to have served on this committee, and pointed out there are still
areas downtown with two-hour limits.
Mr. Esser asked what the time-line was for this temporary plan. Pat Wright stated implementation is
expected June 1, and will be monitored for the next 3 to 6 months.
#0840 M/S/C/U (FardReed) Move to pass on second reading Ordinance No. 4703, establishing new
on-street parking regulations in the downtown core; and amending Chapter 10.11 of the Bremerton
Municipal Code.

10B - ORDINANCE (FIRST READING) RELATING TO THE CLOSURE OF ANDERSON STREET
TO VEHICULAR TRAFFIC BETVVEEN BLOOMINGTON AVENUE & OLYMPIC AVENUE, #AB00-
112: City Engineer Randy Witt reported that staff recommends closing Anderson Street to vehicular
traffic between Bloomington Avenue and Olympic Avenue. The Department of Community
Development sponsored a neighborhood program to address community needs in the area,
including development of the Dr. John P. and Susan J. Matan Community Garden & Park
immediately north of the proposed street closure. The Traffic Safety Commission reviewed the
request for this street closure at its meeting of February 17, 2000. The commission concurred with
recommended closure for that portion of Anderson Street to vehicular traffic.
There were no comments from the public.
#0995 M/S/C/U (Farr/Reed) Move to approve ordinance on first reading, to close Anderson Street to
vehicular traffic between Bloomington Avenue and Olympic Avenue.
10C - ORDINANCE (FIRST READING) ESTABLISHING A ONE-WAY STREET ON A PORTION
OF SECOND STREET, EAST OF WASHINGTON AVENUE, #AB00-113: City Engineer Randy Witt
reported that staff recommends establishment of a one-way street on Second Street between the
eastedy terminus and the alley between the easterly terminus and Washington Avenue. Currently,
Second Street is designated for two-lane, two-way traffic, with parking on the south side, however,
with construction of the Bremerton Transportation Center (BTC) currently under way, parking has
been removed, and three lanes are used for bus traffic to the temporary bus area and traffic exiting
the adjoining parking lot. With completion of the BTC, the City will be reclaiming the bus area for use
as a parking lot. Additionally, with construction of the BTC, the former "Kiss & Ride" area at the end
of First Street is no longer available, and a new area needs to be designated. The City proposes to
provide for "Kiss & Ride" activity on the north side of Second Street. Creating the one-way street
configuration on this portion of Second Street will facilitate circulation and access to the "Kiss &
Ride" spaces. RCW 41.61.135 authorizes the City Council to designate one-way streets in the City.
Staff recommends designation of the one-way street on a portion of Second Street.
Bob DuPrie, Manager of Diamond Parking, representing and speaking on behalf of the owners of a
parcel of property in the area, stated the ownership group is still in the process of deciding there
stance on this plan, but did agree there may be a problem with limited access, and also possible
adverse affects to the value of the property. Mr. Witt discussed the plan in further detail, and felt it
would work, however described possible alternatives or changes in the plan.
Carlos Mont.qomery asked if angled-parking would be reinstated on a portion of 2°d Street. Mr. Witt
said no, because the angled-parking was switched to the other side of the street, without the break
of the alley, more parking was gained. In addition, with the "Kiss & Ride", the parking slots are
pointing in the right direction.
Mr. Law was irritated that the City would have to give up about 16 spaces (which added up to about
$15,000 to $20,000 per month in parking revenue), and resented the State Ferry system and Kitsap
Transit, as the designers of the plan, for not planning the Kiss & Ride (K&R) area to be on their own
property. He asked if Kitsap Transit could handle the K&R drop-off; and if not, could the K&R be
moved to a lower area, because it would be an insult to the "walkers" to pass all of the parked cars
TAPES #1702 & #1703

there have been continuing discussions on where to locate the Kiss & Ride, the parking plan was
developed envisioning the K&R on the north side of Second Street. Whether or not it stays there, the
ability to circulate traffic through the area is the element that is critical. Mr. Law responded that the
K&R issue should have been stricken from the proposal presented to the Council.
#1440 MISICIU (Rollman/Reed) Move to approve ordinance on first reading, establishing Second
Street as a westbound, one-way street from its easterly terminus to the alley between the easterly
terminus and Washington Avenue.
10D - ORDINANCE (FIRST READING) ESTABLISHING ON-STREET PAID PARKING ON FIRST
STREET FROM RAINIER PLACE TO NAVAL AVENUE, #AB00-114: City Engineer Randy Witt
reported that staff recommends establishment of on-street parking along the south side of First Street
adjacent to Naval Station Bremerton and Puget Sound Naval Shipyard from Rainier Place to Naval
Avenue. Providing an estimated 40 on-street parking spaces at this location will help alleviate the
parking shortages in the Naval Station Bremerton and Puget Sound Naval Shipyard, as well as
surrounding neighborhoods. Revenues from this parking will go to the Street fund. Currently, First
Street is a two-lane, one-way (westbound) street. With the addition of the on-street parking, First
Street will be reduced to a one-lane, one-way street in the westbound direction. This reduction to a
single traffic lane is not expected to impact the traffic flows through the area any may reduce vehicle
speeds on the street. Pursuant to WAC 308-330-270(6), City Council can establish paid parking
areas in the public right-of-way by passage of a resolution; the City Charter requires use of an
ordinance. Staff recommends approval of an ordinance establishing paid parking on First Street from
Rainier Place to Naval Avenue.
There were no comments from the public.
#1543 M/S/C/U (FardMcConnell) Move to approve ordinance on first reading, establishing paid
parking on the south side of First Street between Rainier Place and Naval Avenue.
With no further business, meeting concluded at 8:00 P.M.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
As part of the State Route 304 (SR304) and Bremerton Trahsportation Center (BTC) projects, a one-way couplet
was established on portions of Pacific Avenue, First Street and Washington Avenue south of Burwell Street to
facilitate traffic movement thru the area and to the BTC/Ferry Terminal. This element of these projects was
coordinated with the Washington State Department of Transportation (WSDOT) during the planning and
environmental phases of both projects. With implementation of this traffic circulation element, the designation of
SR304 needs to include the entire couplet. Currently the SR304 designation includes Burwell Street from Callow
Avenue to Washington Avenue, and on Washington Avenue south of Burwell Street to the BTC. Those
designations of SR304 remain, and Pacific Avenue between Burwell Street and First Street, and First Street
bet~veen Pacific Avenue and Washington Avenue need to be added to the SR304 designation. WSDOT has
requested the City to approve a resolution that shows its support for designation of SR304 on portions of Pacific
Avenue and First Street. Staff has prepared a resolution (attached) that supports the SR304 designation and
recommends the City Council approve it.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
In recognition of the Bremerton Rotary Club's generous offer to support the expansion and
development of Evergreen Park (Phase II) with a $100,000 cash contribution, the Club is requesting
that "Evergreen Rotary Park" be the name given to the consolidated present and future park
properties. The commitment of these private funds was critical to the success of the Parks and
Recreation Department's grant application for $300,000 of state funds that were awarded to the City
by the Interagency Committee for Outdoor Recreation.
The Club's cash contribution has been earmarked for the construction of park improvements such as
picnic shelters, trails and open spaces that will be developed following the ecological remediation of
the site that is currently underway.
Representatives of the Bremerton Rotary Club submitted their request to the Parks and Recreation
Commission on Tuesday, April 25, 2000. After due consideration, and in accordance with the City
policy for naming parks, the Commission voted unanimously to support the request and to
recommend approval by the City Council.
8. RECOMMENDATION:

I I. ANALYSIS
2 Plaintiff asserts two bases for objection to thc Report and Recommendation, both of which are
3 without merit. First, plaintiff argues that it is entitled to litigation expenses pursuant to the Second
4 stipp-l~rffeh-tal Report and Recommendation and the Clean WaterAx:V. Second, plaintiff argues that in
5 calculating the recommended award of fees, Judge Martinez used an inappropriate attorney fee rate.
6 A. Litigation Expenses
7 In support of its claim for litigation expenses, plaintiff points to a section in Judge Martinez's
8 Second Supplemental Report and Recommendation dated April 2, 1999, which states that "the
9 depositions were necessary for [plaintiff] to adequately prepare for the hearing, and recovery of such
i0 expenses is appropriate." Second Supplemental Report and Recommendation at 4. However, it is clear
11 from a review of the Report that Judge Martinez was referring to attorneys' fees and not to additional
12 litigation expenses. This language appears in a section of the Report entitled "Motion for Attorneys'
13 Fees." Furthermore, in the most recent Report and Recommendation, dated March 21, 2000, Judge
14 Martinez himself states that the Court's Order adopting the Second Supplemental Report and
15 Recommendation does not provide for the recovery of litigation expenses. See Report and
16 Recommendation at 3.
17 in further support of its argument for an award of expenses, plaintiff asserts that the Clean Water
18 Act establishes a statutory right to a prevailing party's recovery of expenses. However, plaintiff
l 9 overlooks the language of the Act which states that the Court "may award costs of litigation ... to any
20 party, whenever the court determines such award is appropriate." 33 U.S.C, §1365(d) (emphasis
21 added). The text of the Clean Water Act does not support plaintiff's assertion that it creates a statutory
22 right to recovery of expenses and in this case, the Court does not find such an award to be appropriate.
23 B. Calculation of Attorneys' Fees
24 For its second objection to the Report and Recommendation, plaintiff argues that Judge Martinez
25 calculated the award or' attorneys' fees using an inappropriate billing ratc. On the contrary, this Court
26oRrma- 2 33
- Nestern District: of HashingLon 05/17/00 17:O0 Pa~e ~ of ~ #59~65B
1 finds that the recommended award, which is based on the information plaintiff provided, accurately
2 reflects the amount "actually billed to plaintiff for work on the four designated motions" on which
3 plaintiff prevailed. See. Report and Recommendation at 1.
4 -[E-ORDER _ _
5 The Court, having reviewed the Report and Recommendation of Magistrate Judge Ricardo S.

On May 10, 2000, City Council passed an ordinance establishing on-street parking zones in the downtown
business district. Part of that ordinance established on-street paid parking on Second Street west of Washington
Avenue, on Fourth Street east of Park Avenue, and on the south side of Burwell Street between Pacific Avenue and
Washington Avenue. In addition, the City administration desires to establish the ability to implement on-street
paid parking on Second Street east of Washington Avenue to provide additional parking in the vicinity of the
Bremerton Transportation Center (see attached drawing). Each location will have approximately ten paid parking
spaces, except Second Street east of Washington Avenue, which may have approximately twenty spaces. Pursuant
to WAC 308-330-270(6), the City Council can establish paid parking areas in the public right-of-way by passage
of a resolution; the City Charter requires use of an ordinance. Staff recommends approval of the attached
ordinance establishing paid parking on portions of Second Street, Fourth Street and Burwell Street.

IMPACT ON NON-PASSAGE:
The Downtown Parking Plan as approved by the City Council on May 10, 2000, will not be fully
implemented. The paid on-street parking element of this plan is to provide for long term parking
for shoppers which will be less attractive to shipyard workers or downtown employees. Non-
passage of the ordinance would require the spaces to be designated as one or two hour parking and
a modification to the downtown parking plan.
6. IMPACT ON STAFFING, BUDGETS, FACILITIES, EQUIPMENT OR OTHER
RESOURCES:
Establishing approximately 30 spaces of on-street paid parking is estimated to provide $30,000
annually to the Public Works and Operations division budget.

Dear Mr. Parr:
Thank you for shadng your comments about downtown parking dudng public
recognition at City Council on May 26, 2000. Mayor Horton and our Council
members are acutely aware that parking availability in the downtown core must
be expanded in order for future redevelopment to occur.
We are currently strategizing and exploring options with other agencies on
parking development. Kitsap Transit will be making a presentation at a public
study session on May 31, 2000 regarding the construction of a parking facility
adjacent to the new Bremerton Transportation Center to support waterfront
activities and redevelopment. We are also implementing a revamped downtown
on-street parking plan to make street parking more plentiful and available for
downtown shoppers and patrons.
We hope to see you at the study session on May 31,2000.

Reference Agenda Item 9C:
I am neither for or against this resolution. However I do have a few
questions that I would appreciate answers to before the Council votes to
approve or disapprove.
1. Has each Council Member read and/or understands the provisions of RCW
35.§1 concerning the requirements for an "Urban Renewal Agency"?
2. Has the council previously developed adopted a resolution lAW RCW
35.81.070 and when was that resolution adopted?
Reference agenda item 10A.
1. Is the construction of the proposed office building part of a "Urban
Renewal Plan" as defined in RCW 35.81.010 (17) and has this plan been
formally discussed and approved as required by RCW 35.81.060. If so when did
this occur and is the plan available for review?
2. Reference paragraph 9 of the pre-construction agreement: If the housing
authority assumes no responsibility for the performance of services which are
to be contracted for, who does? It would appear that this is an open book to
accept potential sub standard services before the fact. I would suggest that
this is not a good business or contracting practice. Why is this particular
statement in the agreement?
I am writing this E-mail as I will be unable to attend the meeting tonight
and would appreciate answers to the above so I might be better informed about
this important issue.
Thank you
Sincerely,
Ray Kleven
