l lA - ORDINANCE NO. 4748 (SECOND READING) PROVIDING THAT ALL VIOLATIONS NOT
OTHERWISE DESIGNATED IN THE BMC SHALL CONSTITUTE A MISDEMEANOR (#AB00-297):
The first reading of this ordinance was heard at the Council meeting on December 2'7, 2000.
There were no comments from the public.
#1085 M/S/C/U (Arends/Rollman) Move to pass on second reading Ordinance No. 4748 providing
that all violations not otherwise designated in the BMC shall constitute a misdemeanor.
1 lB - ORDINANCE NO. 4749 (SECOND READING) REVISING CHAPTER 2.49 OF THE BMC
PROVIDING FOR CITY COUNCIL MEMBERSHIP ON INTERVIEW PANELS FOR CERTAIN
EMPLOYEES (#AB00-298 The first reading of this ordinance was heard at the Council meeting on
December 27, 2000.
Larry Dickerson asked that there be mandatory publishing of all Council member's attendance for
Committee sessions and conferences. Paul Drnjevic agreed, and also voiced his support for this
action before Council tonight.
Mr. Fart took exception to the statement noted under "Impact of Non-Passage" that "if this action is
not approved, then Council would continue to have no representation or participation in the selection
of administrative heads and other selected employees of the City prior to City Council confirmation"
because he knows that Council has participated in many selection boards in the past, or have at least
had the opportunity to participate. He did not agree that Council should prohibit Interim appointments
without Council confirmation because the criterion for an interim appointment was not always the
same as a permanent appointment.
Mr. Reed summarized that valuable information would be obtained by having a Council member
present during interview panels, and this action merely puts that direction in writing.
Mr. McConnell was concerned that the members of the Council whom supported this action were
members of the Council did not attend enough of the Committee meetings currently held. Mr.
Rollman did not think this was a fair assumption, and urged that Council support this action because
not only would Council have representation on these interview panels, but would also have a say on
how long an interim appointment would stay.

Mr. Olsen stated that Council has already communicated their direction on this issue and did believe
that an ordinance was necessary. Mrs. Arends expressed her reservations, and stated that although
she agreed with the intent behind this action, she concurred with comments regarding the difficulty of
assigning Council members to committees unless they are each willing to take on their fair share.
Conrad Esser is hoping that the current Council President and Vice-President would be more
receptive to those members of the Council who have full schedules with employment and families.
Ms. Malanca pointed out that as a result of comments from the first reading of this ordinance,
changes were made, and that the City Council confirmation would only be required as a result of a
proposed provisional appointment wherein the individual did not meet the minimum qualifications.
#1770 M/S/C (Reed/Rollman) Move to pass Ordinance No. 4749 at second reading.
Voted in favor of the motion: Rollman, Shepherd, Esser, Reed, and Law
Voted opposed to the motion: Arends, Farr, Olsen, and McConnell
Motion carried: 5-Yes; and 4-No
With no further business, meeting concluded at 6:35 P.M. Council reconvened in the Conference
Room for a brief Study Session on organizational issues.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
Bids were opened on Thursday, December 14~ for design and construction of the Pendergast Park Illumination
project, which includes the lighting of three softball fields, two soccer fields and a 440-car parking lot. A total
of five (5) bids were received for the project (see attached Bid Tabulation). The lowest qualified bidder is Golf
Landscaping, Inc. of Puyallup with a lump sum base bid of $489,800. The total contract, including Washington
State sales tax, is $529,964. The estimated cost for this project was $550,000.
Earlier this year, the City signed an Agreement with the Inter-Agency Committee for Outdoor Recreation (1AC)
to provide a $150,000 grant for this project. Other funding is being provided by Kitsap County ($200,000), FC
Kitsap Soccer Club, the Women's State Soccer Association, Bremerton Athletic Roundtable, the Pendergast
Memorial Committee, and the City of Bremerton's Park Improvement Fund. Ace Paving and the Department of

2. CLEARANCE COMMENTS:
Stan Palmer Construction of Port Orchard originally appeared to be the low bidder for this project. However,
after checking on references for similar sports lighting projects, staffhas determined that Palmer's firm has
failed to meet the minimum qualifications as outlined in the bid specifications. As a result, their bid has been
determined to be non-responsive, and they have been excluded fi.om further consideration for this project.
5. IMPACT OF NON-PASSAGE:
If this contract is not approved by Council, the athletic facilities and parking lot at Pendergast Park will remain
unlighted, and the City will lose the ability to meet exiting community needs or to attract additional revenue-
generating softball and soccer tournaments to the area.
6. IMPACT ON STAFFING~ BUDGETS~ FACILITIES~ EQUIPMENT OR OTHER

As previously outlined for Council in Agenda Bill 00-066 (dated March 8, 2000), any additional maintenance
