City Commission of the City of Bremerton.
City Hall
Bremerton, Vv'ash.
Oent ! e~en:
Relative to the proposed lease or sale of a portion
of tt~e property o~ned by the city', bordering' on
Oyster Bay, .~n which numerous valuable springs are
existent, please be advised that this property was
deeded to tl~e City of Charleston, prior to its con-
solidati~n with the City of Bremerton, as a source for
municipal water for said cit~, and the deed accepting
such grant by Ch~rleston positively provides that such
property shall not be used so as to interfere with the
use of 'the springs and wells on said property by the
Grantor. It is my opinion tha~ the city would have no
authority i~o sell any part of th~!s tract without a vote
of the people, and it certainly would be against ~.ublic
policy to convey any part thereof without such
authorization. There is r~o highway or roadwa~~ oYer
this tract, but ther~ is a dedicated street or roadway
along the West side of the trac-~, thirt~ feet wide, w~hich,
I assume, may be utilized by the apwlicants for this
conve,~ance, for their necessary ?urposes.
I wou~.d therefore recommend that the ap~licc~ts be
advised t~.a~ the city cannot dispose of any part of
this tract, but that such street is in existence for
their use.
Yours truly,
