kAY 18 2011 <br /> DIGITAL RECORDING MWIL <br /> AftWp, <br /> CITY COUNCIL STUDY SESSION MINUTES <br /> May 11, 2011 <br /> A Study Session of the City Council of the City of Bremerton was called to order in the City Council <br /> Conference Room 603, of the NORM DICKS GOVERNMENT CENTER, 345 6 th Street, Bremerton, <br /> Washington, Wednesday, May 11, 2011, at 5 00 PM, with Council President Will Maupin presiding <br /> Council Members present were Carol Arends, Dianne Robinson, Greg Wheeler, Roy Runyon, Adam <br /> Brockus, Cecil McConnell, and Jim McDonald Council Member Nick Wofford was absent Legislative <br /> Assistant Lori Smith was present to provide staff support <br /> President Maupin emphasized that the Study Session was open to the public, however there would <br /> be no opportunities for input or participation, that no action will be taken, and the content of these <br /> items is subject to change <br /> A NO DISCUSSION PLANNED - The following items are budgeted items or have been reviewed by <br /> the appropriate Council Committee, and will be placed on the May 18, 2011 Council Meeting <br /> Agenda <br /> 1 Proposed Public Hearing and Ordinance to vacate an Alley for Olympic College between 13` <br /> & 15 Streets, West of Warren Avenue — Gunnar Fridnksson, Civil Engineer, Public Works & <br /> Utilities, and Jim McDonald, Public Works Committee Chair Public Hearing <br /> 2 Ordinance to amend Section 2 09 040 of the Bremerton Municipal Code (BMC) entitled "Office <br /> of the City Clerk — Duties" to appoint a temporary Deputy City Clerk in absence of City Clerk — <br /> Carol Etgen, City Clerk, and Nick Wofford, Finance Committee Chair Consent Agenda <br /> 3 Lease Purchase Agreement for 9 Toro Mowers for maintenance of Gold Mountain Golf <br /> Complex — Jeff Elevado, Parks & Recreation Department, and Jim McDonald, Public Safety <br /> and Parks Committee Chair Consent Agenda <br /> 4 License Agreement with Bremerton Farmer's Market for use of a portion of Evergreen Rotary <br /> Park — Jeff Elevado, Parks & Recreation Department, and Jim McDonald, Public Safety and <br /> Parks Committee Chair Consent Agenda <br /> 5 Grant Agreement with the Washington State Department of Ecology for Matan Park LID <br /> Improvements (Retrofit Project) constructed by Washington Conservation Corps (WCC) — <br /> Colette Berna, Parks & Recreation Department, and Jim McDonald, Public Safety and Parks <br /> Committee Chair Consent Agenda <br /> B EXECUTIVE SESSION - The Council convened for a 30 -minute Executive Session to discuss <br /> Potential Litigation and Pending Litigation per RCW 42 30 110(1)(i) <br /> 05 Motion to approve the Settlement Agreement was made by McDonald, and seconded by <br /> Arends <br /> President Maupin asked if any member of the public had a question or comment <br /> Bob Dollar asked why the City was "giving money away" <br /> President Maupin opened discussion to the Council <br /> Mr. Maupin summarized that the $1 15 million Settlement Agreement was in lieu of going to <br /> court, where the City risked being responsible for the full $2- million <br /> Roger Lubovich City Attorney, added that if the City went to court and lost, there was not only a <br /> risk of owing the full $2- million, but interest and attorney fees would be added as well <br />
