year of our Lord one thousand nine hundred and forty, by and between POPE &
TALBOT, INC., a corporation, successor to Puget Mill Company, a corporation
duly organized and existing under and by virtue of the laws of the State of
California, and having its office and principal place of business in the City
and County of San Francisco, in said State, the party of the first part, and
the CITY of BRF~ERTON, a municipal corporation, the party of the second part,
~ITNESSETH :
That the said party of the first part, for and inconsideration of
One and No/lO0 Dollars ($1.00), and other valuable considerations to it in
hand paid by the said party of the second part, the receipt whereof is hereby
acknowledged, does by these presents, grant, convey and dedicate, so far as
its interest may appear, to the said party of the second part, an ~sement
over, along and across the following described property, for the purpose of
laying, re-laying, repairing and maintaining a water pipeline:
The Northwest Quarter of the Southwest Quarter (NWa
of SW¼), Section Thirty-five (35~, To~mship Twenty-four
(24) North, Range One (1) West, W.M., Kitsap County,
Washington,
said pipeline to be located along County Road No. 184 as now established and
~existing, also knovm as the Mission Lake Road.
TO HAVE AND TO HOLD the said premises, the said right-of-way, unto
the said party of the second part so long only as the same shall be required
and used for a water pipeline.
IT IS EXPRESSLY UNDERSTOOD AND AGREED that should the City of
Bremerton at any time cease to use the said land for the purpose of a water
pipeline, that right to the exclusive use and possession thereof shall imme-
diately revert to the party of the first part, its successors and assigns in
interest, and the easement hereby granted shall immediately cease and determine.
No covenants upon the part of the said party of the first part as
to title of said tract of land shall be inferred from the execution of these
presents.
IN NITNESS WHEREOF, the sai~ party of the first part has caused
these presents to be subscribed by its Vice-President and its Secretary, and
its corporate seal to be hereunto affixed the day and year first above written.
