SMSA has held this lease since 2009. A new lease
amendment has been negotiated with SMSA which includes a longer term (20 years) and a pre-paid
fee of$40,000 in exchange for the longer term. The conditions of the lease have been reviewed by
the City's communications consultant and his suggestions incorporated. The agreement is
substantively typical for the industry. The longer lease term allows for a more favorable investment
horizon for the lessee with the potential for additional sub-lessees, and less administrative costs for
the City. The City will also receive 25% revenue sharing per month for sub-lessees that co-locate at
the site—currently there are not any sub-lessees. In addition, the City and American Tower recently
executed a 20-Year $0 lease agreement for the placement of the City's new Flex-net system.
There were no questions or comments from the public...
6:49 Motion was made by Gorman; and seconded by Daugs... Questions and comments were
provided by Daugs, Wheat, Simpson, Gorman, and Younger; with responses provided by Ms.
Monroe...
7:00 M/S/C/U (Gorman/Daugs) Move to approve Amendment No. 3 to the Telecommunications
Facilities Lease Agreement with Seattle SMSA Limited Partnership d/b/a Verizon Wireless; and
authorize the Mayor to finalize and execute the agreement with substantially the same terms and
conditions as presented.
3C —AMENDMENT NO. 1 TO THE LEASE AGREEMETN WITH IGLESIA PENTECOSTAL
VISPERA DEL FIN FOR THE KBRO BROADCAST FACILITY SITE LOCATED AT FOREST RIDGE
PARK: Contracts Administrator Melinda Monroe stated that this proposed lease amendment extends
the agreement that supports the KBRO tower site located at Forest Ridge Park and has provided
broadcasting in this area since 2000. Iglesia Pentecostal Vispera Del Fin has requested to extend
the lease and has been operating and maintaining the station and radio tower successfully. The
broadcast facility was formerly owned by Seattle Streaming Radio and during the term of the
agreement of lease was purchased by Iglesia Pentecostal Vispera Del Fin. This amendment reflects
the assignment of lease to the Iglesia Pentecostal Vispera Del Fin and extends the term for five (5)
years with an optional five (5) year renewal. This amendment maintains the annual increase by CPI
and the rent sharing agreement rate of 50%.
There were no questions or comments from the public...
7:04 Motion was made by Wheat; and seconded by Daugs...
