HomeMy WebLinkAboutROCKY PT WATER Resolution No. ~ RESOLUTION OF ROCKY POINT WATER DISTRICT FOR CONVEYANCE OF WATER SYSTEM IN FURTHERANCE OF CONTRACT WHEREAS, Rocky Point Water District No. 12 of Kitsap County is a successor by change of name from Marine Drive Water District No. 12. That said predecessor Water District, on March the 19th of 19§2, entered into a contract with the City of Bremerton, a municipal corporation, calling for the supply of water, providing of services, and conveyance of water system to the City of Bremerton, which conveyance of then existing facilities, occurred under Bill of Sale dated March 7, 1952. That said contract was last modified by agreement dated the 12th of July, 1960, and WHEREAS, the Water District, in consultation with URS Consultants, Inc., of Seattle, Washington, caused from its own resources, to be made improvements to the water system in place within the District's boundaries. The installation thereof having been performed by RT & T Construction Company between July 15, 1995 and December 31, 1995 and WHEREAS, the City of Bremerton, under letter dated May 29, 1996, has requested the conveyance to the City of the additional improvements installed under that program. NOW THEREFORE, it is hereby RESOLVED that the Commissioners of the District shall make conveyance to the City of Bremerton of the system improvements so made by means of Bill of Sale of the form in nature hereto attached. It is further RESOLVED that the %~. of the District is authorized to execute said conveyance on behalf of the District. The Commissioners present being ~ ~. ~c~ and ~ ~¢~z,~ and and voting Yes No Absent ~ is ~+~ / Commissioner BILL OF SALE OF WATER IMPROVEMENTS COMES NOW, Rocky Point Water District No. 12, Kitsap County, and by these terms and presence does herewith convey~ transfer, set over, and assign all improvements of the system made between July 15, 1995 and December 31, 1995 at more particularly identified in Resolution No. &lO~ authorizing such transfer and as more particularly shown on the attached exhibit. These improvements are located within the boundaries of the Water District and are within the West Half of Sections 1, 10, and Township 24 North, Range ! East W.M., Kitsap County, Washington. This conveyance is made in accordance with and subject to the terms and provisions of that certain agreement between the District and the City of Bremerton concerning water supply last modified July 20, 1960. It is a condition to this conveyance and its continued effectivness that the terms and conditions and provisions of said contract or any modification thereof shall be observed. Please advise if you are going to make a recordation of this document with the Kitsap County Auditor. If so, please supply auditors file numbers etc. You should have at hand already a large scale copy of the URS Map of the Rocky Point Water District Water System, January, 1996.
