The undersigned, CITY OF BREMERTON, a municipal corporation, (hereinafter referred to as the
"Grantor"), for and in consideration of Ten Dollars ($10.00L and other good and valuable consideration, the
receipt of which is hereby acknowledged, does hereby grant, convey, and warrant to CASCADE NATURAL
GAS CORPORATION, a Washington corporation (hereinafter referred lo as Ihe "Granlee"), a permanenl
nonexclusive easement burdening the following described property of the Grantor, located in the:

Tile Grantee is granled the right to construcl, install, operale, n]aintain, prolecl, improve,
repair, and abandon in place a natural gas pipeline or pipelines under, over, through, and across the above
described property. The Grantee is further granted an easement for the nonexclusive right of access to and from
said property for the purposes of utilizing the rights herein granted. The term "pipeline" includes gas lines.

Granlor, on behalf of itself and its agents, invitees and licensees, agrees not to impair or interfere x~ith ~be full use
and enjoyment by the Grantee of the rights herein granted. Without limiting the generalily of the foregoing, lite
Grantor shall not erect any structure within the easement area, or conducl or permit any aclivities v, hich may
impair or inlcrfere with the rights herein granted. The Grantee agrees to hold the Grantor harmless from any
loss, cost, or damage resulting from the Grantee's negligence in connection with die operation or maintenance of
any pipelines installed under or over the easement premises and the Grantor agrees to hold lhe Grantee harmless
from any loss, cost, or damage caused by the Grantor, its agents, inxitees, or licensees from any breach of Ibis
contract. Grantor agrees to cooperate with Grantee to obtain all necessary permits, licenses and go~ermnental
action so that Grantee may enjoy the full use and benefit of this easemenl.
This easement shall be binding upon the heirs, execulors, administrators, personal
representatives, successors, and assigns of the parties hereto.

4. SUMMARY STATEMENT AND REQUIREMENT FOR COUNCIL ACTION:
Cascade Gas Company has requested a ten foot easement across the City's property located on the northeast comer of
17th Street and Warren Ave, tax parcel number 3804-004-006-0107. This request will allow Cascade Gas to place
their new gas main extension under the City's sidewalk at this location instead of in Warren Ave..
8. RECOMMENDATION:
The City Council approve the easement with Cascade Gas Company and authorize the Mayor to execute the
same.

Cascade Gas Company would be required to place their gas main in Warren Ave. This will cause impacts to the
traveling public due to construction.
